Justice K.P.BALACHANDRAN\n\n Dated :12\/08\/2008\n\n O R D E R\n        J.B.KOSHY &amp; K.P.BALACHANDRAN, JJ.\n                  -------------------------------\n                W.A.NO.1850 OF 2005 (E)\n                -----------------------------------\n        Dated this the 12th day of August, 2008\n\n                      J U D G M E N T\n<\/pre>\n<p>KOSHY,J.\n<\/p>\n<\/p>\n<p>     First appellant is working as Confidential Assistant to the<\/p>\n<p>Motor Accident Claims Tribunal, Thalassery, and 2nd appellant<\/p>\n<p>is working as Confidential Assistant to the Additional District<\/p>\n<p>and Sessions Judge, Thalassery. As per the pay revision order<\/p>\n<p>(Ext.P1), confidential assistants to District Judges are entitled<\/p>\n<p>to Rs.350\/- as special allowance whereas confidential<\/p>\n<p>assistants to Subordinate courts are only entitled to Rs.60\/- as<\/p>\n<p>special allowance.     Contention of the appellants is that<\/p>\n<p>Additional District Courts and Motor Accident Claims Tribunal<\/p>\n<p>are holding the rank of District Judges, and therefore, they are<\/p>\n<p>also entitled to get Rs.350\/- as special allowance. Learned<\/p>\n<p>Single Judge in the impugned judgment found that only<\/p>\n<p>confidential assistants to District Judges are entitled to<\/p>\n<p>Rs.350\/-. Additional District Judges as well as Motor Accident<\/p>\n<p>Claims Tribunal cannot come into that category.          District<\/p>\n<p>Judge means only &#8216;Principal District Judge&#8217;. Learned Single<\/p>\n<p>Judge also noticed that in Ext.P1, confidential assistants to<\/p>\n<p><span class=\"hidden_text\">W.A.1850\/05                    2<\/span><\/p>\n<p>Special Judges and Enquiry Officers who are also holding the<\/p>\n<p>rank of District Judges are specifically mentioned to get<\/p>\n<p>Rs.350\/- as special allowance.     But the Additional District<\/p>\n<p>Judges are not mentioned. According to Ext.P1, confidential<\/p>\n<p>assistants to Presiding Officers of other Subordinate Courts<\/p>\n<p>other than District Courts are only entitled to get Rs.60\/- as<\/p>\n<p>special allowance.    The confidential assistants to Principal<\/p>\n<p>Enquiry Commissioner and Special Judges are also entitled to<\/p>\n<p>Rs.350\/-.   Since the Additional District Judges and Motor<\/p>\n<p>Accidents Claims Tribunal are not mentioned separately, the<\/p>\n<p>confidential assistants attached to them are not entitled to get<\/p>\n<p>Rs.350\/- but only Rs.60\/- as they are confidential assistants to<\/p>\n<p>Presiding Officers of Subordinate Courts, and we agree with<\/p>\n<p>the views of the learned Single Judge. We are not repeating<\/p>\n<p>the reasonings of the learned Single Judge, and hence, this<\/p>\n<p>appeal is dismissed.
