MENGDEY APP for Respondent No.\n2 \n=========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.R.VORA\n\t\t\n\t\n\n \n\n                      Date\n: 23\/07\/2008 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tThis<br \/>\npetition is filed under Section  482 of the Code of Criminal<br \/>\nProcedure to quash and set aside the Criminal Complaint (case) No. 7<br \/>\nof 2002 filed before the Court of  Judicial Magistrate, First Class,<br \/>\nBharuch,  on 04.02.2002.\n<\/p>\n<p>2\t\tRespondent<br \/>\nNo.1 Pavankumar  Rameshchandra  Jain presented a private complaint<br \/>\nagainst the present petitioner and one more accused  for the offences<br \/>\npunishable under Sections 465, 471 and 114 of the Indian Penal Code.<br \/>\nPresent  petitioner  was Sarpanch  of Palej Gram Panchayat, District<br \/>\n  Bharuch, while accused  No.1   was  the Talati-cum-Mantri, who is<br \/>\nnot before this Court.  It is the case of the petitioner that  on<br \/>\n23.12.2001,  in  an election  held of Palej Gram Panchayat,  he was<br \/>\nelected as a  member.  There were 19 members in all.  The record of<br \/>\nthe panchayat was always kept with the accused No.1 being<br \/>\nTalati-cum-Mantri. As alleged in the complaint, there were groups in<br \/>\nthe members of the  said panchayat.   A meeting was to be held on<br \/>\n30.01.2002 of the panchayat, and according to the complainant, he had<br \/>\nrequested all the members and accused No.1  to form various<br \/>\ncommittees in the said meeting to he held on 30.1.2002. As mentioned<br \/>\nin para-3 of the application, in the said meeting, the group of the<br \/>\ncomplainant proposed five names of the Executive Committee, which<br \/>\nwas, according to the  complainant,  supported by one of the members<br \/>\nand was allowed by the committee with the support of 11 members.<br \/>\nLikewise, it was proposed to form Social Justice Committee, Water<br \/>\nCommittee etc from the group of the complainant  and those committees<br \/>\nwere supported by the 11 members of the panchayat. The minutes book<br \/>\nwere to be recorded  by accused No.1   of the proceedings took place<br \/>\nof the meeting  held on 30.1.2002 and thereafter accused No.1 was<br \/>\nrequired to  record such proceedings in register.   As soon as the<br \/>\nmeeting was over, complainant asked for the certified copy of the<br \/>\nproceedings,  which were not given by the accused No.1 and was given<br \/>\nto the complainant on 2nd of February, 2002. When this<br \/>\ncertified copies were seen by the complainant, it came to  his<br \/>\nknowledge that proceedings of meeting  held on 30.01.2002 were not<br \/>\ncorrectly reflecting the said proceedings  in the panchayat record,<br \/>\nwhich were prepared by accused No.1, and intentionally  fabricated<br \/>\nand forged documents were prepared by him in abetment of present<br \/>\npetitioner   accused No.2, Sarpanch.  This is  sum and substance<br \/>\nof the accusation. Therefore,  this petition is filed  to quash the<br \/>\nsaid complaint  filed by  respondent No.1.\n<\/p>\n<p>3.\t\tLearned<br \/>\nJudicial Magistrate, First Class, Bharuch, forwarded this complaint<br \/>\nfor the police investigation under Section   156(3)of the Code of<br \/>\nCriminal Procedure. Learned Advocate Ms. Renu Singh  for  learned<br \/>\nAdvocate Mr. Yogesh Ravani for the petitioner and learned APP Mr.<br \/>\nM.R. Mengdey  were heard in detail.  While learned Advocate Mr. G.C.<br \/>\nRay for the respondent No.1  &#8211; original complainant   is not present.\n<\/p>\n<p>4.\t\tIt<br \/>\nwas vehemently submitted by Miss. Renu Singh,  learned Advocate for<br \/>\nthe petitioner that the complaint filed by the complainant   i.e.<br \/>\nrespondent No.1 is mala fide and intentionally  motivated to allege<br \/>\nthe petitioner. It is submitted that ingredients of Section 463,<br \/>\nwhich is alleged against the accused,  has not been disclosed even on<br \/>\nbare reading of the complaint.  It is submitted that there was no<br \/>\nfirst resolution or proceedings and thereafter  second resolution or<br \/>\nproceedings so as to compare both and to come to the conclusion that<br \/>\nthe resolutions for the proceedings prepared by  accused No.1  were<br \/>\nforged.   It is submitted  that even otherwise,  the Gujarat<br \/>\nPanchayats Act, 1993 provides remedies to the members to file Appeal<br \/>\nunder Section 242 of the said Act against any decision of the<br \/>\npanchayat.  