Justice S.S.SATHEESACHANDRAN\n\n Dated :19\/08\/2009\n\n O R D E R\n            S.S.SATHEESACHANDRAN, J.\n          -----------------------------\n        Tr.P.(C).Nos. 123 AND 124 OF 2009\n           --------------------------\n     Dated this the 19th day of August 2009\n     -------------------------------------\n\n\n                     O R D E R\n<\/pre>\n<p>        These two petitions are for transfer filed<\/p>\n<p>under Section  24 of the Code of Civil Procedure.<\/p>\n<p>Common petitioner in these petitions is the wife<\/p>\n<p>and common respondent, the husband.     Matrimonial<\/p>\n<p>disputes between the spouses   have given rise to<\/p>\n<p>five proceedings, three of them pending before the<\/p>\n<p>Family Court, Thiruvalla at the instance of the<\/p>\n<p>wife and the other two before the Family Court,<\/p>\n<p>Ernakulam at the instance of the husband.  Wife now<\/p>\n<p>seeks transfer of the two petitions filed by the<\/p>\n<p>husband pending before the Family Court, Ernakulam<\/p>\n<p>to the Family Court, Thiruvalla where the petitions<\/p>\n<p>filed by her are pending for adjudication.     Wife<\/p>\n<p>seeks transfer of O.P 281 \/2009, for declaration of<\/p>\n<p>Tr.P.(C).Nos. 123           Page numbers<br \/>\nAND 124 OF 2009<\/p>\n<p>the marriage as null and void, and O.P No.282\/2009<\/p>\n<p>a suit for damages, both filed by the husband, and<\/p>\n<p>as already stated pending before the Family Court,<\/p>\n<p>Ernakulam.\n<\/p>\n<\/p>\n<p>          2.    Notice of the petitions was ordered to<\/p>\n<p>the   respondent    \/  husband.     Though  notice  was<\/p>\n<p>served, he has not entered appearance.      I heard the<\/p>\n<p>counsel for the petitioner.       Wife has filed three<\/p>\n<p>petitions,     O.P  196\/09,  seeking    dissolution  of<\/p>\n<p>marriage, M.C 66\/09 a proceeding under Section 125<\/p>\n<p>of the Code of Criminal Procedure and O.P 218\/09<\/p>\n<p>for seeking a decree for return of ornaments and<\/p>\n<p>valuables from the husband, and all of them are<\/p>\n<p>pending     before   the  Family    Court,  Thiruvalla.<\/p>\n<p>Pursuant to receiving notice in those proceedings<\/p>\n<p>and entering appearance before the Family Court,<\/p>\n<p>Thiruvalla, it is submitted, the husband has filed<\/p>\n<p>two petitions referred to above before the Family<\/p>\n<p>Tr.P.(C).Nos. 123          Page numbers<br \/>\nAND 124 OF 2009<\/p>\n<p>Court,     Ernakulam.      The     inconvenience   and<\/p>\n<p>difficulties of the wife to go over to Family<\/p>\n<p>Court, Ernakulam which is situate far away from her<\/p>\n<p>residence and her lack of means even to meet the<\/p>\n<p>conveyance charges are highlighted by the counsel<\/p>\n<p>for transfer of the above two O.Ps filed by the<\/p>\n<p>husband to the Family Court, Thiruvalla where three<\/p>\n<p>other petitions filed by the wife are pending<\/p>\n<p>adjudication.     The husband after receiving notice<\/p>\n<p>having    elected  to  remain   absent,   it  appears,<\/p>\n<p>practically concedes that he has no objection to<\/p>\n<p>the    transfer.     Further    more   in  considering<\/p>\n<p>comparative hardship of the parties with respect to<\/p>\n<p>questions involved in transfer of the proceedings<\/p>\n<p>needless to point out the case of the wife deserves<\/p>\n<p>more consideration where the petition sought for<\/p>\n<p>transfer has been     filed by the husband.     It is<\/p>\n<p>shown that the petitioner is residing within the<\/p>\n<p>jurisdiction of Family Court, Thiruvalla, away from<\/p>\n<p>Tr.P.(C).Nos. 123           Page numbers<br \/>\nAND 124 OF 2009<\/p>\n<p>the    Family     Court,    Ernakulam.       In   these<\/p>\n<p>circumstances, I find, transfer of O.P 281\/09 and<\/p>\n<p>282\/09 filed by the husband from the Family Court,<\/p>\n<p>Ernakulam     to  the   Family  Court,   Thiruvalla  is<\/p>\n<p>essential, and it is ordered accordingly.        Judge,<\/p>\n<p>Family Court, Ernakulam is directed to transfer the<\/p>\n<p>records of the above cases to the Family Court,<\/p>\n<p>Thiruvalla without delay.
