Mr.R.Krishnamurthi,   learned   senior    counsel    and<br \/>\nMr.V.Ayyadurai,  learned counsel appearing for the review petitioner submitted<br \/>\nthat since recognition had been granted to the writ petitioner institution  it<br \/>\nwas  automatically  entitled  to affil he Madras University in view of section<br \/>\n14(6)(a) of the  National  Council  for  Teacher  Education  Act,  1993  which<br \/>\nstates:-\n<\/p>\n<p>&#8220;Every examining body shall, on receipt of the order under sub-section (4),&#8211;\n<\/p>\n<p>(a) grant affiliation to the institution where recognition has been granted.&#8221;\n<\/p>\n<p>                3.   Learned  counsel relied on the Division Bench decision of<br \/>\nthis Court in Writ Appeal No.4204 of 2004 etc.  batch <a href=\"\/doc\/172553\/\">(Bharatidasan University<br \/>\nv.  Dhanalakshmi Srinivasan).  We<\/a> have carefully perused  the  said  judgment.<br \/>\nThat  case  really  was concerne question whether no objection certificate was<br \/>\nrequired from the State Government before affiliation could be granted by  the<br \/>\nUniversity.  The Bench held it was not required.  However, learned counsel for<br \/>\nthe  review  petitioner  has relied on some observations made in that judgment<br \/>\nwhich are as follows:-\n<\/p>\n<p>&#8220;Further the NCTE Act contains adequate  provisions  as  regards  granting  of<br \/>\naffiliation  as  automatic  one  in  respect  of  institutions which have been<br \/>\ngranted with recognition by the NCTE.&#8221;\n<\/p>\n<p>                4.  In our opinion, the word &#8216;automatic&#8217; used in the aforesaid<br \/>\njudgment should not be treated to mean that the Madras University must blindly<br \/>\ngrant affiliation whenever an order of recognition by NCTE under the NCTE Act,<br \/>\n1993 is produced befo oubt section 14(6) says  that  the  examining  body,  on<br \/>\nreceipt  of  the  order  under  sub-section  (4)  of  section  14, shall grant<br \/>\naffiliation to the institution where recognition has been granted.    However,<br \/>\nthis  does  not mean that as soon as an order of recogniti on from the NCTE is<br \/>\nproduced before the University it must close its eyes and  straightaway  grant<br \/>\naffiliation.\n<\/p>\n<p>                5.   In  our  opinion,  when  a  recognition  order of NCTE is<br \/>\nproduced before the University, the University can make a limited  enquiry  as<br \/>\nto  whether  the  Regional  Committee before granting recognition followed the<br \/>\nprovisions of section 14(3)(a) of t, which states:-\n<\/p>\n<p>        &#8220;On receipt of an application  by  the  Regional  Committee  from  any<br \/>\ninstitution  under  sub-section  (1), and after obtaining from the institution<br \/>\nconcerned such other particulars as it may consider necessary, it shall&#8211;\n<\/p>\n<p>(a) if it is satisfied that such institution has adequate financial resources,<br \/>\naccommodation, library, qualified staff, laboratory and that it fulfills  such<br \/>\nother  conditions  required  for  proper  functioning of the institution for a<br \/>\ncourse or training in t eacher education, as may be determined by regulations,<br \/>\npass an order granting  recognition  to  such  institution,  subject  to  such<br \/>\nconditions as may be determined by regulations.&#8221;\n<\/p>\n<p>                6.   It  must  be  understood that a University is a centre of<br \/>\nhigher learning and naturally has to maintain its reputation and it will  like<br \/>\nto  grant  affiliation  only  to  a  college  which has the proper facilities,<br \/>\nqualified staff, financial resour<\/p>\n<p>                7.  We make take a hypothetical case.    Supposing  a  college<br \/>\nwhich  does  not  have  the  adequate  facilities,  qualified staff, financial<br \/>\nresources  etc.,  by  manipulation  or  some  fraud  obtains   a   recognition<br \/>\ncertificate  from the NCTE even though the pr er section 14(3)(a) has not been<br \/>\nfollowed, and then it applies for affiliation to the Madras  University,  does<br \/>\nthis  mean  that  the  Madras  University must close its eyes and even without<br \/>\nmaking any enquiry on its own whether section 14(3)(a) was complied wi th must<br \/>\nstraightaway grant affiliation?  Madras University is a prestigeous  univesity<br \/>\nwhich  has  produced outstanding scholars who have created a mark all over the<br \/>\nworld and we cannot accept the contention that Madras University must  blindly<br \/>\ngrant  affilia  tion  just  because  the  recognition  certificate  by NCTE is<br \/>\nproduced before it.  Of course, if in the limited enquiry as to whether before<br \/>\ngranting  recognition  the  Regional  Committee  had  followed  the  procedure<br \/>\nmentioned  in section 14(3)(a) the Madras Univers ity is satisfied that it was<br \/>\nfollowed then Madras University will have to grant  affiliation,  but  it  can<br \/>\ncertainly make  this  limited  enquiry before doing so.  After all, the degree<br \/>\nwhich will be granted will be of Madras University.\n<\/p>\n<p>                8.  Learned counsel for the review petitioner  submitted  that<br \/>\nthe college  concerned  has all the facilities which are required.  However in<br \/>\npara 6 of its counter affidavit  to  the  writ  petition  the  University  has<br \/>\nalleged  that  out  of  the 8 teacher aff of the college only one is qualified<br \/>\nwhile the others are not.  We need not go into this controversy, as we are  of<br \/>\nthe opinion that until affiliation is granted no college can admit students to<br \/>\na course  which leads to a degree of the University.  In th e present case the<br \/>\npetitioner-college admitted students although affiliation has not been granted<br \/>\nby the Madras University as yet.  In our opinion, this was wholly illegal.  We<br \/>\nhave already mentioned in our judgment dated 20.4.2005 that if  this  practice<br \/>\nof  admitting students even before affiliation is granted, is countenanced the<br \/>\nresult may be that if ultimately affiliation is not  granted  for  some  valid<br \/>\nreason  the  students  will  be left in the lurch and may lose time and money.<br \/>\nHence in our opinion  no  admi  ssion  can  be  granted  by  a  college  until<\/p>\n<p>affiliation  is first granted by the University, and consequently there cannot<br \/>\nbe any order of this Court permitting students to appear in  the  examinations<br \/>\nwhen the college has not even been granted affiliation.\n<\/p>\n<p>                9.   Learned  counsel for the review petitioner submitted that<br \/>\nthere is deemed affiliation of the college.  We do not accept this contention.<br \/>\nThere has to be an affiliation in fact and not a deemed affiliation.\n<\/p>\n<p>                10.
