It is submitted<br \/>\nby learned advocate Mr.Kharadi that the trial court has not given any<br \/>\ncogent reasons for not discharging the accused. It is also submitted<br \/>\nthat, from the papers of chargesheet, nothing is come out to show<br \/>\nprima-facie that the accused is connected with the crime.  It is also<br \/>\nsubmitted that, when the incident took place, the petitioner is not<br \/>\npartner of M\/s.Jay Ambe Chemicals Trading  and necessary documents<br \/>\nwere also  produced to this effect before the police.  It is<br \/>\nsubmitted that the trial court has not considered the same and the<br \/>\ntrial court has committed an error in rejecting the application<br \/>\nExh.10 submitted under Section 239 of Code of Criminal Procedure.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned APP Ms.C.M.Shah for the respondent-State.  It is submitted by<br \/>\nlearned APP Ms.C.M.Shah that, as far as   resolution of the deed of<br \/>\npartnership is concerned,  there is no signature of the present<br \/>\npetitioner was found, and only with a view  to escape his liability,<br \/>\nthe same was created an after-thought.  It is also submitted that<br \/>\ninitially the accused was absconding and therefore he was not<br \/>\narrested and chargesheet could not be filed against the present<br \/>\npetitioner. It is also submitted that the chargesheet was filed<br \/>\nagainst other co-accused persons and the trial has  already been<br \/>\ncommenced and the matter is pending before the trial court for<br \/>\ndelivering the judgment. Subsequently the present petitioner was<br \/>\narrested and the supplementary chargesheet was filed before the trial<br \/>\ncourt.  It is further submitted that  the statement of co-accused has<br \/>\nbeen recorded and there is ample evidence against the present<br \/>\npetitioner.  It is, therefore, submitted that the impugned order<br \/>\npassed by the trial court is legal and proper and the same is not<br \/>\nrequired to be interfered with by this Court.\n<\/p>\n<p>4.\tThis<br \/>\nCourt has gone through the impugned order passed by the trial court.<br \/>\nIt is observed by the trial court that, after perusing the police<br \/>\npapers, there is evidence which connect the present petitioner &#8211;<br \/>\naccused with the crime and sufficient evidence is there to initiate<br \/>\ntrial against the present petitioner.  This Court has also gone<br \/>\nthrough certain papers of chargesheet. As far as resolution of deed<br \/>\nof partnership is concerned,  the  signature  of the present<br \/>\npetitioner is not found in the said partnership deed.  Moreover there<br \/>\nis charge of conspiracy  under Section 120-B of Indian Penal Code,<br \/>\nand to prove this charge, statement of co-accused is also relevant<br \/>\nunder Section 10 of Indian Evidence Act.
