THE BLOCK DEVELOPMENT OFFICER            null KALYANPUR,\n         DISTT.- SAMASTIPUR\n                                         -----------\n<\/pre>\n<p>2.   20.9.2010              Heard learned counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                            Counter affidavit has been filed on behalf of<\/p>\n<p>                  respondent nos. 2, 3 and 5. No counter affidavit has been<\/p>\n<p>                  filed by respondent no. 6.\n<\/p>\n<p>                            The petitioner was transferred on 5.9.2009 from<\/p>\n<p>                  the Block Office, Kalyanpur to the District Agriculture<\/p>\n<p>                  Office, Begusarai. His scheduled superannuation was on<\/p>\n<p>                  31.1.2010.    His L.P.C. was issued from the Kalyanpur<\/p>\n<p>                  Block by respondent no. 6 on 30.1.2010 with an<\/p>\n<p>                  endorsement for recovery of Rs. 59,500\/-.<\/p>\n<p>                            The counter affidavit of respondent nos. 2, 3<\/p>\n<p>                  and 5 states that the other grievances with regard to<\/p>\n<p>                  salary etc. has been redressed, which is not disputed on<\/p>\n<p>                  behalf of the petitioner.\n<\/p>\n<p>                            Learned counsel for the State submits that why<\/p>\n<p>                  the endorsement for recovery of the aforesaid amount was<\/p>\n<p>                  entered into the L.P.C. is for the respondent no. 6 to<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>           answer.\n<\/p>\n<p>                     Counsel for the petitioner submits that no<\/p>\n<p>           endorsement to his prejudice could be done ex parte<\/p>\n<p>           without   any   notice   to   show   cause    as   it   is   an<\/p>\n<p>           administrative\/quasi judicial adjudication.<\/p>\n<p>                     It is the specific assertion of the petitioner that<\/p>\n<p>           in Paragraph-12 of the writ application, no show cause<\/p>\n<p>           notice has been issued before endorsement.<\/p>\n<p>                     This Court holds that the said endorsement for<\/p>\n<p>           Rs. 59,500\/- in his last pay certificate cannot be enforced<\/p>\n<p>           till such time that the petitioner is given a show cause<\/p>\n<p>           notice disclosing the grounds for the same and final<\/p>\n<p>           appropriate orders are passed after consideration of the<\/p>\n<p>           cause shown by him.\n<\/p>\n<p>                     The writ application stands allowed.<\/p>\n<pre>P.
