A letter from the convict&#8217;s mother<br \/>\nenclosed to the application states that doctor has advised her to<br \/>\nhave blood transfusion done at the interval of four months. Six<br \/>\nmonths have already elapsed.  The doctor has, therefore, given<br \/>\nultimatum that within a month of blood transfusion is not done it<br \/>\nwill lead to some unforeseen event.\n<\/p>\n<p>2.\t RULE.\n<\/p>\n<p> Mr.K.P. Raval,  learned Additional Public Prosecutor waives service<br \/>\nof rule on  behalf of the respondent-State.\n<\/p>\n<p>3.\tThe applicant- appellant-\n<\/p>\n<p>original accused has been convicted for the  offences punishable<br \/>\nunder section 302 of the IPC to suffer imprisonment for life with<br \/>\nfine of Rs.20,000\/-, in default to further undergo imprisonment for 1<br \/>\nyear by the learned Judge, City Sessions Court, Ahmedabad in Sessions<br \/>\nCase No.53 of 2008.\n<\/p>\n<p>4.\tThe learned APP has made<br \/>\navailable the Jail record.   The convict has undergone 3 years, 6<br \/>\nmonths and 14 days in Jail. The convict had availed temporary bail<br \/>\ntwice and furlough once.  Nothing objectionable is found from the<br \/>\nJail remarks.\n<\/p>\n<p>5.\tTaking into consideration<br \/>\nthe contents of the application and the record of the convict, the<br \/>\nconvict is ordered to be released on temporary bail for 30 (thirty)<br \/>\ndays from the date of his release  on his executing a personal bond<br \/>\nof Rs.5000\/- (Rupees five thousand only)  to the satisfaction of the<br \/>\nJail authorities.\n<\/p>\n<p>6.\tThe applicant shall<br \/>\nsurrender himself to the Jail authorities on expiry of the above<br \/>\ntemporary bail period. The application is allowed.  Rule is made<br \/>\nabsolute.\n<\/p>\n<p>(RAVI<br \/>\nR.
