With the consent of the<br \/>\n\tlearned Counsel appearing for both the sides, the matter is finally<br \/>\n\theard.\n<\/p>\n<p>The<br \/>\n\tpetitioner has preferred the petition for the relief, inter alia, to<br \/>\n\tquash and set aside the decision dated 27.5.2008 \u00fd  Annexure \u00fdSA\u00fd\u00fd<br \/>\n\tof the Election Officer and it is also prayed that the Election<br \/>\n\tOfficer be directed to prepare voters&#8217; list as per the bye-laws and<br \/>\n\tthe rules for different constituencies as referred to in the memo of<br \/>\n\tthe petition.\n<\/p>\n<p>Mr.Shelat,<br \/>\n\tlearned Sr. Counsel appearing with Mr.Rana for the petitioner, at<br \/>\n\tthe outset, declared before the Court that the petitioner is<br \/>\n\tpressing the present petition only for the purpose of maintaining<br \/>\n\tthe challenge that the voters&#8217; list are required to be prepared as<br \/>\n\tper the constituencies provided in the bye-laws of specified Society<br \/>\n\tsince it provides for two separate constituencies of Utpadak-Members<br \/>\n\tand General Members (Non-Utpadak-Members).<br \/>\n\t He also declared before the Court that so far as the other grounds<br \/>\n\tstated in the petition pertaining to the inclusion or non-inclusion<br \/>\n\tof certain persons as Utpadak-Members<br \/>\n\tor as Non-Utpadak-Members<br \/>\n\tin the voters&#8217; list are concerned, the petitioner, if so advised,<br \/>\n\tmay challenge such action of the election authority after the<br \/>\n\telection is over as per the remedy provided under Section 145U of<br \/>\n\tthe Gujarat Coop. Societies Act (hereinafter referred to as \u00fdSthe<br \/>\n\tAct\u00fd\u00fd) read with the relevant Rules.\n<\/p>\n<p>\tWe<br \/>\n\thave heard Mr.Shelat, learned Sr. Counsel with Mr.Rana for the<br \/>\n\tpetitioner and Ms.Patel, learned AGP for the State Authorities<br \/>\n\tincluding the Election Officer and Mr.Mehta, learned Counsel for<br \/>\n\trespondent No.3.\n<\/p>\n<p>\tThe<br \/>\n\tprincipal grievance, on the part of the petitioner, appears to be<br \/>\n\tthat even as per the Rule 4 of the Gujarat Specified Cooperative<br \/>\n\tSocieties Elections to Committees Rules, 1982 (hereinafter referred<br \/>\n\tto as \u00fdSthe Rules\u00fd\u00fd) and more particularly Sub-Rule (1) read with<br \/>\n\tthe other relevant Rules for finalization of the voters&#8217; list, the<br \/>\n\tvoters&#8217; list of a specified Society, whose election is to be held,<br \/>\n\tis required to be prepared as provided in the bye-laws and the said<br \/>\n\taspect in the submission of the learned Counsel for the petitioner<br \/>\n\tis apparent from the language of the Rule.\n<\/p>\n<p>\tIt<br \/>\n\tappears that the learned Counsel for the respondent Society has also<br \/>\n\tnot disputed the requirement of preparation of the voters&#8217; list as<br \/>\n\tper the constituencies provided in the bye-laws. Even on behalf of<br \/>\n\tthe election officer, the learned AGP is not in a position to<br \/>\n\tdispute the requirement for preparation of the voters&#8217; list as per<br \/>\n\tthe constituencies provided in the bye-laws.\n<\/p>\n<p>\tIt<br \/>\n\tdeserves to be recorded that as per Rule 4, the provisional list is<br \/>\n\trequired to be prepared and the language used in Sub-Rule (1) of<br \/>\n\tRule 4, relevant of which reads as under:-\n<\/p>\n<p>\t\u00fdSIf<br \/>\n\tdifferent constituencies are provided in the bye-laws, the names of<br \/>\n\tvoters shall be arranged constituency-wise as laid down in the<br \/>\n\tbye-laws.\u00fd\u00fd<\/p>\n<p>\tThe<br \/>\n\tperusal of the bye-law No.5 providing for membership speaks for two<br \/>\n\ttypes of membership; one for Utpadak Membership and another<br \/>\n\tfor General Membership (Non-Utpadak Membership).  Bye-law<br \/>\n\tNo.21 provides that the Managing Committee shall be comprising of<br \/>\n\ttotal 25 members, out of which 15 representatives shall be from<br \/>\n\tamongst the members holding Utpadak shares as provided under<br \/>\n\tBye-law No.5(a) and one representative shall be from amongst the<br \/>\n\tMembers as provided under Bye-law No.5(b) being General<br \/>\n\tMembers\/Non-Utpadak Members.\n<\/p>\n<p>\tTherefore,<br \/>\n\ton conjoint reading of bye-law 5 read with bye-law No.21(a) and (b),<br \/>\n\tthere is considerable force in the submission of the learned Counsel<br \/>\n\tfor the petitioner and as the said aspect is not disputed by the<br \/>\n\tlearned Counsel for the respondent Society, nor on behalf of the<br \/>\n\tElection Officer, and no other legal position is brought to the<br \/>\n\tnotice of this Court, we find that it may not be necessary for this<br \/>\n\tCourt to further elaborate the reasons on such aspects.  