No. 1186 of 2009-E\n              ====================\n           Dated this the 3rd day of June, 2009.\n\n\n                        O R D E R\n<\/pre>\n<p>     Petitioners are accused 1, 10, 25, 26, 29, 31 and 33 in<\/p>\n<p>C.C.No.918\/2007 on the file of the Judicial First Class<\/p>\n<p>Magistrate Court-I, Thodupuzha. First respondent is the<\/p>\n<p>complainant. He filed Annexure A1 complaint against 56<\/p>\n<p>accused alleging that they committed offences under<\/p>\n<p>Sections 499 and 500 of Indian Penal Code. After recording<\/p>\n<p>the sworn statements of the complainant and witnesses,<\/p>\n<p>Judicial First Class Magistrate took cognizance of the<\/p>\n<p>offence and issued summons. This petition is filed under<\/p>\n<p>Section 482 of Code of Criminal Procedure to quash<\/p>\n<p>Annexure A1 complaint contending that it is only an abuse<\/p>\n<p>of process of the Court.\n<\/p>\n<p>     2.   Learned Counsel appearing for the petitioners<\/p>\n<p>and first respondent were heard.\n<\/p>\n<p>Crl.M.C.No.1186\/2009-E<br \/>\n<span class=\"hidden_text\">                             -2-<\/span><\/p>\n<p>      3.    Annexure A1 complaint and the cognizance taken<\/p>\n<p>can be quashed under Section 482 of Code of Criminal<\/p>\n<p>Procedure only if the averments in the complaint and sworn<\/p>\n<p>statements read together do not constitute the offence<\/p>\n<p>alleged against the petitioners.     Arguments of learned<\/p>\n<p>Counsel is that the sworn statements of first respondent and<\/p>\n<p>his witnesses do not disclose any publication, which is the<\/p>\n<p>most essential ingredient of an offence of defamation and<\/p>\n<p>therefore no offence is made out and for that reason<\/p>\n<p>Annexure A1 and the case are to be quashed.         Learned<\/p>\n<p>Counsel appearing for first respondent pointed out that<\/p>\n<p>necessary allegations to constitute the offence are there in<\/p>\n<p>Annexure A1 with regard to the publication and the<\/p>\n<p>complaint and sworn statements can only be read together<\/p>\n<p>and so the petition is to be dismissed. On going through<\/p>\n<p>Annexure A1 complaint, it cannot be said that ingredients of<\/p>\n<p>an offence under Section 500 is not disclosed.      If those<\/p>\n<p>allegations are to be taken accepted in their entirety, it<\/p>\n<p>Crl.M.C.No.1186\/2009-E<br \/>\n<span class=\"hidden_text\">                              -3-<\/span><\/p>\n<p>cannot be said that offence is not made out. The question<\/p>\n<p>whether the allegations could be accepted or not cannot be<\/p>\n<p>decided at this stage. It can only be decided at the time of<\/p>\n<p>trial on the evidence to be recorded. Hence on the grounds<\/p>\n<p>alleged, it cannot be quashed at the threshold.
