SHAH\n\t\t\n\t\n\n \n\nDate\n: 20\/06\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tAppeal<br \/>\nfrom Order No.284\/2010 has been preferred by the appellant herein &#8211;<br \/>\noriginal plaintiff to quash and set aside the impugned order dated<br \/>\n09\/07\/2010 passed by learned Principal Senior Civil Judge, Modasa<br \/>\nbelow Exhs.8 &amp; 29 in Special Civil Suit No.76\/2010, by which,<br \/>\nlearned Trial Court has dismissed the aforesaid two applications<br \/>\npreferred by the appellant &#8211; original plaintiff and has refused to<br \/>\ngrant interim injunction in favour of original plaintiff with respect<br \/>\nto disputed property in question.\n<\/p>\n<p>2.\t\tAppeal<br \/>\nfrom Order No.289\/2010 has been preferred by the appellant herein &#8211;<br \/>\noriginal plaintiff to quash and set aside the impugned order dated<br \/>\n09\/07\/2010 passed by learned Principal Senior Civil Judge, Modasa<br \/>\nbelow Exhs.8 &amp; 29 in Special Civil Suit No.77\/2010, by which,<br \/>\nlearned Trial Court has dismissed the aforesaid two applications<br \/>\npreferred by the appellant &#8211; original plaintiff and has refused to<br \/>\ngrant interim injunction in favour of original plaintiff with respect<br \/>\nto disputed property in question.\n<\/p>\n<p>3.\t\tMr.N.K.Pahwa,<br \/>\nlearned advocate appearing on behalf of respective respondent No.2<br \/>\nherein &#8211; original defendant No.2 &#8211; purchaser of the<br \/>\ndisputed property in question, under the instructions from his<br \/>\nrespective clients, has stated at the bar that at present the<br \/>\nrespective original defendants more particularly original defendant<br \/>\nNo.2          are not desirous of transferring and\/or alienating the<br \/>\nsuit properties in any manner whatsoever and as and when respective<br \/>\ndefendant No.2 propose to transfer and\/or alienate the suit<br \/>\nproperties, the same shall be done only after obtaining appropriate<br \/>\npermission from the learned Trial Court and for which, an appropriate<br \/>\napplication shall be submitted by respective original defendant No.2.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the above, the present Appeals from Orders are disposed of by<br \/>\ndirecting the respective respondent No.2 herein &#8211; original<br \/>\ndefendant No.2 to act as stated hereinabove. As and when respective<br \/>\noriginal defendant No.2 propose to transfer and\/or alienate the suit<br \/>\nproperties and any application is submitted by respective respondent<br \/>\nNo.2 herein &#8211; original defendant No.2, the same shall be<br \/>\nconsidered by the Trial Court in accordance with law and on merits,<br \/>\nwithout in any way being influenced by the order passed below Exh.5<br \/>\nas well as the present order. With above directions, both these<br \/>\nAppeals from Orders are disposed of.\n<\/p>\n<p>5.\t\tIn<br \/>\nview of disposal of the main Appeals from Orders, no order in the<br \/>\nCivil Applications and Civil Applications are also disposed of<br \/>\naccordingly.