Suffice it<br \/>\n\tto state that as per the Scheme of the relevant Rules read with the<br \/>\n\tbye-laws, constituencies are required to be prepared of the voters<br \/>\n\tseparately and accordingly the representatives are also required to<br \/>\n\tbe elected from the respective constituencies of the voters&#8217; list.\n<\/p>\n<p>\tIt<br \/>\n\tis an admitted position that the Election Officer as such prepared<br \/>\n\tthe voters&#8217; list separately for both the categories of Utpadak<br \/>\n\tmembers and General members, however, it appears that the stand of<br \/>\n\tthe Election Officer, as per the impugned order was that the voters<br \/>\n\tof both the constituencies shall be entitled to cast their vote in<br \/>\n\trespect of the members to be elected holding Utpadak shares<br \/>\n\tas well as holding non-Utpadak shares.  If the bye-law<br \/>\n\tprovides for separate constituencies and the representation of the<br \/>\n\tmembers in the Managing Committee from amongst the voters of<br \/>\n\tseparate constituencies, as a normal principle, only such voters<br \/>\n\tshall be entitled to elect their representative as per their<br \/>\n\tconstituency.  We are inclined to take the aforesaid view since<br \/>\n\tthere is no other provision in the bye-laws brought to our notice,<br \/>\n\textending the rights of all the voters in respect of all the<br \/>\n\tconstituencies or enabling them to cast their vote in respect of<br \/>\n\telection of all the members of the Managing Committee.\n<\/p>\n<p>\tThe<br \/>\n\taforesaid is coupled with the circumstances that even in the past,<br \/>\n\tthe election of the respondent No.3 Society was being held<br \/>\n\tconstituency-wise and the representatives were elected<br \/>\n\tconstituency-wise from amongst the voters of such constituency<br \/>\n\tseparately.\n<\/p>\n<p>\tIt<br \/>\n\tis well settled that if without disturbing the election, this Court,<br \/>\n\tin exercise of its power under Article 226 of the Constitution of<br \/>\n\tIndia, is in a position to render justice, such power can be<br \/>\n\texercised.  As the voting is to take place on 23.6.2008 and as the<br \/>\n\tvoters&#8217; list is already separately prepared by the Election Officer<br \/>\n\tand as it is an admitted position that the nominations as well as<br \/>\n\tthe candidates, who are to contest election, are separate namely;<br \/>\n\tfrom amongst Utpadak-Members and from amongst<br \/>\n\tNon-Utpadak-Members, if direction is given to the Election<br \/>\n\tOfficer to hold the election constituency-wise for casting the vote<br \/>\n\tby such members, included in the respective constituencies, it would<br \/>\n\tnot result into arresting the election process and holding of such<br \/>\n\telection would, on the contrary, result into in accordance with the<br \/>\n\tstatutory Rules read with the Bye-laws.\n<\/p>\n<p>\tHence,<br \/>\n\tthe following orders:-\n<\/p>\n<p>\t(a)\t\tThe<br \/>\n\tElection Officer shall hold the election of respondent No.3 Society<br \/>\n\tas per the election programme, copy whereof is produced at Annexure<br \/>\n\t\u00fdSF\u00fd\u00fd, keeping in view the observations made hereinabove and shall<br \/>\n\tpermit casting of vote by the voters, included in the respective<br \/>\n\tconstituencies, qua candidates to be elected in that respective<br \/>\n\tconstituencies.\n<\/p>\n<p>\tThe<br \/>\n\tlearned AGP, on behalf of the Election Officer, has also declared<br \/>\n\tbefore the Court that accordingly the election shall be held on<br \/>\n\t23.6.2008.\n<\/p>\n<p>\tIt<br \/>\n\tis clarified that this Court has not gone into the aspect of<br \/>\n\tgenuineness of the respective voters to be included in the<br \/>\n\trespective constituencies of Utpadak-Members or<br \/>\n\tNon-Utpadak-Members, as the case may be, since, in any case,<br \/>\n\tfor such question or dispute, there is an express remedy provided<br \/>\n\tunder Section 145U of the Act, after the election is over.\n<\/p>\n<p>\tIn<br \/>\n\tview of the above, the impugned order \u00fd  Annexure \u00fd  A shall stand<br \/>\n\tmodified to the aforesaid extent.\n<\/p>\n<p>\tThe<br \/>\n\tpetition is partly allowed to the aforesaid extent.  Rule made<br \/>\n\tabsolute accordingly.
