SHAH\n\t\t\n\t\n\n \n\nDate\n: 10\/04\/2006 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>This<br \/>\n\tappeal is filed by the appellant ?  original opponent No.2 ?<br \/>\n\tGujarat State Road Transport Corporation under sec.173 of the Motor<br \/>\n\tVehicles Act, 1988 challenging the judgment and Award passed by the<br \/>\n\tMotor Accident Claims Tribunal (Main), Mehsana in Motor Accident<br \/>\n\tClaims Petition No.493 of 1984 dtd.24\/10\/1990.\n<\/p>\n<p>The<br \/>\n\trespondent No.1 herein ?  original claimant sustained injury in the<br \/>\n\tvehicular accident which took place between ST Bus bearing<br \/>\n\tregistration No.GRT-6935 and Jeep bearing registration NO.GRW-9606<br \/>\n\twhich occurred on 14\/3\/1984 at about 10.30 hrs, on Patan Chanasma<br \/>\n\tRoad. The driver of the Jeep also lost his life in the said<br \/>\n\tvehicular accident. The respondent  No.1 herein ?  original<br \/>\n\tclaimant was one of the passengers in the Jeep. He preferred Motor<br \/>\n\tAccident Claim Petition No.493 of 1984 before the learned Motor<br \/>\n\tAccident Claims Tribunal  (Main), Mehsana claiming compensation of<br \/>\n\tRs.9000.00 and the learned Tribunal by its impugned judgment and<br \/>\n\taward awarded Rs.5100.00 towards damages to the Jeep.  Being<br \/>\n\taggrieved and dissatisfied with the said judgment judgment and award<br \/>\n\tpassed by the learned Motor Accident Claims Tribunal (Main), Mehsana<br \/>\n\tin Motor Accident Claims Petition No.493 of 1984 dtd.24\/10\/1990, the<br \/>\n\tappellant ?  original opponent No.2 has preferred the present First<br \/>\n\tAppeal.\n<\/p>\n<p>The<br \/>\n\tmain contention raised and the only submission made on behalf of the<br \/>\n\tappellant  to assail the impugned judgment and award  passed by the<br \/>\n\tMotor Accident Claims Tribunal is on the point of negligence on the<br \/>\n\tground of contributory negligence on the part of the driver of the<br \/>\n\tJeep. It is submitted that the tribunal has materially erred in not<br \/>\n\trelying upon the version and\/or the statement of driver of the ST<br \/>\n\tBus  and has materially erred in not holding the driver of the Jeep<br \/>\n\tas negligent in driving the Jeep, due to which the accident has<br \/>\n\ttaken place and therefore, it is requested to allow the present<br \/>\n\tappeal.\n<\/p>\n<p>On<br \/>\n\tthe other hand, it is submitted on behalf of the respondent ?<br \/>\n\toriginal claimant that in the facts and circumstances of the case<br \/>\n\tand looking to the documentary evidence and on appreciation of<br \/>\n\tevidence, the tribunal has not held  the driver of the Jeep as<br \/>\n\tnegligent and has held the driver of the ST Bus solely responsible<br \/>\n\tand negligent  for the accident in question and therefore, it is<br \/>\n\trequired to dismiss the present appeal.\n<\/p>\n<p>Heard<br \/>\n\tthe learned advocates appearing on behalf of the parties and perused<br \/>\n\tthe the documentary as well as oral evidence submitted by the<br \/>\n\tparties on record.  I have gone through the finding recorded by the<br \/>\n\tTribunal more particularly,  para 10 of the impugned judgment and<br \/>\n\taward dealing with the negligence aspect on the part of the drivers<br \/>\n\tof the ST Bus and Jeep. Considering the evidence at Ex.55 and<br \/>\n\tconsidering the fact that the Bus was driven on a single track road<br \/>\n\tand it being a heavy vehicle, it was the duty of the driver of the<br \/>\n\tST Bus to take more care and that the theory of the ST Bus driver<br \/>\n\tthat the bus was stationary,   has been disbelieved by the Tribunal<br \/>\n\tand accordingly,  the Tribunal on appreciation of evidence has come<br \/>\n\tto the conclusion and recorded finding that the driver of the ST Bus<br \/>\n\twas solely negligent in driving the Bus, as a result of which, the<br \/>\n\tvehicular accident in question has taken place. On going through the<br \/>\n\tentire evidence on record, the aforesaid finding is not required to<br \/>\n\tbe interfered with by this Court. The learned Tribunal was justified<br \/>\n\tin holding the driver of the ST Bus as sole negligent for the<br \/>\n\taccident in question. Even otherwise also, it is required to be<br \/>\n\tnoted that  this appeal is of 1992 and in fact the accident has<br \/>\n\ttaken place in the year 1984. Except the aforesaid, no other<br \/>\n\tsubmissions have been made on behalf of the appellant.\n<\/p>\n<p>Over<br \/>\n\tand above on the ground of smallness of the amount also, the present<br \/>\n\tappeal is required to be dismissed.\n<\/p>\n<p>For<br \/>\n\tthe reasons stated hereinabove,   the petition fails and the same<br \/>\n\tdeserves to be dismissed and is accordingly dismissed.
