DAVE\n\t\t\n\t\n\n \n\nDate\n: 18\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nC.R.No.I-3\/2011 with A.C.B. police station, Surat City, for the<br \/>\noffences punishable under Sections 7, 12, 13(1)(D) and 13(2) of the<br \/>\nPrevention of Corruption Act, 1988.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the parties and perused the record.\n<\/p>\n<p>\tLearned<br \/>\ncounsel for the applicant submits that the allegation against the<br \/>\napplicant is of demanding bribe but the amount was received by the<br \/>\ndriver and at this stage the three ingredients, namely, demand,<br \/>\nacceptance and recovery, are not surfacing on record and, subject to<br \/>\npunishment prescribed for the offence and scrutiny and examination of<br \/>\nevidence by the trial court in detail, by imposing suitable<br \/>\nconditions, the applicant may be enlarged on bail.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case and considering the nature of<br \/>\nallegations and  role attributed to the applicant,  without<br \/>\ndiscussing the evidence in detail, prima facie, this Court is of the<br \/>\nopinion that this is a fit case to exercise the discretion to enlarge<br \/>\nthe applicant on bail.\n<\/p>\n<p>\tHence,<br \/>\nthe application is allowed and the applicant is ordered to be<br \/>\nreleased on bail in connection with first information report<br \/>\nregistered at C.R.No.I-3\/2011 with A.C.B. police station, Surat City,<br \/>\non his executing a bond of Rs.5,000\/- (Rupees five thousand only)<br \/>\nwith one surety of the like amount to the satisfaction of the trial<br \/>\ncourt and subject to the conditions that he shall<\/p>\n<p> i.\tnot<br \/>\ntake undue advantage of his liberty or misuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injuries to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\this presence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10 a.m. And 3 p.m till commencement of the<br \/>\n\ttrial.\n<\/p>\n<p>furnish<br \/>\n\tthe present  address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>\tThe<br \/>\nAuthorities will release the applicant only if he is not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter. Bail bond to be executed before the lower court<br \/>\nhaving jurisdiction to try the case.\tAt the trial, the trial court<br \/>\nshall not be influenced by the observations of preliminary nature,<br \/>\nqua the evidence at this stage, made by this Court while enlarging<br \/>\nthe applicant on bail.\tRule is made absolute to the aforesaid extent.<br \/>\nD.S.
