L.B.DABHI, APP for Respondent(s) :\n1, \nNone for Respondent(s) :\n2, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 15\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>RULE.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tL.B.Dabhi, learned APP appears and waives service of notice of Rule<br \/>\n\ton behalf of the Respondent &#8211; State of Gujarat.\n<\/p>\n<p>Having<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>By<br \/>\n\tfiling instant Application through jail authority, the applicant &#8211;<br \/>\n\tconvict has prayed to release him on temporary bail for a period of<br \/>\n\t45 days to enable him to get the treatment from the Doctor of his<br \/>\n\town choice as he is a known case of PLHA (HIV reactive) since<br \/>\n\t20.7.2010.\n<\/p>\n<p>Having<br \/>\n\tconsidered the submission advanced by Mr.L.B.Dabhi, learned APP for<br \/>\n\tthe Respondent &#8211; State of Gujarat and a perusal of the<br \/>\n\taverments made in the application, so also the jail remark sheet<br \/>\n\tforwarded by the jail authority along with the Application it is<br \/>\n\tseen that the Applicant convict has undergone total period of 2<br \/>\n\tyears, 9 months and 28 days imprisonment. That apart, on perusal of<br \/>\n\tthe medical certificate dated 3.2.2011 issued by Medical Officer,<br \/>\n\tCentral Jail Dispensary, Ahmedabad, it is seen that the Applicant<br \/>\n\taccused is known case of PLHA (HIV reactive) since 20.7.2010 and is<br \/>\n\tgiven treatment according to (National Aids Control Programme, which<br \/>\n\tis approved by World Health Organization under the consultation of<br \/>\n\tART experts of Civil Hospital, Ahmedabad.  At present, the Applicant<br \/>\n\taccused has complained for blood in urine, but the urine sample<br \/>\n\texamination is normal and the patient is regularly seen and treated<br \/>\n\tby full time general surgeon of Central Dispensary.\n<\/p>\n<p>In<br \/>\n\tview of this, though, the Applicant accused is a known case of PLHA<br \/>\n\t(HIV reactive) since 20.7.2010 and has been given regular treatment<br \/>\n\tby full time general surgeon of Central Dispensary, we are not<br \/>\n\tinclined to release the Applicant convict on temporary bail on the<br \/>\n\tgrounds stated by him in the application.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the application fails and accordingly it is<br \/>\n\trejected.\n<\/p>\n<p>Rule<br \/>\n\tis discharged.\n<\/p>\n<p>(A.M.Kapadia,J)<\/p>\n<p>(B.N.Mehta,J)<\/p>\n<p>Jayanti*<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Bharat vs State on 15 February, 2011 Author: A.M.Kapadia,&amp;Nbsp;Honourable Mr.Justice Bankim.N.Mehta,&amp;Nbsp;
