HEMA, J.\n       - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                        B.A. No. 6450 of 2008\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n           Dated this the 29th day of October,2008\n\n                                 O R D E R\n<\/pre>\n<p>      Petition for anticipatory bail.\n<\/p>\n<p>      2. The alleged offences are under sections 498A read with<\/p>\n<p>section 34 IPC. According to the prosecution, 1st accused who is<\/p>\n<p>the husband of de facto complainant along with his parents<\/p>\n<p>allegedly harassed her demanding more money etc. 25<\/p>\n<p>sovereigns of gold and Rs.3 lakhs given at the time of marriage<\/p>\n<p>were misappropriated by them.\n<\/p>\n<p>      3. Learned counsel for petitioner submitted that                     1st<\/p>\n<p>accused studied only up to IX th Standard and de facto<\/p>\n<p>complainant is a Nurse by profession. She alleged that 1st<\/p>\n<p>accused was incompetent to consummate the marriage etc. and<\/p>\n<p>that she was not prepared to live with 1st accused. The marriage<\/p>\n<p>took place only on 1-3-2008 and within a short period the parties<\/p>\n<p>started living separately. The complaint was lodged on 22-9-<\/p>\n<p>2008.\n<\/p>\n<p>      4. On hearing both sides, I find that anticipatory bail can<\/p>\n<p>be granted on conditions. Hence, the following order is passed:-<\/p>\n<blockquote><p>      (1) Petitioner shall surrender before the Investigating<\/p>\n<p>             Officer within seven days from today and in the<\/p>\n<p>             event of his arrest, he shall be released on bail,<\/p>\n<p>BA 6450\/08                        -2-\n<\/p><\/blockquote>\n<blockquote><p>           on his executing a bond for Rs. 25,000\/- with two<\/p>\n<p>           solvent sureties each, for the like amount, to the<\/p>\n<p>           satisfaction of the arresting officer,    on the<\/p>\n<p>           following conditions:-\n<\/p><\/blockquote>\n<blockquote><p>           i)     Petitioner shall    report before  the<\/p>\n<p>                 Investigating   Officer  as  and   when<\/p>\n<p>                 directed   and    co-operate   with the<\/p>\n<p>                 investigation and make available for<\/p>\n<p>                 interrogation.\n<\/p><\/blockquote>\n<blockquote><p>           ii)   Petitioner shall not commit any offence<\/p>\n<p>                 while on bail.\n<\/p><\/blockquote>\n<blockquote><p>      This petition is allowed.<\/p>\n<\/blockquote>\n<blockquote><p>                                            K.HEMA, JUDGE.\n<\/p><\/blockquote>\n<blockquote><p>mn.<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Reji Baby vs State Of Kerala Through The Sub on 29 October, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 6450 of 2008() 1.
