DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 28\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tpresent application has been filed by the applicant for modification<br \/>\n\tof the condition 6(f) imposed while releasing the petitioner on bail<br \/>\n\tas per order passed by this Court (Coram:R.P.Dholakia, J.) in<br \/>\n\tCriminal Miscellaneous Application No.1524 of 2004 dated 11.03.2004.<br \/>\n\tCondition, which is sought to be modified, reads as under:\n<\/p>\n<p>&#8220;[f]<br \/>\n\t\t\t\t surrender his Passport, if any, to the lower Court within a<br \/>\n\t\t\t\tweek;&#8221;\n<\/p>\n<p>Mr.Ramnandan<br \/>\n\tSingh, learned advocate for the applicant submitted that the<br \/>\n\tapplicant desires to visit China and U.S.A. for the purpose of<br \/>\n\tbusiness for a period of six months, and, therefore, present<br \/>\n\tapplication may be allowed modifying the condition.\n<\/p>\n<p>As<br \/>\n\tit transpires from the averments, it is also stated about visit<br \/>\n\tEuropean countries as well as U.S.A and China, there is no definite<br \/>\n\ttime schedule. Therefore, considering the present application, the<br \/>\n\tPassport is ordered to be released for the purpose of making<br \/>\n\tarrangement for his travel abroad and for taking steps for Visa.<br \/>\n\tHowever, the applicant shall give the detail itinerary with regard<br \/>\n\tto his travel abroad either at U.S.A. or China for limited or<br \/>\n\tspecific period of one year and shall surrender his passport<br \/>\n\ton his return, in either case, on or before first week of August,<br \/>\n\t2011.\n<\/p>\n<p>With<br \/>\n\tthe above observations and directions, present application is<br \/>\n\tallowed. Rule is made absolute to the aforesaid extent. Direct<br \/>\n\tService is permitted.\n<\/p>\n<p>[Anant<br \/>\nS.
