JUSTICE BHAGWATI PRASAD)<\/p>\n<p>Present<br \/>\n\tappeal is filed by the State  against the judgment of acquittal<br \/>\n\tpassed by learned Sessions Judge, Amreli in Sessions Case No. 1 of<br \/>\n\t1986 dated 31\/3\/1987.\n<\/p>\n<p>\tHeard Learned<br \/>\n\tcounsels for the appellant State and the Respondents.\n<\/p>\n<p>Learned<br \/>\n\tTrial Court after considering the case of the prosecution  came to<br \/>\n\tthe conclusion that this was a case where both the parties entangled<br \/>\n\tto a free fight, therefore section 149 was excluded. Regarding<br \/>\n\tidentity, learned trial Judge observed that it was not possible to<br \/>\n\tidentify any particular accused for any particular injury caused<br \/>\n\tbecause injured eye witnesses would not have been able to say who<br \/>\n\twas the author  of the particular injury. In this background learned<br \/>\n\ttrial Judge acquitted all the present respondents \/ original<br \/>\n\taccused.\n<\/p>\n<p>Regarding<br \/>\n\ttwo other accused i.e. Koli Kesha Manji and Koli Manji Lakhman ?<br \/>\n\toriginal accused No. 6 &amp; 8 respectively of Sessions Case No. 1<br \/>\n\tof 1986 who were convicted by the Sessions Judge under Section 302<br \/>\n\tI.P. Code, had preferred Criminal Appeal No. 366 of 1987 before this<br \/>\n\tCourt. Aforesaid two accused persons had died during pendency of<br \/>\n\ttheir appeal being Criminal Appeal No. 366 of 1987 and therefore<br \/>\n\ttheir appeal came to be abated by this Court  vide order dated<br \/>\n\t23\/11\/1994.\n<\/p>\n<p>Since<br \/>\n\tthose who were convicted have died and their appeal came to be<br \/>\n\tabated, and in the findings of the learned Sessions Judge the<br \/>\n\trespondents in the present appeal are held to be not the authors of<br \/>\n\tthe injuries caused to the injured, section 149 was excluded.<br \/>\n\tTherefore there would not be any hitch in expressing agreement with<br \/>\n\tthe findings recorded by the trial Court because it was a case  of<br \/>\n\tfree fight.  In this background present appeal against acquittal<br \/>\n\twould not survive as no particular role is assigned to any of the<br \/>\n\trespondents\/accused. Therefore it is difficult to reverse the<br \/>\n\tfindings of the trial Court and convert the judgment of acquittal<br \/>\n\tinto conviction.\n<\/p>\n<p>Present<br \/>\n\tappeal therefore is not maintainable.  In the result the appeal<br \/>\n\tfails and is dismissed. Bail bonds shall stand cancelled.
