Justice S.S.SATHEESACHANDRAN\n\n Dated :11\/03\/2010\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n        ------------------------------------------------\n                  C.R.P.No.345 of 2005\n         -----------------------------------------------\n      Dated this the 11th day of March, 2010\n\n                         O R D E R\n<\/pre>\n<p>       Revision     is    directed       against      the  order<\/p>\n<p>passed  in   O.P.(Ele)No.48\/01           by    the    Additional<\/p>\n<p>District   Judge,      Thodupuzha         granting      enhanced<\/p>\n<p>compensation    to    the    respondent\/claimant.            The<\/p>\n<p>respondent in the above original petition, the<\/p>\n<p>Kerala  State       Electricity         Board      [hereinafter<\/p>\n<p>referred  to     as    &#8216;the     Board&#8217;]       has     filed  the<\/p>\n<p>revision  challenging        the     enhanced      compensation<\/p>\n<p>awarded to the respondent [hereinafter referred to<\/p>\n<p>as &#8216;the claimant&#8217;] towards loss suffered by him<\/p>\n<p><span class=\"hidden_text\">by  the   drawing       of    Koothumkal-Panamkutty          110<\/span><\/p>\n<p>KV line through his property.              The Board has cut<\/p>\n<p>and  removed      some      trees      from      the    property<\/p>\n<p>of the claimant for the drawing of line.                     The<\/p>\n<p>Board assessed and paid compensation of Rs.28,957\/-<\/p>\n<p>towards  the     loss     suffered       by     the     claimant.<\/p>\n<p>C.R.P.No.345 of 2005<\/p>\n<p>                        :: 2 ::\n<\/p>\n<p>\nDissatisfied  with   the   compensation paid,   the<\/p>\n<p>claimant filed the above original petition seeking<\/p>\n<p>enhanced compensation.\n<\/p>\n<p>       2.   The learned District Judge re-assessed<\/p>\n<p>the compensation with reference to the materials<\/p>\n<p>produced  and   awarded enhanced   compensation of<\/p>\n<p>Rs.18073\/- to the claimant directing the Board to<\/p>\n<p>pay the said sum with interest fixed.   The amount<\/p>\n<p>so awarded is excessive and unreasonable is the<\/p>\n<p>challenge raised   by  the   Board in  the  present<\/p>\n<p>revision impeaching the correctness of the order<\/p>\n<p>rendered by the learned District Judge.<\/p>\n<p>       3.    I heard the learned counsel for the<\/p>\n<p>petitioner.\n<\/p>\n<p>       4.    The learned counsel for the Board<\/p>\n<p>contended that no worth mentioning evidence was<\/p>\n<p>tendered in the case to claim any excess amount<\/p>\n<p>C.R.P.No.345 of 2005<\/p>\n<p>                        :: 3 ::\n<\/p>\n<p>\nthan what was awarded and paid earlier.<\/p>\n<p>       5.  Perusing the impugned order, I find that<\/p>\n<p>the court below has re-assessed the compensation<\/p>\n<p>taking note that the Board had adopted annuity<\/p>\n<p>return of 10% to assess the compensation payable<\/p>\n<p>for the trees cut and removed.        Following the<\/p>\n<p>principles laid down in <a href=\"\/doc\/452127\/\">Kumba Amma v. K.S.E.B.<\/a><\/p>\n<p>{2000(1) K.L.T. 542}, the court below directed both<\/p>\n<p>the parties to file statements to re-assess the<\/p>\n<p>compensation adopting annuity return at 5%.    I do<\/p>\n<p>not find any impropriety or illegality in the<\/p>\n<p>direction given by the court below for re-assessing<\/p>\n<p>the compensation in the lines indicated as above.<\/p>\n<p>Pursuant to such direction only the claimant filed<\/p>\n<p>a statement.   It appears that the said statement<\/p>\n<p>was not only not challenged by the Board, but,<\/p>\n<p>practically, conceded   to.   Re-assessment of  the<\/p>\n<p>C.R.P.No.345 of 2005<\/p>\n<p>                        :: 4 ::\n<\/p>\n<p>\ncompensation with respect to the trees cut and<\/p>\n<p>removed adopting the annuity return of 5% gave rise<\/p>\n<p>to the enhanced compensation of Rs.18,073\/- and<\/p>\n<p>that was ordered by the learned District Judge.  By<\/p>\n<p>no stretch of imagination the compensation so paid<\/p>\n<p>can be considered as excessive or unreasonable.<\/p>\n<p>       There is no merit in the revision.
