Mehta for petitioner and learned<br \/>\n\tAdvocate Ms.Manisha Lavkumar for respondent Electricity<br \/>\n\tCompany.Learned Advocate Ms. Manisha Lavkumar for respondent<br \/>\n\telectricity company seeks leave to amend affidavit in reply which is<br \/>\n\tgranted.\n<\/p>\n<p>In<br \/>\n\tthis petition, petitioner has challenged action on the part of<br \/>\n\trespondent   Electricity Company in disconnecting power supply of<br \/>\n\tpetitioner&#8217;s cell site generates in village Baradiya by issuing show<br \/>\n\tcause notice dated 7th May, 2010 to proceed against<br \/>\n\tpetitioner under section 135 and 138 of the Electricity Act, 2003<br \/>\n\tasking petitioner to give an Indemnity Bond.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Mehta for petitioner submitted that respondent<br \/>\n\tElectricity Company has not provided any provisional assessment to<br \/>\n\tpetitioner for which petitioner is prepared to pay amount without<br \/>\n\tprejudice to his rights and contentions, so, petitioner may be able<br \/>\n\tto get reconnection of electricity from respondent electricity<br \/>\n\tcompany.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Ms. Manisha Lavkumar for respondent Electricity Company has<br \/>\n\tsubmitted that detailed affidavit in reply has been filed by<br \/>\n\trespondent company. Considering affidavit in reply filed by<br \/>\n\trespondent company, para 12 thereof is quoted as under:\n<\/p>\n<p> 12.\tI<br \/>\n\tsay and submit that accordingly, under the provisions of sections<br \/>\n\t135 and 138 of the Act, necessary F.I.R. is also registered with<br \/>\n\tGujarat Urja Vikas Nigam Ltd., Rajkot and the matter is being<br \/>\n\tinvestigated. I say and submit that the petitioner&#8217;s contention that<br \/>\n\the is ready and willing to pay any amount so stipulated under the<br \/>\n\tsupplementary bill and thereby entitled to his reconnection, is not<br \/>\n\ttenable in as much as the petitioner has been booked for offence<br \/>\n\tpunishable under section 135 and 138 of Indian Electricity Act, 2003<br \/>\n\twhereunder a duty is cast upon him to reveal the name of the person<br \/>\n\tfrom whom such external devices are obtained and in the event the<br \/>\n\tpetitioner is unable to state the name of such person he has to give<br \/>\n\tundertaking to the said effect that he is unaware of any such person<br \/>\n\tfrom whom such device has been purchased or obtained or he is is any<br \/>\n\tsuch know of. On his filing such undertaking, commercial connection<br \/>\n\twould be restored. Annexed hereto and marked as Annexure R2 is copy<br \/>\n\tof such undertaking which the petitioner is required to be furnished<br \/>\n\t on payment of necessary re-connection charges as stipulated under<br \/>\n\tthe Act.\n<\/p>\n<p>Therefore,<br \/>\n\tshe submitted that undertaking as referred to in above paragraph 12,<br \/>\n\tif it is to be submitted by petitioner to respondent electricity<br \/>\n\tCompany, then, respondent electricity company is prepared to<br \/>\n\treconnect electricity to the petitioner. Learned Advocate Mr. Mehta<br \/>\n\tfor petitioner submitted that petitioner will give such undertaking<br \/>\n\tas referred to in paragraph 12 within period of one week from today<br \/>\n\tand thereafter, Ms. Manisha Lavkumar, learned advocate for<br \/>\n\trespondent electricity company submitted that on the basis of such<br \/>\n\tundertaking, respondent company will reconnect power supply<br \/>\n\telectricity on payment of reconnection charges by petitioner<br \/>\n\timmediately after receiving undertaking from petitioner and<br \/>\n\treconnection charges. It is made clear by this court that in this<br \/>\n\tparticular case, no assessment has been made by respondent<br \/>\n\telectricity company and, therefore, it is required undertaking as<br \/>\n\treferred to in paragraph 12 by Respondent Company.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid observations and directions, present petition is<br \/>\n\tdisposed of by this court  without prejudice to rights and<br \/>\n\tcontentions of both parties and also without expressing any opinion<br \/>\n\ton merits. However, in case of any difficulty, it is open to both<br \/>\n\tparties to apply before this Court.
