OF BIHAR, PATNA\n                                      -----------\n<\/pre>\n<p>2.   30.9.2010            Heard learned counsel for the petitioners<\/p>\n<p>                 and the State.\n<\/p>\n<p>                          An      advertisement   was   issued   inviting<\/p>\n<p>                 applications for appointment to posts under the<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>District        Rural    Development              Agencies      in   the<\/p>\n<p>department of Rural Development, Government of<\/p>\n<p>Bihar.      The posts were (i) Programme Officer (ii)<\/p>\n<p>Assistant Project Officer (iii) Assistant Project Officer<\/p>\n<p>(Marketing) and (iv) Project Economist.                         Together<\/p>\n<p>they form Group-I.             The qualifications for the four<\/p>\n<p>posts      were         mentioned        individually           in   the<\/p>\n<p>advertisement.          The petitioners were applicants for<\/p>\n<p>the post of Project Economist holding post graduate<\/p>\n<p>qualification in Economics.\n<\/p>\n<p>            Learned           counsel       for     the       petitioners<\/p>\n<p>contended that they were candidates for all the four<\/p>\n<p>posts optionally.            If they were not found fit for the<\/p>\n<p>post of Project Economist, they should have been<\/p>\n<p>considered for other three posts suitably.                        Strong<\/p>\n<p>reliance was placed on the admit card top column<\/p>\n<p>which mentions the words &#8220;preference wise post<\/p>\n<p>code&#8221;. All the four posts had separate codes. The<\/p>\n<p>second submission was that appointments had been<\/p>\n<p>made       on    the    post     of   Programme           Officer    and<\/p>\n<p>Assistant        Project       Officer      of     persons       holding<\/p>\n<p>qualification in Labour and Social Welfare on the<\/p>\n<p>premise that it was equivalent to the course of<\/p>\n<p>Personal        Management            and        Industrial     Relation<\/p>\n<p>conducted by the L.N.M. Institute of Economic<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>Development and Social Change. If the conditions of<\/p>\n<p>eligibility were deviated there is no reason why the<\/p>\n<p>same benefit of deviation cannot be provided to the<\/p>\n<p>petitioners also on basis of equivalence.<\/p>\n<p>          Counsel for the State submitted that there<\/p>\n<p>is nothing in the advertisement to state that options<\/p>\n<p>were invited with regard to the posts. In any event, a<\/p>\n<p>person who did not possess the basic qualification<\/p>\n<p>for a post cannot submit or claim an option right for<\/p>\n<p>the same.        He lastly submitted that issues of<\/p>\n<p>equivalence of qualification are matters for the<\/p>\n<p>employer to decide.\n<\/p>\n<p>          This    Court   does   not   find   from   the<\/p>\n<p>advertisement that any options were invited for the<\/p>\n<p>posts. If a candidate possesses qualifications for<\/p>\n<p>more than one post, he could certainly have applied<\/p>\n<p>for more than one post. But that is an issue which<\/p>\n<p>does not concern the Court. It is the specific case of<\/p>\n<p>the petitioners that they hold necessary qualification<\/p>\n<p>for the post of Project Economist only being post<\/p>\n<p>graduate in Economics. On their own showing that<\/p>\n<p>they did not hold the basic eligibility for the other<\/p>\n<p>three posts, what may or what may not have been<\/p>\n<p>processed for appointment on the other three posts<\/p>\n<p>does not concern the petitioners and this Court is<br \/>\n<span class=\"hidden_text\">                               4<\/span><\/p>\n<p>           therefore not persuaded to go into those issues at<\/p>\n<p>           the behest of the petitioners in view of the nature of<\/p>\n<p>           their claim.\n<\/p>\n<p>                     In any event of the matter, whether the<\/p>\n<p>           qualification prescribed for the post of Programme<\/p>\n<p>           Officer and Assistant Project Officer was equivalent<\/p>\n<p>           to Labour and Social Welfare and those holding the<\/p>\n<p>           latter qualifications met the job requirement of the<\/p>\n<p>           employer to hold equivalence are issues for employer<\/p>\n<p>           alone to decide.\n<\/p>\n<p>                     There is no occasion for the Court to dwell<\/p>\n<p>           into this issues as it cannot be the case and it is not<\/p>\n<p>           the case of the petitioners that their post graduate<\/p>\n<p>           qualification in Economics is equivalent to post<\/p>\n<p>           graduate in Rural Management or MBA.\n<\/p>\n<p>                     This     Court   finds   no   merit   in   this<\/p>\n<p>           application. It is accordingly dismissed.<\/p>\n<pre>P.
