Yadav\n\nHon'ble Dilip Gupta,J.\n<\/pre>\n<p>The petitioners have sought the quashing of the order dated 24th<br \/>\nApril, 2009 passed by the District Inspector of Schools, Mau as<br \/>\nwell as a direction upon the respondents to ensure compliance of<br \/>\nthe order dated 22nd June, 2009 passed by the Director of<br \/>\nEducation (Madhyamik), Allahabad. The petitioners have also<br \/>\nsought a direction upon the Joint Director of Education, Azamgarh<br \/>\nRegion Azamgarh to decide the dispute of the Committee of<br \/>\nManagement referred to him on 13th September, 2006 as well as<br \/>\nthe present dispute with regard to the elections held in 2009.\n<\/p>\n<p>The records of the writ petition indicate that in respect of the<br \/>\nelections held for the year 2006, two rival Committees set up their<br \/>\nclaim for recognition and the District Inspector of Schools by his<br \/>\norder dated 13th September, 2006 referred the matter to the Joint<br \/>\nDirector of Education, Azamgarh Region Azamgarh. The records<br \/>\nalso indicate that in respect of the elections held in the year 2009<br \/>\nthe respondent-Committee of Management held elections and the<br \/>\nDistrict Inspector of Schools by his order dated 24th April, 2009<br \/>\nattested the signatures of the Manager of the respondent-<br \/>\nCommittee of Management. The case set up by the petitioners is<br \/>\nthat they had also held elections on 7th March, 2008 and the<br \/>\npapers were submitted in the office of the District Inspector of<br \/>\nSchools on 11th March, 2009 but without considering the said<br \/>\nelection, the District Inspector of Schools recognized the election<br \/>\nheld by the respondent-Committee of Management by the order<br \/>\ndated 24th April, 2009.\n<\/p>\n<p>It transpires that subsequently the petitioners filed a representation<br \/>\nbefore the Joint Director of Education, Azamgarh Region<br \/>\nAzamgarh, who passed an order on 2nd May, 2009 in favour of the<br \/>\npetitioner-Committee of Management but this order was recalled<br \/>\nsubsequently by the order dated 2nd May, 2009. The petitioners<br \/>\nthen filed a representation before the Director of Education<br \/>\n(Madhyamik) Allahabad who passed an order on 22nd June, 2009<br \/>\n for maintaining status quo. According to the respondents, the order<br \/>\ndated 22nd June, 2009 has been recalled by the Director of<br \/>\nEducation (Madhyamik) Allahabad.\n<\/p>\n<p>I have heard Sri G.K. Singh, learned counsel for the petitioners<br \/>\nand Sri Ashok Khare, learned Senior Counsel for the respondents.\n<\/p>\n<p>Sri G.K.Singh, learned counsel appearing for the petitioners<br \/>\nsubmitted that the dispute regarding the election held in 2006 has<br \/>\nnot been decided and even the dispute regarding the election held<br \/>\nin 2009 is pending before the Joint Director of Education. He,<br \/>\ntherefore, submits that the Joint Director of Education who is the<br \/>\nChairman of the Regional Committee should have referred the<br \/>\nmatter to the Regional Committee for consideration but that has<br \/>\nnot been done.\n<\/p>\n<p>Sri Ashok Khare, learned Senior Counsel appearing for the<br \/>\nrespondent-Committee of Management, however, submits that the<br \/>\npetitioners have not placed before the Court the relevant orders<br \/>\ndated 16th January, 2009, 18th March, 2009 and 4th April, 2009<br \/>\nand in the facts and circumstances of the case when they<br \/>\nthemselves had not approached the Regional Committee and have<br \/>\nfiled representations before the Joint Director of Education and<br \/>\nDirector of Education (Madhyamik), the matter is not required to<br \/>\nbe referred to the Regional Committee. He further submits that the<br \/>\npetitioners have failed to establish that they had held the elections<br \/>\non 7th March, 2008 as no document has been filed in support of<br \/>\nthe said election.\n<\/p>\n<p>I have carefully considered the submissions advanced by learned<br \/>\ncounsel for the parties.\n<\/p>\n<p>The District Inspector of Schools has recognized the respondent-<br \/>\nCommittee of Management by the order dated 22nd April, 2009. It<br \/>\nis the case of the petitioners that they had also held election which<br \/>\nhas not been taken into consideration by the District Inspector of<br \/>\nSchools. The petitioners have represented their matter to the Joint<br \/>\nDirector of Education who is the Chairman of the Regional<br \/>\nCommittee. The contention of the respondent-Committee of<br \/>\nManagement is that the Regional Committee does not have the<br \/>\njurisdiction. This objection can also be examined by the Regional<br \/>\nCommittee as also other objections.\n<\/p>\n<p>The writ petition is, accordingly, disposed of with a direction to<br \/>\nthe Regional Committee to decide the matter expeditiously after<br \/>\naccording adequate opportunity to the petitioners as also the<br \/>\n respondent-Committee of Management and it shall be open to the<br \/>\nrespondent-Committee of Management to raise all the objections<br \/>\nbefore the Regional Committee including the objection that the<br \/>\nRegional Committee does not have the jurisdiction to decide the<br \/>\nmatter.\n<\/p>\n<p>It is made clear that this Court has not adjudicated upon the merits<br \/>\nof the case, which shall be considered by the Regional Committee<br \/>\nin accordance with law.\n<\/p>\n<p>Order Date :- 7.1.2010<br \/>\nNSC\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court C\/M Town Inter College Thru&#8217;
