OFFICER &amp; ANOTHER\n \n\nVersus\n \n\nKUKABHAI\nHIPABHAI &amp; OTHERS\n \n\n====================================== \nAppearance\n: \nMs Trusha Patel, Assistant\nGovernment Pleader for the Appellant  \nMs\nManisha Kala for Mr GM Amin for the respondents\n \n======================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BHAGWATI PRASAD\n\t\t\n\t\n\n \n\nDate\n: 02\/07\/2008 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tIn<br \/>\nthe above captioned appeal filed under Section 54 of the Land<br \/>\nAcquisition Act, 1894 (\u00fdSthe Act\u00fd\u00fd)  read with Section 96 of the<br \/>\nCivil Procedure Code, 1908, what is challenged is the legality of<br \/>\naward dated 18.08.2006  passed by the Additional Senior Civil Judge,<br \/>\nAhmedabad (Rural) in Land Acquisition Reference Case No.301 of 2002.<br \/>\nBy the said award, the learned Civil Judge had awarded  additional<br \/>\ncompensation at the rate of Rs.47.70  ps. per Sq. Mtr.,  as against<br \/>\nthe claim of Rs.100\/- per Sq. Mtr. made by the claimants.\n<\/p>\n<p>2.\tThe<br \/>\nExecutive Engineer, Narmada Project, Saurashtra Branch Canal,<br \/>\nDivision  No.2\/4,  Bhavnagar had proposed to acquire agricultural<br \/>\nlands of village : Chokdi, Taluka Dhandhuka, District Ahmedabad, for<br \/>\nthe purpose of construction of canal under Narmada Project. Pursuant<br \/>\nto that, notification under Section 4(1) of the Act was issued, which<br \/>\nwas published in the Official Gazette on 27.04.2000. Thereafter, the<br \/>\nState Government made declaration under Section 6 of the Act, which<br \/>\nwas published on 30.08.2000. The interested persons were served with<br \/>\nnotices for determination of compensation payable to them. The<br \/>\nclaimants appeared before the Special Land Acquisition Officer and<br \/>\nclaimed compensation at the rate of Rs.100\/- per Sq. Mtr. However,<br \/>\nthe Special Land Acquisition Officer offered compensation to the<br \/>\nclaimants at the rate of Rs.1.80 per Sq. Mtr.\n<\/p>\n<p>3.\tThe<br \/>\nclaimants, seeking higher compensation, submitted an application<br \/>\nunder Section 18 of the Act requiring the Special Land Acquisition<br \/>\nOfficer to refer their cases to the Court for the purpose of<br \/>\ndetermining the just and fair compensation.  Accordingly, the<br \/>\nreference was made to the District Court, Ahmedabad (Rural)  where<br \/>\nthey were registered as Land Reference Case Nos.301 of 2002.\n<\/p>\n<p>4.\tOn<br \/>\nbehalf of the claimants, one Umedsang Manubhai was examined at<br \/>\nExh.19.  The claimant in his deposition had referred an award passed<br \/>\nin Land Acquisition Reference No.2720 of 1996.  At his instance, the<br \/>\nsaid award is exhibited as Exh.15.  The said award is for the lands<br \/>\nof village Chokdi for which notification under Section 4 was<br \/>\npublished on 07.06.1993.  The claimant deposed that the lands<br \/>\nacquired in the year 1993 and the lands for which the Reference<br \/>\nNos.301 of 2002  was filed, were  only at a very short distance.<br \/>\nThough the said witness was cross-examined for the learned counsel<br \/>\nfor the acquiring  authorities, nothing substantial could be<br \/>\nelicited, nor the assertions made by the witness could be<br \/>\ndemonstrated to be false.\n<\/p>\n<p>5.\tOn<br \/>\nbehalf of the acquiring authorities, award at Exh. 23, measurement<br \/>\nsheet at Exh.24, award statement at Exh.25 were produced. The<br \/>\nappellant had not led any oral evidence and had not examined any<br \/>\nwitness in their support. On appreciation of the evidence adduced by<br \/>\nthe parties, the Reference Court was of the opinion that the previous<br \/>\naward of the Reference Court relating to the lands of very same<br \/>\nvillage, was a relevant piece of evidence and furnished good guidance<br \/>\nfor the purpose of determining of the market value of the lands<br \/>\nacquired in the instant case.  The learned Judge noticed that<br \/>\nnotification under Section 4(1) of the Act was published in the<br \/>\nOfficial Gazette on 07.06.1993 for the lands acquired earlier;<br \/>\nwhereas, in the instant case, the notification under the said Section<br \/>\nwas issued on 23.04.2000.  He, thereafter, calculated the reasonable<br \/>\nrise in the price of the lands at the rate of 10% per annum. For<br \/>\nearlier acquisition of the lands, award at the rate of Rs.27.60\/- per<br \/>\nSq. Mtr. was passed. Considering that aspect, the Trial Judge derived<br \/>\na figure of Rs.47.50\/- per Sq. Mtr.\n<\/p>\n<p>6.