Public Prosecutor and Mr. Pratik<br \/>\nJasani, learned advocate waive service of rule on behalf of<br \/>\nrespondent Nos.1 &#8211; State and 2 respectively.\n<\/p>\n<p>2.\t\tThe<br \/>\npresent application under Sec.482 of the Code of Criminal Procedure<br \/>\nhas been filed for quashing of complaint \/ FIR registered as<br \/>\nC.R.No.I-12 of 2011 before &#8220;B&#8217; Division Police Station,<br \/>\nBhavnagar for the offences punishable under Sections 326, 323, 504,<br \/>\n34 of Indian Penal Code and under section 3(1)(x) of the Atrocities<br \/>\nAct.\n<\/p>\n<p>3.\t\tIt<br \/>\nis submitted by Mr.P.P.Majmudar, learned Advocate for applicants that<br \/>\nthe dispute is settled between the parties and a compromise has been<br \/>\narrived at between the parties.  Affidavit of original complainant to<br \/>\nthis effect is also placed on record.   Therefore, it is submitted<br \/>\nthat in view of settlement between the parties, complaint be quashed<br \/>\nand petition be allowed. Mr.Mamjudar, has relied upon following<br \/>\ndecisions in support of his submissions: &#8211;\n<\/p>\n<p>(1)\tNikhil<br \/>\nMerchant v\/s. CBI and Anr. [2009 (1) GLH 31]<\/p>\n<p>(2)\tJagdish<br \/>\nChananan &amp; Ors. v\/s. State of Haryana &amp; Anr. \t[2008 (2) GLH<br \/>\n53]<\/p>\n<p>(3)\tManoj<br \/>\nSharma v\/s. State [JT 2008 (11) SC 674]<\/p>\n<p>4.\t\tIt<br \/>\nis submitted by Mr.Jasani, learned Advocate appearing for respondent<br \/>\nno.2 &#8211; original complainant that matter is settled and that the<br \/>\ncomplainant has no grievance against the present applicants.  It is<br \/>\nalso submitted by Mr.Jasani, that original complainant or any witness<br \/>\nwill not claim compensation from the Government as offence is<br \/>\nregistered under the provisions of Atrocities Act.\n<\/p>\n<p>5.\t\tThe<br \/>\nApex Court in the case of Madan Mohan Abbot Vs. State of Punjab<br \/>\nreported in (2008)4  Supreme Court Cases page 582 has<br \/>\nobserved as under in paras 5 and<br \/>\n7 of the judgment:\n<\/p>\n<p>&#8220;5.\tIt<br \/>\nis on the basis of this compromise that the application was filed in<br \/>\nthe High Court for quashing of proceedings which  has been dismissed<br \/>\nby the impugned order.  We notice from a  reading of the FIR and the<br \/>\nother documents on record that the  dispute was purely a personal one<br \/>\nbetween two contesting  parties and that it arose out of extensive<br \/>\nbusiness dealings  between them and that there was absolutely no<br \/>\npublic policy  involved in the nature of the allegations made against<br \/>\nthe accused.   We are, therefore, of the opinion that no useful<br \/>\npurpose would be served in continuing with the proceedings in the<br \/>\nlight of the compromise and also in the light of the fact that the<br \/>\ncomplainant has, on 11th January 2004,  passed away and the<br \/>\npossibility of a conviction being recorded has thus to be ruled out.&#8221;\n<\/p>\n<p>&#8220;7.\n<\/p>\n<p>We see from the impugned order that the learned Judge has confused a<br \/>\ncompounding of an offence with the quashing of  proceedings.  The<br \/>\nouter limit of Rs.250\/- which has led to the dismissal of the<br \/>\napplication is an irrelevant factor in the later case.  We<br \/>\naccordingly allow the appeal and in the peculiar facts of the case,<br \/>\ndirect that  FIR No.155 dated 17th November 2001 P.S. Kotwali,<br \/>\nAmritsar and all proceedings connected therewith shall be deemed to<br \/>\nbe quashed.&#8221;\n<\/p>\n<p>6.\t\tConsidering<br \/>\naforesaid decisions of the Hon&#8217;ble Supreme Court and settlement<br \/>\narrived between the parties, in opinion of this Court, no useful<br \/>\npurpose would be served in continuing with the criminal proceedings<br \/>\nand it will be harassment to the parties.  Hence, a case is made out<br \/>\nto exercise powers under section 482 of Criminal Procedure Code.\n<\/p>\n<p>7.\t\tIn<br \/>\nthe result, present application is allowed.  The complaint  \/ FIR<br \/>\nbeing C.R.No.I-12 of 2011 registered with &#8220;B&#8217; Division Police<br \/>\nStation, Bhavnagar and the proceedings therein are required to be<br \/>\nquashed and are accordingly quashed. Rule is made absolute to the<br \/>\naforesaid extent. Direct service is permitted.
