The petitioner, an Assistant Engineer in the State<br \/>\n                     of Bihar, has filed this petition under Article 226 of the<br \/>\n                     Constitution to claim interest over the sum of Rs. 58,065\/-<br \/>\n                     being the amount of arrears of salary and the traveling<br \/>\n                     allowance for the period from 16.04.1989 to 07.05.1990<br \/>\n                     paid to him on 22.10.2008.\n<\/p>\n<p>                                  The claim deserves to be rejected on the principle<br \/>\n                     analogous to Explanation V to Section 11 C.P.C. The<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>        petitioner had earlier approached this Court in the same<br \/>\n        subject matter in CWJC No. 535 of 2002. While deciding<br \/>\n        the said petition this Court (Coram: Hon&#8217;ble Mr. Justice<br \/>\n        Chandramauli Kumar Prasad, J, as he then was) by order<br \/>\n        dated 19.05.2008 directed the State Government to<br \/>\n        consider the claim and to pay the amount due. Learned<br \/>\n        Advocate Mr. Bibhakar Tiwary has appeared for the writ<br \/>\n        petitioner. He has submitted that the petitioner did ask for<br \/>\n        payment of interest over the amounts of arrears of salary<br \/>\n        and the traveling allowance. He candidly admits that the<br \/>\n        said relief was not granted vide order dated 19.05.2008.\n<\/p>\n<p>                     In my opinion the claim for interest now raised in<br \/>\n        the present petition is barred by Explanation V to Section<br \/>\n        11 CPC which reads as under:\n<\/p>\n<blockquote><p>                     &#8220;Explanation V.- Any relief claimed in the<br \/>\n                     plaint, which is not expressly granted by the<br \/>\n                     decree, shall, for the purposes of this section,<br \/>\n                     be deemed to have been refused.&#8221;<\/p><\/blockquote>\n<p>                     For the aforesaid reason the petition is dismissed<br \/>\n        in limine.\n<\/p>\n<p>                                    ( R.M.
