It<br \/>\nappears that thereafter  respondent No.2 summoned the petitioner for<br \/>\nverification of his case qua Caste Status Certificate vide letters<br \/>\ndated 03.08.2005, 13.09.2005 and 05.10.2005. As the petitioner has<br \/>\nchanged his residence the letters could not be received by him.<br \/>\nThereafter, after receiving information from the person residing<br \/>\nnearby vicinity, the petitioner remained present before respondent<br \/>\nNo.2 but since it was the first occasion for the petitioner, he has<br \/>\nprayed for time upto 25.11.2005. The petitioner received<br \/>\na letter dated 12.01.2006 from the respondent No. 1 intimating the<br \/>\npetitioner that his admission to the PTC has been cancelled<br \/>\nconsidering his Caste Certificate having been cancelled by respondent<br \/>\nNo.2. The petitioner has not received any communication\/order\/letter<br \/>\nfrom either of the respondents. The petitioner thereafter preferred<br \/>\nSpecial Civil Application No. 1320 of 2006 before this Court which<br \/>\nwas withdrawn by the petitioner in view of decision of respondent<br \/>\nNo.2. The petitioner thereafter received  decision from respondent<br \/>\nNo. 2  on 18.01.2006 cancelling the Caste Status Certificate of the<br \/>\npetitioner. Hence,  petitioner has approached this Court by<br \/>\npreferring the present petition.\n<\/p>\n<p>3.0\tThe<br \/>\npetition is admitted vide order dated 20.03.2006 however, interim<br \/>\nrelief was declined saying that it would amount to allowing the main<br \/>\nrelief in the petition. The Court has also directed the respondents<br \/>\nto consider the application preferred by the petitioner opting for<br \/>\n&#8216;General Category&#8217; provided sears are vacant preferably prior to<br \/>\ncommencement of examination. The petitioner thereafter preferred<br \/>\nCivil Application No. 4643 of 2006 for seeking compliance of the<br \/>\norder of this Court dated 20.03.2006 passed in the petition. The<br \/>\nCivil Application is heard today with the petition.\n<\/p>\n<p>4.0\tHeard<br \/>\nMr. Qureshi, learned counsel appearing for the petitioner and Mr.<br \/>\nJaswant K. Shah, learned Assistant Government Pleader for the<br \/>\nrespondent State. Respondent No. 3 is served but no-one has appeared<br \/>\non behalf of the respondent No.3.\n<\/p>\n<p>5.0\tLearned<br \/>\nadvocate for the petitioner submitted that petitioner<br \/>\nis Goswami by Caste and Hindu by religion which was mentioned in his<br \/>\nSchool Leaving Certificate. The surname mentioned as &#8216;Giri&#8217; is<br \/>\nadmittedly &#8216;Goswami&#8217;. He further submitted that father of the<br \/>\npetitioner has been residing in Ahmedabad since 1960. The petitioner<br \/>\nhas born and brought up in Gujarat.\n<\/p>\n<p>5.1\tLearned<br \/>\nadvocate for the petitioner further submitted that prior to receipt<br \/>\nof the letter from the PTC college he did not receive any<br \/>\ncommunication\/order\/letter from either of the respondents. Thus, the<br \/>\npetitioner had preferred a petition and during the pendency of the<br \/>\npetition, the respondent No. 2 requested to supply copy of order<br \/>\ndated 20.12.2005 by which admission of the petitioner was cancelled.<br \/>\nThereafter, respondent No. 2 issued letter of cancelling the<br \/>\nadmission of the petitioner vide order dated 18.01.2006. Learned<br \/>\nadvocate for the petitioner further submitted that respondent No. 2<br \/>\nhas taken decision on 18.01.2006 while the petitioner&#8217;s admission was<br \/>\ncancelled on 12.01.2006. He further submitted that the decision was<br \/>\ntaken behind the back of the petitioner relying upon the order<br \/>\nnon-existent at the relevant time. Hence, grave injustice was caused<br \/>\nto the petitioner when his admission is cancelled as no decision was<br \/>\ntaken by respondent No.2 and the petitioner&#8217;s Caste Status<br \/>\nCertificate was not cancelled on that day. Hence, the decision which<br \/>\nis taken behind the back of the petitioner is illegal.\n<\/p>\n<p>5.2\tLearned<br \/>\nadvocate for the petitioner submitted that action on the part of the<br \/>\nrespondents is pre-determined. Before respondent No.2 took decision,<br \/>\nadmission of petitioner was cancelled by respondent No.1. This shows<br \/>\nthe pre-meditated and pre-determined act on the part of the<br \/>\nrespondents. Such action of the respondents is not sustainable in<br \/>\nlaw.\n<\/p>\n<p>5.3\tLearned<br \/>\nadvocate for the petitioner further submitted that the petitioner had<br \/>\nadmittedly produced before respondent No.2 a copy of School Leaving<br \/>\nCertificate of his uncle, a copy of the certificate issued by the<br \/>\nemployer showing that the petitioner&#8217;s father was serving in a Mill<br \/>\nsince 1975 and a copy of affidavit showing pedigree and other<br \/>\nrelevant documents including the School Leaving Certificate of the<br \/>\npetitioner. It is also submitted that in the decision dated<br \/>\n18.01.2006, the dispute which is relied on by the authority is as to<br \/>\nwhether the petitioner is residing in the State of Gujarat before<br \/>\n1978. He further submitted that affidavit of the mother of the<br \/>\npetitioner as well as his uncle showing that the petitioner and his<br \/>\nbrothers were born in Gujarat. Therefore, if the petitioner&#8217;s case is<br \/>\nnot considered it will cause grave injustice to the petitioner.\n<\/p>\n<p>6.0\tLearned<br \/>\nAssistant Government Pleader for the respondent- State authorities<br \/>\ncontended that if the petitioner has taken any undue benefits of the<br \/>\ncertificate issued on any incorrect record, then in that case the<br \/>\npetitioners have to face the consequence<br \/>\nof taking undue benefit, to which they were not legally entitled.\n<\/p>\n<p>7.0\tThe<br \/>\nissue involved in the present petition is squarely covered by the<br \/>\ndecision dated 12.03.2008 of this Court rendered in Special Civil<br \/>\nApplication No. 7853 of 2005.\n<\/p>\n<p>8.0\tIn<br \/>\nview of the above, the impugned order passed by respondent No.2 is<br \/>\nnot interfered with, but with the observations that it would be open<br \/>\nto the petitioners to file appropriate civil suit for appropriate<br \/>\ndeclaration that the petitioner belongs to SEBC category. It is<br \/>\nfurther observed that if such a declaration is given by the Civil<br \/>\nCourt, thereafter it would be open to the petitioners to move the<br \/>\nauthority for issuance of the certificates in accordance with law.\n<\/p>\n<p>9.0\tIt<br \/>\nis clarified that if the aforesaid suit is filed by the petitioners,<br \/>\nthe Civil Court shall independently examine the matter and shall not<br \/>\nbe guided by the order of this Court.\n<\/p>\n<p>10.0\tThe<br \/>\npetition is partly allowed to the aforesaid extent. Rule made<br \/>\nabsolute accordingly.\n<\/p>\n<p>11.0<br \/>\nSince the petition is disposed of, Civil Application does not survive<br \/>\nand the same is disposed of accordingly.
