P. BHATT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/05\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE P. P. BHATT)<\/p>\n<p>1.0\tPresent<br \/>\napplication is filed by the applicant &#8211; convict through jail<br \/>\nseeking 60 days&#8217; Temporary Bail for the purpose of carrying out<br \/>\nagricultural operations.  In support of the application, Village Form<br \/>\nNo. 7\/12 is produced.  The applicant &#8211; convict has stated in<br \/>\nthe application that his father and mother are not alive; his wife,<br \/>\ntwo sons and two daughters are there in the family.  It is stated in<br \/>\nthe application that the elder son is aged 35 years, who is blind by<br \/>\nbirth.  The younger son is aged 25 years, who is dumb by birth.  One<br \/>\ndaughter is married and residing with her in laws, whereas, another<br \/>\ndaughter, who is aged 20 years, is also dumb by birth.\n<\/p>\n<p>2.0\tRule.\n<\/p>\n<p> Learned Additional Public Prosecutor Mr. Pandya waives service of<br \/>\nprocess of Rule.\n<\/p>\n<p>3.0\tLearned<br \/>\nAdditional Public Prosecutor made available for perusal the Jail<br \/>\nRemarks.  The applicant &#8211; convict has undergone imprisonment of<br \/>\n04 years, 07 months and 19 days as on 9th May 2011.  He<br \/>\nhas enjoyed two Furloughs, one in the year 2008 and another in the<br \/>\nyear 2010.  Every time, he reported in jail in time.  Nothing adverse<br \/>\nis noticed against the convict in the Jail Remarks <\/p>\n<p>4.0\tLooking<br \/>\nto the facts and circumstances of the case, this is a fit case,<br \/>\nwherein presence of the applicant &#8211; convict is required for<br \/>\nsome time with the family so as to support the family.  Taking into<br \/>\nconsideration the contents of the application, the application is<br \/>\nallowed.  The applicant &#8211; convict is ordered to be released on<br \/>\nTemporary Bail for a period of 60 days from the date of<br \/>\nhis release, on his executing a personal bond of Rs.5,000\/-<br \/>\n(Rupees Five Thousand only) to the satisfaction of the jail<br \/>\nauthorities.\n<\/p>\n<p>4.1\tThe<br \/>\napplicant &#8211; convict shall surrender to the jail authorities on<br \/>\nexpiry of the Temporary Bail period.\n<\/p>\n<p>4.2\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p>[<br \/>\nRavi R.
