Kaurav, Dy.AG, for the Respondents No.1 to 3.<\/pre>\n<p>         Petitioner has sought the following relief :<\/p>\n<blockquote><p>                  i. to direct the respondents 1 &amp; 2 to<br \/>\n                     make investigation of the complaint<br \/>\n                     by some independent and high<br \/>\n                     power committee or to some<br \/>\n                     higher officer or though C.I.D.\n<\/p><\/blockquote>\n<blockquote><p>                  ii. To direct the respondents to make<br \/>\n                      fair and impartial investigation on<br \/>\n                      the entire incident and thereafter to<br \/>\n                      register criminal case against the<br \/>\n                      accused persons.\n<\/p><\/blockquote>\n<blockquote><p>                  iii. To direct the respondents to<br \/>\n                       provide police protection to the<br \/>\n                       petitioner and her family members.\n<\/p><\/blockquote>\n<blockquote><p>                  iv. To grant any other relief which may<br \/>\n                      deem fit and proper.\n<\/p><\/blockquote>\n<p>         Grievance of the petitioner is that daughter of petitioner<\/p>\n<p>namely &#8216;k&#8217; was abducted and was raped by several persons under<\/p>\n<p>the protection of one Panchulal Prajapati, State MLA. Though a<\/p>\n<p>report was lodged, but, because of the State MLA who belongs to<\/p>\n<p>ruling party, no action was taken by the police, so this petition was<\/p>\n<p>filed.\n<\/p>\n<p>         Though return has been filed in which respondents have<\/p>\n<p>stated that a criminal case was registered, but, from perusal of the<\/p>\n<p>averments made in the complaint, petition and the affidavit of &#8216;k&#8217; it<\/p>\n<p>appears that matter deserves to be investigated by an<br \/>\n                                WP No.14057\/2007<\/p>\n<p>        independent officer, without being influenced by the status of<\/p>\n<p>        culprits.\n<\/p>\n<p>               In view of the aforesaid, respondent No.2 (Two) is directed<\/p>\n<p>        to issue appropriate direction for investigation in the matter by<\/p>\n<p>        independent officer not below the rank of Dy.SP. Said officer shall<\/p>\n<p>        submit his report to respondent No.3 and in case any cognizable<\/p>\n<p>        offence is found, proper action shall be taken by the respondent<\/p>\n<p>        No.3 in that regard.\n<\/p>\n<p>               Aforesaid exercise shall be completed by the respondents<\/p>\n<p>        No.2 and 3 within a period of 60 days from the date of<\/p>\n<p>        communication of this order.
