Dinesh Singh son of Ram Nandan Singh                     ...Petitioners\n                                           Versus\n                  The State Of Bihar                                                  ...OP\n                                          -----------\n<\/pre>\n<p>2\/   14.09.2011                     Heard learned counsel for the petitioners and the State.<\/p>\n<p>                                    The petitioners seek anticipatory bail in a case instituted<\/p>\n<p>                        for the offence under sections 147, 149, 341, 323, 427 of the Indian<\/p>\n<p>                        Penal Code and section 3(x) of the of Scheduled Castes and<\/p>\n<p>                        Scheduled Tribes (Prevention of Atrocities) Act.\n<\/p>\n<p>                                    Considering that the real dispute was with regard to the<\/p>\n<p>                        construction on a government land, it is ordered that in the event of<\/p>\n<p>                        surrender of the petitioners, named above, within four weeks from<\/p>\n<p>                        the date of receipt of a copy of this order in connection with Baroon<\/p>\n<p>                        P.S. Case No.150 of 2011, they shall be released on anticipatory bail<\/p>\n<p>                        on furnishing bail bond of Rs.5,000\/-(five thousand) each with two<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>       sureties of the like amount each to the satisfaction of the Chief<\/p>\n<p>       Judicial Magistrate, Aurangabad, subject to conditions as laid down<\/p>\n<p>       under section 438 (2) Cr. P.C., and (i) That one of the bailors will be<\/p>\n<p>       a close relative of the petitioners, who will give an affidavit giving<\/p>\n<p>       genealogy as to how he is related with the petitioners. The bailors<\/p>\n<p>       will undertake to furnish information to the court about any change<\/p>\n<p>       in the address of the petitioners, (ii) That the affidavit shall clearly<\/p>\n<p>       state that the petitioners are not an accused in any other case and, if<\/p>\n<p>       they are, they shall not be released on bail and further the petitioners<\/p>\n<p>       shall undertake to be represented on the first date after cognizance if<\/p>\n<p>       the investigation in the case is still pending and in case they fail to<\/p>\n<p>       do so, their bail bond will be liable to be cancelled (iii) That the<\/p>\n<p>       bailors shall also state on affidavit that they will inform the court<\/p>\n<p>       concerned if the petitioners are implicated in any other case of<\/p>\n<p>       similar nature after their release in the present case and thereafter the<\/p>\n<p>       court below will be at liberty to initiate the proceeding for<\/p>\n<p>       cancellation of bail on the ground of misuse, (iv) That the petitioners<\/p>\n<p>       will be well represented on each date and if they fail to do so on two<\/p>\n<p>       consecutive dates, their bail will be liable to be cancelled.<\/p>\n<pre>JA\/-                                            (Anjana Prakash,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Anil Tigar &amp; Anr. vs The State Of Bihar on 14 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.
