PARTY.\n                                             -----------\n<\/pre>\n<p>           For the petitioner : Mr. Mahesh Narayan Parbat, Adv.<br \/>\n            For the State : Mr. Ram Priya Sharan Singh, A.P.P.\n<\/p>\n<p>                                          &#8212;-\n<\/p>\n<p>2\/   15.06.2010               Heard the parties.<\/p>\n<p>                           In a criminal prosecution for offence under<\/p>\n<p>                sections 307, 379\/34 and some other allied offences<\/p>\n<p>                under the Indian Penal Code        in which subsequently<\/p>\n<p>                offence   under   section   411   I.P.C.   was   added,   the<\/p>\n<p>                petitioner and three other persons are named in the<\/p>\n<p>                F.I.R. as accused.\n<\/p>\n<p>                           It is submitted by learned counsel for the<\/p>\n<p>                petitioner that on perusal of F.I.R., Annexure-1, it<\/p>\n<p>                appears that case under section 307 I.P.C. is not made<\/p>\n<p>                out against the petitioner as also against other accused<\/p>\n<p>                persons. It is further submitted that co-accused Rabi @<\/p>\n<p>                Rabi Kumar, with almost similar and identical allegation<\/p>\n<p>                with that of the petitioner has already been granted bail<\/p>\n<p>                by a Bench of this Court by order dated 20.05.2010<\/p>\n<p>                passed in Cr. Misc. No. 17181 of 2010. The petitioner is<\/p>\n<p>                said to have surrendered on 19.02.2010.<\/p>\n<p>                           In the aforesaid facts and circumstances let<\/p>\n<p>                the above named petitioner be enlarged on bail on<br \/>\n<span class=\"hidden_text\">                             -2-<\/span><\/p>\n<p>           furnishing bail bonds of Rs. 10,000\/- with two sureties of<\/p>\n<p>           the like amount each to the satisfaction of Chief Judicial<\/p>\n<p>           Magistrate, Siwan in connection with Siwan Town P.S.<\/p>\n<p>           Case No. 24 of 2010, subject to the conditions :<\/p>\n<p>            (A)            one of the bailors must be government<\/p>\n<p>                           servant or close family members of the<\/p>\n<p>                           petitioner, who will file an affidavit in the<\/p>\n<p>                           court      below      showing       his\/her<\/p>\n<p>                           relationship with the petitioner and<\/p>\n<p>            (B)            if the petitioner is found involved in<\/p>\n<p>                           same and similar nature of cases in<\/p>\n<p>                           future, then in that case the informant\/<\/p>\n<p>                           prosecution shall be at liberty to file a<\/p>\n<p>                           petition for cancellation of the bail of the<\/p>\n<p>                           petitioner, and if such a petition is filed,<\/p>\n<p>                           the court below would be obliged to<\/p>\n<p>                           dispose of the same in accordance with<\/p>\n<p>                           law after giving opportunity of hearing to<\/p>\n<p>                           all concerned .\n<\/p>\n<\/p>\n<p>                                   ( Birendra Prasad Verma, J )<\/p>\n<p>BTiwary\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Vikki Kumar Gupta @ Vikki vs The State Of Bihar on 15 June, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
