First offence mentioned is  Ist<br \/>\nCR No. 79 of 2005 for the offence punishable under Sections 143, 144,<br \/>\n145, 147, 148, 149, 151, 186, 332, 336, 353, 506[2] of Indian Penal<br \/>\nCode and under Section 135[i] of the Bombay Police Act, 1951. Second<br \/>\noffence registered against the petitioner as mentioned in the notice<br \/>\nis Prohibition CR No. 5083\/07 for the offence punishable under<br \/>\nSections 66[b], 65[a][e] and 81 of the Bombay Prohibition Act, 1949,<br \/>\nwhile third offence registered against the petitioner is  Prohibition<br \/>\nCR No. 5055\/08 for the offence punishable under sections 66[b],<br \/>\n65[a][e] and 81 of the Bombay Prohibition Act. Learned advocate<br \/>\nsubmitted that  the competent authority has considered stale cases of<br \/>\n2005 and 2007 while the petitioner is  already acquitted in the<br \/>\nprohibition case being Prohibition CR No. 5055\/08. Thus, there is<br \/>\ncomplete non-application of mind by the competent authority in<br \/>\npassing the externment order. Considering the aforesaid aspect of the<br \/>\nmatter, the petition deserves to be  allowed and the  notice dated<br \/>\n13.8.2008 issued by respondent no.3, order dated 4.4.2009 passed by<br \/>\nDeputy Police Commissioner, Zone-6, Ahmedabad City and the  order<br \/>\ndated 28.1.2010 passed by the respondent no.1 in Externment Appeal<br \/>\nNo. 120 of 2009 be quashed and set aside.\n<\/p>\n<p>3.\t\tMs.\n<\/p>\n<p>T.K. Patel, learned APP, representing the respondents, while opposing<br \/>\nthe writ petition and averments made therein, submitted that there is<br \/>\nno infirmity in the order passed by the competent authority and the<br \/>\ncompetent authority has taken into consideration the entire material<br \/>\non the record of the case before passing the order of externment as<br \/>\nprovided under the Bombay Police Act and the rules framed thereunder.<br \/>\nThus, learned APP submitted that the  petitioner has not made out a<br \/>\ncase for grant of relief as prayed for in the petition and the<br \/>\npetition is devoid of merit and deserves to be dismissed.\n<\/p>\n<p>4.\tI<br \/>\nhave heard the learned advocates of both the sides at length and in<br \/>\ngreat detail. I have considered the averments made in the petition<br \/>\nand perused the show cause notice dated 13.8.08 at Annexure:A to the<br \/>\npetition, wherein, three offences are mentioned, being Ist CR No.<br \/>\n79\/05 for the offence punishable under Sections 143, 144, 145, 147,<br \/>\n148, 149, 151, 186, 332, 336, 353, 506[2] of Indian Penal Code and<br \/>\nunder Section 135[i] of the Bombay Police Act, second offence being<br \/>\nProhibition CR No. 5083\/07 for the offence punishable under Sections<br \/>\n66[b], 65[a][e] and 81 of the Bombay Prohibition Act and third<br \/>\noffence being Prohibition CR No. 5055\/08 for the offence punishable<br \/>\nunder sections 66[b], 65[a][e] and 81 of the Bombay Prohibition Act.<br \/>\nI have perused the order dated 4.4.09 passed by the  Deputy<br \/>\nCommissioner of Police, Zone-6, Ahmedabad City and the order dated<br \/>\n28.1.2010 passed by the Additional Secretary, Home Department,  by<br \/>\nwhich the Additional Secretary, Home Department has confirmed the<br \/>\norder dated 4.4.09 passed by the Dy. Police Commissioner, Zone-6,<br \/>\nAhmadabad City. The offences which are mentioned in the the order<br \/>\npassed by the competent authority are for the years 2005, 2007 and<br \/>\n2008. It has been contended by the learned advocate for the<br \/>\npetitioner that in prohibition case which was registered in the year<br \/>\n2008, the petitioner is acquitted and  since reference is made of<br \/>\ncases of 2005 and 2007, they can be said to be stale cases and there<br \/>\nwas complete non-application of mind by the competent authority in<br \/>\npassing the order of externment. There is lot of  force in the<br \/>\nsubmission canvassed by the learned advocate on behalf of the<br \/>\npetitioner and the State  has not controverted the aforesaid<br \/>\naverments made in the petition by filing appropriate affidavit in<br \/>\nreply.  Thus, even the averments made in the petition have remained<br \/>\nuncontroverted. In view of the aforesaid facts and circumstances of<br \/>\nthe case, the notice dated 13.8.2008 issued by respondent no.3, order<br \/>\ndated 4.4.2009 passed by the Deputy Police Commissioner, Zone-6,<br \/>\nAhmedabad City as confirmed by the  order dated dated 28.1.2010<br \/>\npassed by the respondent no.1 in Externment Appeal No. 120 of 2009,<br \/>\nin my view, deserve to be quashed and set aside.\n<\/p>\n<p>5.\tFor<br \/>\nthe foregoing reasons, the petition is allowed. Notice dated<br \/>\n13.8.2008 issued by respondent no.3, order dated 4.4.2009 passed by<br \/>\nthe Deputy Police Commissioner, Zone-6, Ahmedabad City and the  order<br \/>\ndated 28.1.2010 passed by the respondent no.1 in Externment Appeal<br \/>\nNo. 120 of 2009 are hereby quashed and set aside.
