judgmentva\u00a7V*ar’d::passed by the Court below. On perusal of the<\/p>\n
Ills\u00bb-.._sarne v\\}’i1at”iemerge.s dis that the appellant has \ufb01led a petition u\/S<\/p>\n
  ){ia)(ib) Hindu Marriage Act contending that the appellant and<\/p>\n
 iresponcicnt are husband and wife. Their marriage was solemnized on<\/p>\n
 at Marikamba Sirsi Temple as per the customs of Hindu<\/p>\n
\/,,\/\u00ab<\/p>\n
religion. Out of their wedlock a son was born on 01.1 1.1992. He was<\/p>\n
named as Shivashankar. The appellant is a native of Dharwaid<\/p>\n
parents are residing at Dharwad. He was appointed   <\/p>\n
in Sericulture Department. For the last eve years’..on.;acc”o1.1_nt’oi’ his<\/p>\n
service in Sericulture Department he want’etoi”e_stablish;  ‘ho’L1se,at’=,<\/p>\n
Ranibennur. But the respondent   in
\nSirsi. When the appellant went”to_ her the month
\nof March 1992 he made all_   back to lead
\nmatrimonial life.   with him and
\ninsisted him   her on the ground
\nthat her parents  citizens and there is no one to
\nlook after them;  consideration the appellant felt
\nne.eessityV_.teg.i an app}-icati_on u\/S 9 of the Hindu Marriage Act for<\/p>\n
restitution of c,o’njugal’ rights and the same was registered in lVI.C. No.<\/p>\n
 on\ufb02tiiie  Judge (Senior Division), Dharwad. After<\/p>\n
 of notice the respondent as a counter blast appeared through<\/p>\n
i._i_tl1e_ Cot1nse.l”‘g_\u00aband \ufb01led objections. There was conciliation took place<\/p>\n
. ‘ibetweeni the parties, they have filed ajoint memo and the petition was<\/p>\n

withdrawn. Thereafter the appellant was transferred to Chennagiri.

child but due to intervention of the parents. of   could if

P.C. seeking    respondent is not ready and
\nwilling to lead   appellant. Therefore he was
\nconstrained to llfi’-lei’ petitionlllonl around of cruelty and non cos

petitioner, petitioner has failed to establish that respondent 13-as_>failed<\/p>\n
to reside at Ranebennur whereas respondent has proved is<\/p>\n
living with the appellant at Ranebennur. Being <\/p>\n
impugned order passed by the T\ufb01alizii\u00e9ourtiv -i’_appellan_t<\/p>\n
respondent respectively felt necessity to \ufb01leiitheiinstant’appeals.  i<\/p>\n
4. We have gone through the groundsi._:”rged._ in theiappeal filed by
\nappellant. After perusal of  order passed<\/p>\n
by the learned Additional’y’_’Civi_l Judge (‘Senior.Di.Krision), Ranebennur,<\/p>\n
we do not find any liessfany material irregularity as
\nsuch committed.i ” ‘  _-tal(en into consideration and
\nspeci\ufb01cally at”one_st’ag_e’ “appellant and respondent have<\/p>\n
compromised. the matter.’  But unfortunately due to the transfer of<\/p>\n
appeliliant Cli’icl1llag_iVrl the respondent ‘stayed with him few months.<\/p>\n
 Again”she’.ii.as”‘gone  parental house. Taking all these facts into<\/p>\n
coinsideration  assigning cogent and valid reasons has rejected the<\/p>\n
4. petition.’ ‘=T_he reasons given for rejecting the petition is just and<\/p>\n
