Justice HARUN-UL-RASHID\n\n Dated :25\/06\/2010\n\n O R D E R\n                       HARUN-UL-RASHID, J.\n                       ------------------------\n                        A.S.No.610 Of 2000\n                        ----------------------\n              Dated this the 25th day of June, 2010.\n\n                          J U D G M E N T\n<\/pre>\n<p>      The plaintiff in O.S.No.1211 of 1995 on the file of the Sub<\/p>\n<p>Court, Thrissur is the appellant. Suit was filed for partition of the<\/p>\n<p>plaint schedule property and for allotment of one half share with<\/p>\n<p>mesne profits. Pending appeal, the original plaintiff died and her<\/p>\n<p>legal representative was impleaded as additional appellant.<\/p>\n<p>Parties are hereinafter referred to as the plaintiff and defendant<\/p>\n<p>as arrayed in the suit.\n<\/p>\n<p>      2.   Plaint schedule property is 32 cents of land in survey<\/p>\n<p>No.417\/4 of Thrissur village.        Plaintiff is the sister of the<\/p>\n<p>defendant.    According to the plaintiff, the property originally<\/p>\n<p>belonged to Sankaran, brother of her father, Ayyappan.<\/p>\n<p>Sankaran died as a bachelor and on his death the property<\/p>\n<p>devolved on plaintiff&#8217;s father Ayyappan.       On the death of her<\/p>\n<p>father, the property devolved upon the plaintiff and defendant<\/p>\n<p>equally. Therefore the suit for partition was filed. The suit was<\/p>\n<p>resisted by the defendant, brother, contending that they belong<\/p>\n<p>to Karuvan community and that Karuvans follow Hindu<\/p>\n<p>A.S.No.610 Of 2000<\/p>\n<p>                               ::2::\n<\/p>\n<p>Mitakshara Law and not Hindu Mitakshara law as modified by<\/p>\n<p>custom. Defendant also contended that since the plaintiff was<\/p>\n<p>given in marriage in kudivaippu form on payment of dowry which<\/p>\n<p>represents her share in the property, she is not entitled to any<\/p>\n<p>share in the property.\n<\/p>\n<p>      3.   Admittedly, parties belongs to Karuvan community.<\/p>\n<p>The Hindu Mitakshara law is applicable to Malayala Kammalas<\/p>\n<p>community. Malayala Kammalas follow modified form of Hindu<\/p>\n<p>Mitakshara Law and not Hindu Mitakshara Law as modified by<\/p>\n<p>custom. This fact is not disputed by either side. The law relating<\/p>\n<p>to intestate succession of Malayala Kammalas was decided in the<\/p>\n<p>decision reported in Damodaran v. Palu (1986 KLT 1259). This<\/p>\n<p>Court held that the Malayala Kammalas follow modified form of<\/p>\n<p>Hindu Mitakshara Law and not Hindu Mitakshara Law as modified<\/p>\n<p>by custom. It was held that when the modified form of Hindu<\/p>\n<p>Mitakshara Law followed by them is not disputed and when it is<\/p>\n<p>recognised by judicial pronouncements it is only a question of<\/p>\n<p>considering whether under the modified law the plaintiff is<\/p>\n<p>entitled to the property.\n<\/p>\n<p>A.S.No.610 Of 2000<\/p>\n<p>                                   ::3::\n<\/p>\n<p>     4.    This Court further held as follows:\n<\/p>\n<p>              &#8220;Among the Malayala kammalas, there are mainly<\/p>\n<p>        two   forms    of  marriage,     Sambandam     form    and<\/p>\n<p>        Kudivaippu form. Daughters will lose their right in the<\/p>\n<p>        family of birth only if they are given away in marriage in<\/p>\n<p>        the Kudivaippu form on payment of streedhanam.<\/p>\n<p>        Otherwise they will not become members of the family<\/p>\n<p>        of the husband and they will continue to have the right<\/p>\n<p>        in the family of birth. It is only by the Kudivaippu form<\/p>\n<p>        that they are inducted as members of the family of the<\/p>\n<p>        husbands. That is after receiving what is due from the<\/p>\n<p>        family of birth. When a marriage is conducted, there is<\/p>\n<p>        no presumption of law that it is in any particular form or<\/p>\n<p>        whether streedhanam was paid or not. These are all<\/p>\n<p>        matters for proof. The crucial question is whether the<\/p>\n<p>        female members were given streedhanam on marriage<\/p>\n<p>        and thereby they lost right in the family of birth. If that<\/p>\n<p>        is proved, there may arise the presumption that the<\/p>\n<p>        marriage was in the Kudivaippu form and they became<\/p>\n<p>        members of the family of the husbands.           That the<\/p>\n<p>        marriage was on payment of streedhanam has to be<\/p>\n<p>        proved by the person who so contends.&#8221;\n<\/p>\n<p>The trial court examined the question on the basis of the legal<\/p>\n<p>provisions stated in the aforesaid decision.        When the plaintiff<\/p>\n<p>was examined as PW1, she admitted that the marriage was<\/p>\n<p>A.S.No.610 Of 2000<\/p>\n<p>                                ::4::\n<\/p>\n<p>conducted in the kudivaippu form.        The defendant and his<\/p>\n<p>witnesses also testified before the court that the marriage of the<\/p>\n<p>plaintiff was conducted in kudivaippu form. The defendant also<\/p>\n<p>gave evidence stating that at the time of marriage the plaintiff<\/p>\n<p>was given streedhanam. PW1 also admitted that at the time of<\/p>\n<p>marriage she was given gold ornaments.         When the plaintiff<\/p>\n<p>herself admitted that marriage was conducted in kudivaippu form<\/p>\n<p>naturally, she became a member of her husband&#8217;s family and<\/p>\n<p>thus she ceases to be a member of her family and the<\/p>\n<p>presumption is that she was given streedhanam at the time of<\/p>\n<p>marriage.    A decision can be taken in this case without much<\/p>\n<p>effort since plaintiff herself admitted that the marriage was<\/p>\n<p>conducted in kudivaippu form and also that she was given gold<\/p>\n<p>ornaments at the time of marriage.        The defendant and his<\/p>\n<p>witnesses also tendered evidence which would go to show that<\/p>\n<p>she was given streedhanam at the time of marriage. The trial<\/p>\n<p>court also held that her admission itself shows that she lost her<\/p>\n<p>right in the family by birth.\n<\/p>\n<p>A.S.No.610 Of 2000<\/p>\n<p>                                  ::5::\n<\/p>\n<p>     5.    In view of the legal position and the facts adverted to<\/p>\n<p>by the court below in detail and discussed by me in nutshell I find<\/p>\n<p>that the plaintiff is not entitled to any relief claimed in the suit.
