They have challenged an order dated 1.10.07<br \/>\npassed by the Principal Senior Civil Judge, Anjar below Ex.5 in<br \/>\nSpecial Civil Suit No.9\/07.  Operative part of the impugned order<br \/>\nreads as follows:\n<\/p>\n<p>   (1)The<br \/>\npresent application is hereby ordered \t\tto be allowed.\n<\/p>\n<p>Defendant<br \/>\n\tare restraining from transferring, alienating the said property<br \/>\n\tthrough them or by their power of attorneys till then the final<br \/>\n\tdisposal of the suit.\n<\/p>\n<p>The<br \/>\n\tplaintiff is directed to deposit the rest of the amount in the Court<br \/>\n\twithin 15 days from the date of the order.\n<\/p>\n<p>Defendants<br \/>\n\tare hereby directed to carry out the measurement through D.I.L.R.<br \/>\n\tThat is the proper authority for carrying out the measurement and<br \/>\n\tthe report should be produced before this Court within 30 days from<br \/>\n\tthe date of the order and if any time is required, defendants are<br \/>\n\tpermitted to ask for the time.\n<\/p>\n<p>Learned<br \/>\nadvocate Shri Buch for the appellants submitted that the appellants<br \/>\ndo not in this appeal oppose the directions restraining the defendant<br \/>\nfrom transferring, alienating the property during the pendency of the<br \/>\nsuit nor are the appellants perturbed by the direction for taking out<br \/>\nmeasurements of the property in question.  He, however,submitted that<br \/>\nthe direction for depositing  rest of the amount before the Court<br \/>\nwould prejudice the appellants-original defendants.\n<\/p>\n<p>\tI<br \/>\nsee no reason to interfere.  All that the Trial Court  at the interim<br \/>\nstage   has done is to have the measurements of the property taken<br \/>\nand restrain the defendants from transferring or alienating the<br \/>\nproperty. Additionally, the plaintiff is directed to deposit the<br \/>\nremaining amount  under the agreement to sell.  This is only to test<br \/>\nthe bonafide of the plaintiff.  No prejudice would be caused  to the<br \/>\ndefendants i.e. present appellants.  The suit will be decided finally<br \/>\non the basis of the evidence that may be brought on record by both<br \/>\nthe sides unmindful of the observations  in the impugned order  as<br \/>\nwell as in  this order.
