No.34486 of 2008\n           ------------------------------------------------\n          Dated this the 21st day of November, 2008\n\n                          JUDGMENT\n<\/pre>\n<p>    Petitioner is the first judgment debtor in<\/p>\n<p>O.S.340\/06 on the file of the Munsiff&#8217;s Court,<\/p>\n<p>Punalur. The decree in the suit was passed against<\/p>\n<p>himself  and  defendants            2     and      3    granting  the<\/p>\n<p>respondent  mandatory           injunction            directing    the<\/p>\n<p>defendants to vacate the scheduled building within<\/p>\n<p>a time limit. As the judgment debtors did not<\/p>\n<p>surrender vacant possession in compliance with the<\/p>\n<p>decree, Ext.P3 execution petition was filed in the<\/p>\n<p>court below to which it is submitted is Ext.P4<\/p>\n<p>objection filed by the judgment debtors. They also<\/p>\n<p>filed petition in the court below as I.A.2049\/08<\/p>\n<p>(Ext.P1) to set aside the ex parte decree and<\/p>\n<p>I.A.2048\/08  (Ext.P2)          to     condone         the    delay  in<\/p>\n<p>filing the petition to set aside the ex parte<\/p>\n<p>decree.  Ext.P6     petition          was      filed       to  advance<\/p>\n<p>hearing of I.A.2048\/08 and I.A.2049\/08. According<\/p>\n<p>to the learned counsel for the petitioner, no<\/p>\n<p>orders are passed on the advance petition and no<\/p>\n<p><span class=\"hidden_text\">W. P. C. No.34486 of 2008          -2-<\/span><\/p>\n<p>      considered order is passed on Exts.P1 and P2<\/p>\n<p>      applications and before that the execution is<\/p>\n<p>      being       proceeded  with  and the  execution court<\/p>\n<p>      passed        Ext.P5  order deputing Amin  to  effect<\/p>\n<p>      delivery and the case is posted to 25\/11\/05 for<\/p>\n<p>      report of delivery. Counsel asserts that delivery<\/p>\n<p>      has not been effected till now and I propose to<\/p>\n<p>      pass orders believing the said representation and<\/p>\n<p>      giving the counsel to understand that this order<\/p>\n<p>      shall not have any effect if delivery is effected<\/p>\n<p>      by this time viz. 2.30 p.m. In case delivery is<\/p>\n<p>      not already effected the delivery shall stand<\/p>\n<p>      adjourned by two weeks. In the meanwhile, the<\/p>\n<p>      learned Munsiff shall pass appropriate orders on<\/p>\n<p>      Exts.P1         and P2 advancing the hearing  to any<\/p>\n<p>      convenient         date on  the  application  of  the<\/p>\n<p>      petitioner with a copy of this judgment and with<\/p>\n<p>      notice to the respondent as this Writ Petition is<\/p>\n<p>      being        disposed   of  without  notice   to  the<\/p>\n<p>      respondent.\n<\/p>\n<p>              This Writ Petition is disposed of with the<\/p>\n<p>      above directions. Issue copy of this judgment to<\/p>\n<p><span class=\"hidden_text\">W. P. C.
