MUKHOPADHAYA)<\/p>\n<p>\tThis<br \/>\nappeal has been preferred by the Food Corporation of India against<br \/>\nthe order of the learned Single Judge dated 27.3.2009 whereby the<br \/>\nwrit petition preferred by the 1st respondent was allowed<br \/>\nin terms with the directions given in other similar case in Letters<br \/>\nPatent Appeal No. 687 of 1997 decided on 11.6.2001.\n<\/p>\n<p>2.\tIt<br \/>\nappears that the respondent &#8211; writ petitioner wanted certain<br \/>\nbenefits pursuant to the circular dated 11.2.1979 which having<br \/>\ndenied, he preferred the writ petition.  The learned Single Judge<br \/>\nhaving noticed that such circular fell for consideration before a<br \/>\nDivision Bench of this Court in LPA No. 687 of 1997 and the Division<br \/>\nBench by order dated 11.6.2001 having directed the Food Corporation<br \/>\nof India to make payment of the outstanding claim of the petitioner<br \/>\nof the said case in accordance with the provisions of the said<br \/>\ncircular, disposed of the writ petition of the respondent &#8211;<br \/>\nwrit petitioner with similar directions.\n<\/p>\n<p>3.\tThe<br \/>\nlearned counsel for the appellant would contend that the case of the<br \/>\nrespondent &#8211; writ petitioner was considered and rejected, but<br \/>\nit is not in dispute that the circular dated 11.2.1979 is in vogue<br \/>\nand with regard to a similarly situated person, direction was given<br \/>\nby the Division Bench of this Court to make payment of outstanding<br \/>\ndues in terms of the said circular dated 11.2.1979.  In that view of<br \/>\nthe matter, if the learned Single Judge has given similar direction<br \/>\nthat the Food Corporation of India is required to reconsider the<br \/>\nclaim of the respondent &#8211; writ petitioner as per the circular<br \/>\ndated 11.2.1979 and on such consideration, if any amount is found<br \/>\npayable and outstanding, they will pay the same in accordance with<br \/>\nthe provisions of the circular dated 11.2.1979 within three months<br \/>\nfrom the date of receipt of the copy of the order, but they cannot<br \/>\nreject the same on the ground of limitation, no case is made out for<br \/>\ninterfering with the said order of the learned Single Judge.<br \/>\nHowever, no interest having allowed in the other case, no such order<br \/>\nfor interest is passed in the present case.\n<\/p>\n<p>\tThe<br \/>\nappeal stands disposed of.