Even thereafter there are  remedies of Revisions, etc.<br \/>\nIt is submitted that this complaint is filed only with a motivated<br \/>\nintention  for suspension of sarpanch  &#8211; accused No.1 present<br \/>\npetitioner.  Resolutions are to be prepared by accused No.1 Vora<br \/>\nGanibhai and not by the present petitioner, who is sarpanch.<br \/>\nTherefore, there is no role so far as the present petitioner is<br \/>\nconcerned so as to involve him in this serious offence.\n<\/p>\n<p>5.\t\tAs<br \/>\nagainst that, learned APP Mr. M.R. Mengdey, vehemently urged that<br \/>\nmerely  availability of alternative remedy, would not bar a<br \/>\nprosecution when offence is disclosed.   It has been vehemently urged<br \/>\nthat while  quashing the proceedings, there were mala fides on the<br \/>\npart of the complainant  especially when the complaint is registered,<br \/>\n is not at all a factor, to be considered in the  quashing petition.<br \/>\nIt is requested that the  petition requires to be dismissed.\n<\/p>\n<p>6.\t\tHaving<br \/>\nheard the learned counsels  as said above and when the counsel for<br \/>\nthe complaint respondent No.1  is absent,   this Court has gone<br \/>\nthrough the facts of the case  minutely.   Undoubtedly,   it has now<br \/>\nbeen settled in many decisions  that  though  inherent powers of this<br \/>\nCourt  under Section 482  of the Code of Criminal Procedure are wide,<br \/>\nbut has to be exercised sparingly, carefully and with caution and<br \/>\nonly when such exercise is justified by the tests specifically laid<br \/>\ndown in Section 482  i.e. to prevent  the abuse of process of court.<br \/>\nIt cannot be used to stifle a legitimate prosecution.\n<\/p>\n<p>7.\t\tLearned<br \/>\nAPP Mr. M.R. Mengdey relied upon a decision of the Apex Court in the<br \/>\nmatter of <a href=\"\/doc\/279427\/\">ZANDU PHARMACEUTICAL WORKS LTD vs MOHD. SHARAFUL HAQUE AND<br \/>\nANR.,<\/a> as reported in 2005 (1) SCC 122 and attention of this Court was<br \/>\ndrawn to para 10 of the decision, wherein the Apex Court<br \/>\ncategorically observed that when an information is lodged  at the<br \/>\npolice station and an offence is  registered, then the mala fides of<br \/>\nthe informant  would be of secondary importance.   It is the<br \/>\nmaterial collected during the investigation  and evidence led in<br \/>\ncourt which decides the fact of the accused  person.  The allegations<br \/>\nof mala fides against the informant  are of no consequence and cannot<br \/>\nby themselves be the basis for quashing  the proceedings.\n<\/p>\n<p>8.\t\tIn<br \/>\nthe facts of the present case and in the scope of Section 482 of the<br \/>\nCode of Criminal Procedure,  this Court is unable to accept the<br \/>\ncontention of learned Advocate for the petitioner  that no offence<br \/>\nwhatsoever  is disclosed by the complaint.   It has been specifically<br \/>\naverred  that  in the meeting  proceedings were recorded by accused<br \/>\nNo.1 and when it was entered into the record of the panchayat with<br \/>\nthe aid and abetment of present  petitioner, those proceedings  were<br \/>\nchanged  and  in the committees proposed by the complainant,  names<br \/>\nof the group of the present petitioner  appeared, though, that was<br \/>\nnot the correct proceedings which had taken place in the meeting.<br \/>\nThis allegation at present,  prima facie, discloses the ingredients<br \/>\nof  forging and fabricating a document wherein role of the present<br \/>\npetitioner    being accused No.2  is also depicted in the complaint.<br \/>\nThis court  would not enter into the inquiry as to what extent  the<br \/>\nallegations are true as this has to be  investigated by the police<br \/>\nand to be tried by the Magistrate. This Court cannot  assuming  the<br \/>\nrole of  trial court and, therefore,  the present application<br \/>\ndeserves to be dismissed.\n<\/p>\n<p>9.\t\tIn<br \/>\nthe result, this petition stands dismissed.  Rule is discharged.<br \/>\nInterim relief granted vide order dated 27th of Jan, 2003<br \/>\nis further extended for 08 weeks from today, in case the petitioner<br \/>\nintends to approach higher forum. However, interim relief shall not<br \/>\nthereafter  further be extended in any circumstances.\n<\/p>\n<p>(J.\n<\/p>\n<p>R.
