Justice V.GIRI\n\n Dated :06\/06\/2008\n\n O R D E R\n                          V.GIRI, J.\n           -------------------------\n               W.P.(C).No.16773 of 2008 V\n           -------------------------\n              Dated this the 6th day of June, 2008.\n\n\n                        JUDGMENT\n<\/pre>\n<p>          The petitioner was appointed as Sub Inspector of<\/p>\n<p>Fisheries. Promotion to the post of Inspector of Fisheries,<\/p>\n<p>as per the Special Rules, is by way of promotion from Sub<\/p>\n<p>Inspectors, by direct recruitment and appointment by<\/p>\n<p>transfer from among Upper Division Clerks.          A ratio of<\/p>\n<p>1:1:1 is prescribed as per the Special Rules. The<\/p>\n<p>petitioner&#8217;s grievance is that several Upper Division Clerks<\/p>\n<p>have been posted against interchangeable posts of<\/p>\n<p>Assistant Extension Officer or Technical Assistant and they<\/p>\n<p>are permitted to continue in such posts.           Though the<\/p>\n<p>promotion given to the petitioner is provisional subject to<\/p>\n<p>availability of Public Service Commission hands, it is<\/p>\n<p>pointed out that the number of persons who are appointed<\/p>\n<p>to the post of Inspector and as Assistant Extension Officers<\/p>\n<p>or Technical Assistants are far in excess of the 1\/3rd quota<\/p>\n<p>that is available to be transferees as such. These facts are<\/p>\n<p>highlighted in Ext.P5 representation to the Director of<\/p>\n<p>Fisheries. This writ petition has been filed, inter alia,<\/p>\n<p>W.P.(C).NO.16773\/08<\/p>\n<p>                            :: 2 ::\n<\/p>\n<p>\nseeking a direction to consider Ext.P5 and also to prevent<\/p>\n<p>the reversion of the petitioner as such.<\/p>\n<p>         2.   I heard learned counsel for the petitioner<\/p>\n<p>and the learned Government Pleader.<\/p>\n<p>         3. No doubt, if the Special Rules prescribe a<\/p>\n<p>ratio of 1:1:1 among the promotees, direct recruits and<\/p>\n<p>transferees appointed on transfer, then the same will<\/p>\n<p>have to be maintained by the Government and the<\/p>\n<p>appointing authority.    But, insofar as the petitioner&#8217;s<\/p>\n<p>reversion is concerned, it is clear that it is only to<\/p>\n<p>accommodate the Public Service Commission hands as<\/p>\n<p>such.   I cannot, therefore, interdict the Director from<\/p>\n<p>doing so. But the petitioner has highlighted the alleged<\/p>\n<p>excessive posting of Upper Division Clerks appointed as<\/p>\n<p>Assistant Extension Officers or Technical Assistants. This<\/p>\n<p>is a matter that has to be looked into by the Director.<\/p>\n<p>         In the result, the writ petition is disposed of<\/p>\n<p>directing the 1st respondent to consider Ext.P5 and take<\/p>\n<p>appropriate action within a period of two months from the<\/p>\n<p>date of receipt of a copy of this judgment.
