PUBLIC PROSECUTOR\nfor\nApplicant(s) : 1, \nNone for Respondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE JAYANT PATEL\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.B.ANTANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/10\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE JAYANT PATEL)<\/p>\n<p>\tThe<br \/>\npresent application for leave  to Appeal is directed against the<br \/>\njudgment and the order dated 30th<br \/>\n December, 2009 passed by the learned Sessions Judge in Sessions Case<br \/>\nNo. 153 of 2007 whereby the accused has been acquitted for the<br \/>\noffence punishable under Sections 363, 366 and 376 of Indian Penal<br \/>\nCode.\n<\/p>\n<p>\tWe have considered<br \/>\nthe  judgment and the reasons recorded by the learned Sessions Judge.<br \/>\nWe have also considered the record and proceedings produced by  the<br \/>\nlearned APP.\n<\/p>\n<p>\tIt appears that as<br \/>\nper the evidence on record, there was a love affair between the<br \/>\nvictim and the accused and that aspect was admitted by the victim<br \/>\nherself in her deposition. Further, in the medical history, she had<br \/>\ndeclared before the doctor that she had voluntarily gone with the<br \/>\naccused. As per the medical evidence, there are no injury marks on<br \/>\nthe body or private parts of the victim. Under these circumstances,<br \/>\nif the learned Sessions Judge has found that the prosecution has not<br \/>\nbeen able to prove the case beyond reasonable doubt, the same cannot<br \/>\nbe said to be erroneous.\n<\/p>\n<p>\tHence, leave does not<br \/>\ndeserve to be granted, therefore, not granted.
