CIVIL JUDGE (,I.E.DN.}',._K,G.'E.;  Q ~ \n\nTHIS 1\u00a5f{S}:A.'_V oN.1V1'5o'R----wVoRDERS THIS DAY,\nTHE COURT  _FOLLOW1NG:\n\n.~afk\\f\\\ufb01DDGMENT 1111\n unjanleees\ufb01nal:plaintiff in 0.S.No.184\/2000 on\n\nthe file the  Aclldvitiolnal Civil Judge [Jr.Dn.), K.G.F. is\n\n   Ciourtmin this appeal questioning the legality\n\nV   of the judgments of the courts below\n\ndiSmiSsi:igAi" his Suit for declaration and permanent\n\n' injunction.\n\n2. AS there has been a delay of 1156 days in filing\n\nH this appeal. The appellant has filed the application for\n\n\n\ncondonation of the said delay. The application is\n\nsupported by the affidavit of the appellant. Aslpgetflthe\n\nstatement made in the affidavit, the \n\nthe copies of the judgment and ~decree'f_VVof.--VI.th'e \n\nAppellate Court on 16.3.2006,iftheeeafteii' \n\nwith his counsel for the pnrpose of He'\n\nhas further stated thatt he'.lefe'l1'ei.ll'  than one year\nas such he was  counsel to file\nthe appeals    suffering from\nAsthma   to TB. Centre at\nBangalore'  thfan\u00e9fyears he took treatment\nas  on  ill--health, he could not meet\n\nhis 'Advocate-_and filefffappeal. Except filing an affidavit\n\n   effect  supporting document has been\n\n   that he was actually suffering from\n\nthe ailment stated in the affidavit. Therefore, the\n\nf ~ reasons stated in the affidavit have not been\n\n"'v-Vsulostantiated. Thus the long delay of 1156 days in\n\n \ufb01ling the appeal has not been satisfactorily explained.\n\ns'?\n\n@\/\n\n\n\nUnder these circumstances, no ground is made out to\nissue notice of the application for condonation of'-delay\n\nto the respondent.<\/pre>\n
3. I have also heard the learned  <\/p>\n
appellant to find out as to Whe_th.e_r_the’ <\/p>\n
any question of law.\n<\/p>\n
4. According to thellpia.intiff”he  of<\/p>\n

the’ application before the competent authority for<\/p>\n
  \ufb01vii-I|””‘.’the  Similarly, the respondent \/<\/p>\n
   applied for regrant. The Tahsildar who<\/p>\n
was the’ competent authority, by order dated 22.7.1998<\/p>\n
  Atreg\u00e9ranted the land in favour of the plaintiff and rejected<\/p>\n
7.the’claim of the defendant. The defendants preferred an<\/p>\n
l 2 “appeal before the Prl. District Judge at Kolar in Misc.<\/p>\n

\n1<\/span><\/p>\n
Appeal No.7 5\/98 as required by Section 3(2) of the said<\/p>\n
Act. However, in the said appeal, the defendaritsihherein<\/p>\n
in collision with the villagers created sornie <\/p>\n
taking undue advantage of the<i1'1i\u00bbteraeyllof  ' f <\/p>\n
and playing fraud and by
\ncompromise presented bet\u00b0o_re..the
\non that basis the Appellate  of the
\nappeal. After coming atoll of the said
\ncompromise,   field the present
\nsuit for  order based by the
\n    of the compromise petition
\n\ufb01led  \/98 is null and void on the<\/p>\n
ground   obtained by fraud and<\/p>\n
 _Inisrep"resentatioVn'.lll He also sought for permanent<\/p>\n
 injunction.T~_–~'<\/p>\n
 respondents \/ defendants contested the<\/p>\n
suit. on several grounds including the jurisdiction of the<\/p>\n
 sflotzrt to entertain such suit. The Trial Court framed<\/p>\n
several issues. After the parties led evidence, the Trial
\nCourt dismissed the suit answering the rnate:'ial'jissues<\/p>\n
in the negative against the plaintiff. On <\/p>\n
plaintiff, the Lower Appellate Court the ' ; <\/p>\n
judgment of the trial court\n<\/p>\n
6. As could be seenl\u00bbfro’1T1pSec’tion   Act
\nexclusive jurisdiction’  llquestions and
\nappeals enumerated  is vested with
\nthe oompeten:tV’V:~ .’}f who is the<\/p>\n
designated  Act. Against the order<\/p>\n
of the conipeteifiti authority aggrieved party has a right of
\nappeal ‘top theit}’I)ilstrict:_'”_.’Judge under Sub–Section (2) of<\/p>\n
S_ezi:tio’r1  the____Act. From this. it is clear that the<\/p>\n
‘ of the Civil Court to adjudicate upon any of<\/p>\n
 under Section 3(1) (a) to {d} is impliedly<\/p>\n
excluded; Though the plaintiff brought the suit for<\/p>\n

In my opinion, such a suit was\u00bb.~m_isconce’ivefd <\/p>\n
not maintainable before the  <\/p>\n
the Trial Court entertainedfdfie suit .and_ffafterrecording’ t<\/p>\n
the evidence held that the_.p1a–intiff-\u00bbis not entitled for the
\nrelief. Unfortunately, the   not go into the<\/p>\n
question as. whether  hast’jurisdiction to entertain<\/p>\n
the  Appellate Court also did not go
\ninto   However, on fact, both the<\/p>\n
coiirts   held that the plaintiff has not<\/p>\n
 , suatisfactorily established that the compromise entered<\/p>\n
   ,,.ff.vas,t’.c’-Fvitiated by fraud played by the<\/p>\n
reispovndeunts\/defendants, and by misrepresentation.<\/p>\n
 .. Under\ufb01these circumstances, I am of the considered<\/p>\n
‘ “‘._V’op–inion that this appeal does not involve any question of<\/p>\n
“law much less substantial question of law.<\/p>\n
7. In this Vi\u20acW of the matter, there is no merit in<\/p>\n
this appeal. There are no reasons for issuir1g..’n.oti Ce_ of<\/p>\n
the application or of the appeal to the  <\/p>\n
this View of the matter, the\u00bb ‘appIQiCe\u00a7tVio1:i<\/p>\n