\tI<br \/>\nhave heard Ms. Trusha Patel, learned Assistant Government Pleader for<br \/>\nthe appellants and Mr. Gopinath Amin, learned Counsel for the<br \/>\nclaimants. Ms. Patel submitted that the claimants had not produced<br \/>\nsale bills or purchase bills to show the expenditure incurred by the<br \/>\nclaimants for fertilizers, seeds, medicines, etc. She further<br \/>\ncontended that even apart from the above bills, no document is<br \/>\nproduced to prove that the lands in dispute were of equal fertility,<br \/>\npotentiality and having equal facilities as compared to the lands for<br \/>\nwhich L.A.R. No.2720 of 1996 was passed. She had contended that the<br \/>\nlearned Trial Judge had not discussed the aspect as to how the said<br \/>\naward was comparable.  In response, Mr.Amin had submitted that as the<br \/>\nlands of earlier reference were  nearby lands of the same village, it<br \/>\ncan safely be presumed that the award was comparable.    Ms Patel has<br \/>\nalternatively submitted that even if the award passed in<br \/>\nL.A.Reference No.2720 of 1996 is taken into consideration, the same<br \/>\nwas under challenge before this Court by way of First Appeals<br \/>\nNos.5081 to 5092 of 2006.   It is also pointed out that the Division<br \/>\nBench of this Court has by its order dated 18th February<br \/>\n2006 partly allowed the appeals and the total compensation is reduced<br \/>\nto Rs.25\/- per square meter.   She has, therefore, contended that the<br \/>\ncompensation awarded in the present case should also be<br \/>\nproportionately reduced.\n<\/p>\n<p>7.\tThis<br \/>\nCourt has considered the record and proceedings supplied by the<br \/>\nlearned counsel for the claimants  which includes the documentary<br \/>\nevidence adduced by the parties before the Reference Court. Having<br \/>\ngone through the entire record and decision of this Court in First<br \/>\nAppeals No.5081 of 2006 to 5092 of 2006, I am of the opinion that the<br \/>\ncompensation awarded by the learned Civil Judge is required to be<br \/>\nmodified to the extent the comparable award is modified by the<br \/>\nDivision Bench of this Court.  I further hold that the learned Civil<br \/>\nJudge has rightly considered the award passed in LAR Case No.2720 of<br \/>\n1996 as the same was comparable in facts and circumstances of the<br \/>\npresent case. .  The said reference was for the nearly lands of the<br \/>\nvery same village having similar fertility,  potentiality and<br \/>\nfacilities.  However, as the said award is modified by this Court on<br \/>\n18th February 2006 by partly allowing First Appeals<br \/>\nNos.5081 to 5092 of 2006 filed by the State of Gujarat, this Court<br \/>\nalso feels to modify the award passed in LAR No.301 of 2002 to that<br \/>\nextent.\n<\/p>\n<p>8.\tI<br \/>\ndo not find much substance in the first contention of learned<br \/>\nAssistant Government Pleader to the<br \/>\neffect that the award passed in LAR No.2720 to 2731 of 1996 was not<br \/>\ncomparable to the present case.  However, I accept her alternative<br \/>\nsubmission that the award is required to be modified to the extent<br \/>\nthe award is required to be modified to the extent the award in LAR<br \/>\nNo.2720 of 1996 is modified.  On calculation, it is found that the<br \/>\nclaimants are entitled to to the total compensation at the rate of<br \/>\nRs.42.50 per square meter.\n<\/p>\n<p>9.\tI<br \/>\nfurther believe that by no stretch of imagination it can said that<br \/>\nRs.42.50 per square meter can be termed as excessive or exorbitant<br \/>\nwhen the State has compulsorily acquired the said lands against the<br \/>\nwish of the claimants and when they have lost their livelihood.   The<br \/>\naward passed by the Special Land Acquisition Officer granting the<br \/>\ncompensation at the rate of Rs.1.77 per square meter was arbitrary,<br \/>\noppressive and atrocious and hence the trial Court has rightly held<br \/>\nthat the award passed by the Land Acquisition Officer was inadequate.\n<\/p>\n<p>10.\tIt<br \/>\nis well settled principle of law that the previous award passed by<br \/>\nthe reference court relating tot he lands of same village is a very<br \/>\ngood piece of evidence for the purpose of determining market value of<br \/>\nsimilar lands acquired from the same village subsequently.   In the<br \/>\nfacts and circumstances of the present case, this Court is of the<br \/>\nopinion that the award passed by the Reference Court is required to<br \/>\nbe modified to the aforesaid extent.  Hence, the appeals are partly<br \/>\nallowed.\n<\/p>\n<p>11.\tFor<br \/>\nthe foregoing reasons, the appeal is partly allowed.  It is declared<br \/>\nthat the claimants are entitled to get Rs.42.50 per square meter<br \/>\nincluding the amount already awarded to them by the Land Acquisition<br \/>\nOfficer.    There shall be no order as to costs. The Registry is<br \/>\ndirected to draw the decree in terms of this judgment immediately.<br \/>\nThe amount deposited by the appellants at the time of admission of<br \/>\nthe appeals may be disbursed to the respective claimants after<br \/>\nverification of their identity, if not disbursed.\n<\/p>\n<p>12.\tOffice<br \/>\nis directed to send R &amp;
