Mann, Advocate for the petitioner.\n\n                                     ..\n<\/pre>\n<p>Rajesh Bindal J.\n<\/p>\n<p>                In the present petition, the challenge is to the order dated 18.11.2008,<br \/>\npassed by the learned court below, whereby on account of non-filing of written<br \/>\nstatement by the petitioner, his defence was struck off.\n<\/p>\n<p>                For the view I am taking, I do not deem it appropriate to issue notice<br \/>\nof motion to the respondents as the same would not only delay the disposal of the<br \/>\npresent petition but even delay the disposal of the claim petition before the learned<br \/>\ncourt below.\n<\/p>\n<p>                Learned counsel for the petitioner submitted that written statement<br \/>\ncould not be filed on the date fixed for the reason that counsel for the petitioner<br \/>\nnoted a wrong         date, otherwise the written statement was ready. He further<br \/>\nsubmitted that no effective proceedings have taken place after the passing of the<br \/>\nimpugned order as the case is still fixed for filing of replication to the written<br \/>\nstatement filed by other respondents. She has relied upon judgments of Hon&#8217;ble<br \/>\nthe Supreme Court in <a href=\"\/doc\/877414\/\">Kailash v. Nanhku and others<\/a>, JT 2005(4) SC 204; <a href=\"\/doc\/393527\/\">Salem<br \/>\nAdvocate Bar Association, Tamil Nadu v. Union of India, JT<\/a> 2005(6) SC 486 and<br \/>\n<a href=\"\/doc\/1461813\/\">M\/s R. N. Jadi and Brothers and others v. Subhashchandra, JT<\/a> 2007(9) SC 165 to<br \/>\nsubmit that Order VIII Rule 1 of the Code of Civil Procedure has been held to be<br \/>\ndirectory in nature and not mandatory.\n<\/p>\n<p>                After hearing learned counsel for the petitioner, I find merit in the<br \/>\ncontentions raised by him.\n<\/p>\n<p>                It has been consistently opined by Hon&#8217;ble the Supreme Court in the<br \/>\njudgments, referred to above, that Order VIII Rule 1 of the Code of Civil<br \/>\nProcedure which provides time for filing of written statement is directory in<br \/>\n C.R. No. 97 of 2009                                         [2]<\/p>\n<p>nature.\n<\/p>\n<p>                Accordingly, the petition is accepted.
