APP (DB) No.823 of 2010\n                           Subedar Singh &amp; Anr\n                                 Versus\n                              State of Bihar\n                                -----------\n<\/pre>\n<p>4   04.11.2011            We have seen the record of the Juvenile Justice Board,<\/p>\n<p>                 Bhojpur at Ara, forwarded to this Court by Sri Sumit Ranjan, Judicial<\/p>\n<p>                 Magistrate, Ist Class, Bhojpur at Ara under his Letter No. 177 dated<\/p>\n<p>                 5.9.2011 passed in death reference and analogous appeals.<\/p>\n<p>                           By the said order dated 3.5.2011 noticing the plea of<\/p>\n<p>                 juvenility raised on behalf of (i) Bela Singh of Cr. Appeal (DB) No.<\/p>\n<p>                 652 of 2010, (ii) Santosh Singh of Cr. Appeal (DB) No. 676 of 2010,<\/p>\n<p>                 (iii) Manoj Singh of Cr. Appeal (DB) No. 688 of 2010 and (iv) Dilip<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>           Singh appellant no. 3 of Cr. Appeal (DB) No. 727 of 2010. This Court<\/p>\n<p>           had referred the matter to the Juvenile Justice Board. Upon inquiry, the<\/p>\n<p>           Juvenile Justice Board has found Bela Singh, Manoj Singh and Dilip<\/p>\n<p>           Singh to be juvenile within the meaning of Section 2 (k) of the<\/p>\n<p>           Juvenile Justice (Care and Protection of Children) Act, 2000 as<\/p>\n<p>           amended. So far as appellant Santosh Singh is concerned, he has been<\/p>\n<p>           found to be not juvenile on the date of occurrence.\n<\/p>\n<p>                     Learned counsels for the State and for the informant do not<\/p>\n<p>           challenge the report of the Juvenile Justice Board. In that view of the<\/p>\n<p>           matter, this Court has no option but to accept the finding of the<\/p>\n<p>           Juvenile Justice Board, declaring Bela Singh, Manoj Singh and Dilip<\/p>\n<p>           Singh as aforesaid to be juvenile in conflict with law, which fact would<\/p>\n<p>           have to be kept in mind when ultimately this Court is required to pass a<\/p>\n<p>           sentence against them because the sentence, that can now be passed,<\/p>\n<p>           would be governed by the provisions of the Juvenile Justice (Care &amp;<\/p>\n<p>           Protection of Children) Act, 2000 and not as per provisions of the<\/p>\n<p>           Code of Criminal Procedure and the Indian Penal Code.<\/p>\n<p>                     This death reference with associated appeals are now ready<\/p>\n<p>           for final hearing.
