JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\nDate\n: 14\/11\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled, with the following prayers:\n<\/p>\n<p>&#8220;(A)\tYour<br \/>\nLordships may be pleased to issue a writ of mandamus or any other<br \/>\nappropriate writ, order or direction directing the respondents to<br \/>\ngrant the permission for shifting the school from Shergadh to Keshod;\n<\/p>\n<p>and<br \/>\nin the alternative<\/p>\n<p>(B)\tYour<br \/>\nLordships may be pleased to issue a writ of mandamus or any other<br \/>\nappropriate writ, order or direction directing the respondents to<br \/>\nconsider the application of the petitioner for shifting the school to<br \/>\nKeshod from Shergadh and grant permission for the same;\n<\/p>\n<p>(C)\tPending<br \/>\nadmission, hearing and final disposal of this writ petition, Your<br \/>\nLordships may be pleased to direct the respondents to consider the<br \/>\napplication of the petitioner for shifting the school and place the<br \/>\norder before this Hon&#8217;ble Court;\n<\/p>\n<p>(D)\tBe<br \/>\npleased to pass such other and further reliefs as may be deemed just<br \/>\nand proper by Your Lordships in the facts and circumstances of the<br \/>\ncase.&#8221;\n<\/p>\n<p>2.\tAt<br \/>\nthe outset, Ms.Mamta R. Vyas, learned advocate for the petitioner,<br \/>\nstates that the petitioner has made a representation dated 01.11.2010<br \/>\nfor shifting the School in question, which has not been considered or<br \/>\ndecided by respondent No.2. It is further submitted that the interest<br \/>\nwould be met, if respondent No.2 is directed to consider and decide<br \/>\nthe same, within the time bound period.\n<\/p>\n<p>3.\tUpon<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioner, the following order is passed:\n<\/p>\n<p>Respondent<br \/>\nNo.2 may consider and decide the  representation of the petitioner<br \/>\ndated 01.11.2010, in accordance with law, within a period of eight<br \/>\nweeks from the date of receipt of the copy of this order.\n<\/p>\n<p>\tThe<br \/>\npetition is disposed of, in the above terms, without entering into<br \/>\nthe merits of the case.\n<\/p>\n<p>Direct<br \/>\nService of this order, is permitted.\n<\/p>\n<p>  (Smt.
