Assistant Administrator, Bankipur Circle Patna<br \/>\n                 Municipal Corporation,Both at Budh Marg, P.S.<br \/>\n                 Kotwali, District Patna.\n<\/p>\n<pre>                                            ------              Respondents\n                               =====\n<\/pre>\n<p>          For the petitioner : Mr. Birendra Mohan Singh<br \/>\n                               And Mrs. Anjana Mishra<br \/>\n          For the Respondents: Mr. Chandra Shekhar<br \/>\n                               =====<br \/>\n                           P R E S E N T<\/p>\n<p>               THE HON&#8217;BLE MR JUSTICE AJAY KUMAR TRIPATHI<\/p>\n<p>Ajay Kumar Tripathi,J.,          The    background         to     filing    of     the<\/p>\n<p>          present writ application is on going dispute between the<\/p>\n<p>          petitioner      and    the        respondent          Patna      Municipal<\/p>\n<p>          Corporation over what would be the correct assessment of<\/p>\n<p>          tax for the holding of the petitioner in question. Some<\/p>\n<p>          time in the year 1992 the annual rental value of the<\/p>\n<p>          property under the purported exercise of power under<\/p>\n<p>          section 139 of Patna Municipal Corporation Act was made<\/p>\n<p>          at   Rs.   13,000\/-   but    on    an   appeal    vide        order    dated<\/p>\n<p>          20.7.1992 this amount was reduced to Rs. 11,000\/- and<\/p>\n<p>          the petitioner started paying the holding tax on such a<\/p>\n<p>          decision but in yet another action of the respondents<\/p>\n<p>          the issue of annual rental value of the property was<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>reopened by respondent Patna Municipal Corporation and a<\/p>\n<p>figure of Rs. 80,000\/- was worked out. A demand was<\/p>\n<p>raised on the petitioner and the petitioner decided to<\/p>\n<p>appeal    against       the    said     demand.        From   perusal    of<\/p>\n<p>annexure-4 it is evident that the matter had been heard<\/p>\n<p>over many years but hearing was nothing substantive.<\/p>\n<p>Except for adjournments, the merit of the matter was<\/p>\n<p>never gone into. On 14.5.1993 the administrator in his<\/p>\n<p>order records that the petitioner would pay 50% of the<\/p>\n<p>annual rental value of Rs. 80,000\/- and the merit of the<\/p>\n<p>matter would be decided at a later date. When no final<\/p>\n<p>adjudication was made for quite some time, petitioner<\/p>\n<p>decided    to    file   the   present     writ    application      on    the<\/p>\n<p>ground    that    the   demand    raised       cannot    be   enforced    in<\/p>\n<p>absence of a final adjudication attaining finality in<\/p>\n<p>view of mandate of law laid down under section 153 of<\/p>\n<p>the   Act.   He    is   precluded       from   challenging      the   order<\/p>\n<p>before the District Judge and testing the validity of<\/p>\n<p>such a decision. His contention is that he is being<\/p>\n<p>forced to pay taxes even without a proper assessment<\/p>\n<p>having been finally made against him.<\/p>\n<p>2.           A perusal of annexure-4 is a clear indication<\/p>\n<p>of adhocism in decision making by the respondent Patna<\/p>\n<p>Municipal       Corporation.      The    power    of    deciding      annual<\/p>\n<p>rental value is surely within their domain under the Act<\/p>\n<p>but a decisive opinion will have to be recorded one way<\/p>\n<p>or the other to at least allow every person to move the<br \/>\n<span class=\"hidden_text\">                                      3<\/span><\/p>\n<p>          next higher forum and test its validity, if not the<\/p>\n<p>          reasonableness of such a decision.\n<\/p>\n<p>          3.          Since in the present case the administrator<\/p>\n<p>          has not rendered his opinion on the merits of the matter<\/p>\n<p>          he is    precluded from demanding municipal holding tax<\/p>\n<p>          from the petitioner on the basis of annual rental value<\/p>\n<p>          of Rs. 80,000\/- or even payment of 50% thereof. The<\/p>\n<p>          orders     and   the   demand   of   holding   tax   raised    are<\/p>\n<p>          quashed. Liberty however, is granted to the concerned<\/p>\n<p>          authority that he shall decide the matter in accordance<\/p>\n<p>          with law    and then thereafter enforce the same.<\/p>\n<p>          4.
