Justice K.HEMA\n\n Dated :21\/06\/2010\n\n O R D E R\n                             K.HEMA, J.\n            ----------------------------------------------\n               Bail Application No.3730 of 2010\n            ----------------------------------------------\n                     Dated 21st June, 2010.\n\n                              O R D E R\n<\/pre>\n<p>           This petition is for bail.\n<\/p>\n<p>           2. The alleged offences are under Sections 143, 147,<\/p>\n<p>148, 323, 324, 307 and 120B read with Section 149 of the Indian<\/p>\n<p>Penal Code. According to prosecution, on 15.5.2010, at about 11<\/p>\n<p>p.m., petitioners(accused nos.1 to 3) along with another assaulted<\/p>\n<p>defacto complainant using knife, stone etc. and he sustained<\/p>\n<p>serious injuries. The offences were committed in pursuance of a<\/p>\n<p>conspiracy.\n<\/p>\n<p>           3.   Learned counsel for petitioners submitted that<\/p>\n<p>petitioners were not implicated as per the first information<\/p>\n<p>statement. The name of four persons were referred to in the F.I.<\/p>\n<p>statement, who are stated to be known to defacto complainant<\/p>\n<p>and according to him, those persons had stabbed him and hit him<\/p>\n<p>with stone etc. Petitioners&#8217; names were not mentioned in the F.I.<\/p>\n<p>statement and defacto complainant had no case that any persons<\/p>\n<p>other than the five persons stated in the F.I. statement were<\/p>\n<p>involved. Petitioners are subsequently brought to the array of<\/p>\n<p><span class=\"hidden_text\">BA NO. 3730\/10                     2<\/span><\/p>\n<p>accused. It is also submitted that one of the accused, who was<\/p>\n<p>referred to in the F.I. statement was granted bail by this Court, as<\/p>\n<p>per Annexure 2 order. Petitioners were arrested on 16.5.2010<\/p>\n<p>and they are in custody for the past 36 days.<\/p>\n<p>            4. This petition is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that the role of 4th accused is different from the role of<\/p>\n<p>the other accused. That is the reason why bail was granted to<\/p>\n<p>him. But, as per the materials in the case diary, petitioners are<\/p>\n<p>the persons who had assaulted defacto complainant.<\/p>\n<p>            5.   On hearing both sides and on going through the<\/p>\n<p>case diary, particularly the F.I. statement, I am inclined to grant<\/p>\n<p>bail to petitioners on conditions. Hence, the following order is<\/p>\n<p>passed :\n<\/p>\n<\/p>\n<blockquote><p>            Petitioners shall be released on bail on their executing<\/p>\n<p>            bond for Rs.50,000\/- (Rupees fifty thousand only) each<\/p>\n<p>            with two solvent sureties each for the like sum to the<\/p>\n<p>            satisfaction of the court concerned, on the following<\/p>\n<p>            conditions :\n<\/p><\/blockquote>\n<blockquote><p>                (i)         Petitioners shall report before the<\/p>\n<p><span class=\"hidden_text\">BA NO. 3730\/10                  3<\/span><\/p>\n<p>                     Investigating Officer     on every Monday,<\/p>\n<p>                     Wednesday and Saturday between 10 a.m.<\/p>\n<p>                     and 1 p.m. until further orders.<\/p>\n<\/blockquote>\n<blockquote><\/blockquote>\n<p>               (ii)   Petitioners shall not enter the limits of the<\/p>\n<p>                     police   station,  within   which   crime   is<\/p>\n<p>                     registered,   except    for   compliance    of<\/p>\n<p>                     condition No.1.<\/p>\n<blockquote><p>               (iii)  Petitioners shall not influence or intimidate<\/p>\n<p>                     any witness or tamper with evidence.<\/p>\n<\/blockquote>\n<blockquote><p>                                Petition is allowed.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                            K.HEMA, JUDGE.<\/p>\n<p>tgs<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.Dineshan vs Station House Officer on 21 June, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 3730 of 2010() 1.
