Joseph,\n\nBrahmasandra-Karikere Road,\n\nA'Brahmasandra, Kora Hobli,\n\nTumkur Taluk. PETITIONER\/S\n\n[By Sri. G.R.Prakash, Adv.)\n\n\n\n \n\n5. It is relevant to note that the 1\"\npetitioner is the daughterwinwlaw of the respondent<\/pre>\n<p>and petitioners 3 and 4 are minor children of the 3&#8243;<\/p>\n<p>petitioner. A minor should not be _pnt ltd&#8217;-dnya<\/p>\n<p>injustice for the negligence ,of jits&#8221;iguardianiu<\/p>\n<p>Furthermore, so far as the guardian is concerned, it<\/p>\n<p>is stated in her affida\u00e9itr prodnced :#hatWM\u00a7h\u00e9 his &#8221;<\/p>\n<p>suffering from polyp bleeding, \ufb01ne to which she was<br \/>\nadmitted in the hospital.i She&#8221;is a person from the<br \/>\nvillage background and has no worldly.Rnowledge. It<\/p>\n<p>is under these gircdmstand\u00e9\u00e9_\u00a3\ufb01at she did not file<\/p>\n<p>the written statement jand :the&#8217; objections to the<\/p>\n<p>application&#8217; within _the &#8220;time allowed. by law. The<\/p>\n<p>delay in filing the written statement and objections<\/p>\n<p>V to the application, in case of exceptional grounds<\/p>\n<p>l; are made out by the party, could be condoned and the<\/p>\n<p>written statement and objections to the application<\/p>\n<p>can be permitted compensating the delay by awarding<\/p>\n<p>u&#8217;*pcosts.&#8217;tpd So, taking into consideration these<\/p>\n<p>i%vcircumstances, I am of the opinion that the<\/p>\n<p>R~. petitioners have made out exceptional grounds to<\/p>\n<p>uifile written statement and also objections to the<\/p>\n<p>application filed under Order 39 Rule 2 and 2 CPC on<\/p>\n<p>payment of reasonable costs.
