No.10077 of 2010\n                          SHIV NATH DAS\n                                Versus\n                        THE STATE OF BIHAR\n                               -----------\n<\/pre>\n<p>03   14.07.2010          Renewing the prayer for bail on the 4th<\/p>\n<p>                 occasion, the submission is that he is in custody<\/p>\n<p>                 since 20.10.2006. Charges have been framed on<\/p>\n<p>                 7.1.2008 vide Annexure-6. This Court had noticed<\/p>\n<p>                 that out of the 12 witnesses 7 were official witnesses<\/p>\n<p>                 with an observation that, if the official witnesses are<\/p>\n<p>                 not examined within reasonable time the petitioner<\/p>\n<p>                 may renew his prayer for bail last rejected on<\/p>\n<p>                 12.8.2009.\n<\/p>\n<p>                          The report called for at Flag-A states that<\/p>\n<p>                 the trial is running for evidence since 20.2.2008<\/p>\n<p>                 and of the 16 witnesses only 3 have been examined,<\/p>\n<p>                 this despite informing the Superintendent of Police,<\/p>\n<p>                 West Champaran.\n<\/p>\n<p>                          The credit for grant of bail to the petitioner<\/p>\n<p>                 in a police case under the N.D.P.S. Act goes to the<\/p>\n<p>                 laxity of the prosecution. Let the petitioner, above<\/p>\n<p>                 named, be enlarged on bail on furnishing bail bonds<\/p>\n<p>                 of Rs. 20,000\/- (Twenty thousand) with two sureties<\/p>\n<p>                 of the like amount each to the satisfaction of<\/p>\n<p>                 Additional   Sessions     Judge,    F.T.C.-III,   West<\/p>\n<p>                 Champaran, Bettiah in connection with Chanpatiya<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>       P.S. Case No. 235 of 2006, T.R. No. 10 of 2007.<\/p>\n<p>                The bail bonds of the petitioner shall bear<\/p>\n<p>       the photograph and proof of residence of the bailors<\/p>\n<p>       which shall be verified through the local Police<\/p>\n<p>       before final acceptance. Both the sureties of the<\/p>\n<p>       petitioner must be his wife and another blood<\/p>\n<p>       relative, who shall adequately be explained at the<\/p>\n<p>       time of acceptance of the bail bonds that should the<\/p>\n<p>       petitioner abscond they may be made answerable.<\/p>\n<p>                The trial court is directed to proceed<\/p>\n<p>       appropriately under 350 Cr.P.C. against the official<\/p>\n<p>       witnesses,   who      were      not   appearing   despite<\/p>\n<p>       summons and conclude the summary trial against<\/p>\n<p>       such witnesses at the earliest.\n<\/p>\n<p>                Let a copy of this order be sent by Fax to<\/p>\n<p>       the Superintendent of Police, West Champaran for<\/p>\n<p>       appropriate action.\n<\/p>\n<\/p>\n<pre>P.K.
