(2) 109  1992 SCC  (1) 331\n JT 1991 (6)   534\t  1991 SCALE  (2)1187\n\n\nACT:\nService Law:\n    Central\t Health\t     Service---Doctors--Ad\t hoc\nappointees--Regularisation of---Courts'directions for prepa-\nration\tof separate seniority list and creation of  supernu-\nmerary posts opening promotional avenues to ad hoc  appoint-\nees on par with regularly recruited doctors.\n\n\n\nHEADNOTE:\n    In\tCivil  Appeal No.3519 of 1984, filed by\t the  appel-\nlants,\twho were appointed as doctors on adhoc basis in\t the\nCentral\t Health\t Service on various dates between  1968\t and\n1977,  praying\tfor regularisation of  their  services\twith\nreference  to  their original dates  of\t appointments,\tthis\nCourt, by its judgment dated 9.4.1987 and subsequent orders,\ngave certain directions. Since the Union of India could\t not\nimplement  the\tdirections, the appellants filed  the  civil\nmiscellaneous  petition\t for clarification  of\tthe  earlier\norders\tpassed\tby this Court in the Civil  Appeal.  Certain\nother  doctors\twho fall in the category of  the  appellants\n(adhoc appointees) and who had not earlier filed writ  peti-\ntion before the High Court, filed writ petitions and  inter-\nvention\t applications  before  this Court  praying  for\t the\nbenefits as granted to the appellants.\n    It was contended by the Union of India that if regulari-\nsation was granted to all the appellants and the like  cate-\ngories of doctors, the doctors regularly appointed in  Group\nA  may\tget relegated to secondary position in view  of\t the\nfact  that  the appellants were appointed  much\t earlier  on\nadhoc basis.\n    The regularly recruited doctors, not heard earlier, also\nfiled  intervention applications praying that any  order  of\nregularisation of the appellants and the similarly  situated\ndoctors\t should ensure that their interests were not  preju-\ndiced.\n    The appellants and the other similarly situated  doctors\nexpressed  their  willingness to be considered\tfor  regular\nappointments\n110\nonly from 1.1.1973, this being the date on which the Group B\nand Group A services were merged together by the  Government\nof  India.  They also agreed to give up monetary  claims  on\naccount\t of revision of scales, regularisation or  promotion\nto which they would be entitled till 31.10.1991.\nDisposing of the matters, this court,\n    HELD:  1.  Each  of the appellants will  be\t treated  as\nregularised  in Group A of the Central Health  Service\tfrom\n1.1.1973 or the date of his first initial appointment in the\nservice\t (though  as an adhoc Group B doctor)  whichever  is\nlater. [p. 113 B]\n     2.\t In order to ensure that there is no disturbance  in\nthe seniority and the promotional prospects of the regularly\nrecruited doctors there will be a separate seniority list in\nrespect\t of  the appellants and their  promotions  shall  be\nregulated  by such separate seniority list and\tsuch  promo-\ntions  will only be in supernumerary posts to be created  by\nthe Government. [p. 113 B-C]\n    3(a). Each of the appellants will be eligible for promo-\ntion to the post of Senior Medical Officer or Chief  Medical\nOfficer\t or further promotional posts therefrom taking\tinto\naccount\t his seniority in the separate seniority  list.\t [p.\n113 D]\n    (b).The  promotion of any of the appellants to the\tpost\nof Senior Medical officer, Chief Medical Officer and further\npromotional post therefrom will be on par with the promotion\nof the regularly recruited doctor who is immediately  junior\nto the concerned appellant on the basis of their  respective\ndates of appointment, e.g. if a regularly recruited  doctor,\non the basis of the seniority list maintained by the Depart-\nment,  gets a promotion as Senior Medical Officer  or  Chief\nMedical\t Officer or further promotion thereafter,  then\t the\nappellant who was appointed immediately earlier to him\twill\nalso be promoted as a Senior Medical officer or Chief  Medi-\ncal Officer or further promotion therefrom (as the case\t may\nbe) with effect from the same date. [p. 113 D-F]\n    4.\tIn order to avoid any conflict or any  possibilities\nof reversion, the post to which an appellant will be promot-\ned  (whether  as  Senior Medical Officer  or  Chief  Medical\nOfficer or on further promotion therefrom) should only be to\na  supernumerary  post. Such number of\tsupernumerary  posts\nshould be created by the Govern-\n111\nment as may be necessary to give effect to the above  direc-\ntions.\tNo promotion will be given to any of the  appellants\nin the existing vacancies which will go only to the regular-\nly appointed doctors. [pp. 113 F-H, 114 A]\n      All  the writ petitioners and interveners, falling  in\nthe  category of the appellants, would also be\tentitled  to\nthe  same  reliefs  as the appellants for  all\tpurposes  of\nseniority and promotion. Sucharita  and  Vimal<br \/>\nDave for the appearing parties.\n<\/p>\n<p>The following Order of the court was delivered:\n<\/p>\n<p>    CMP\t No.  8076\/1988: This is an application\t by  certain<br \/>\ndoctors\t of the Central Health Service for clarification  of<br \/>\nthe  earlier orders passed by this Court in C.A.  3519\/1984.<br \/>\nActually, the appellants&#8217; grievance is that even though\t the<br \/>\nappeal was disposed of by the order of this court dated 9.4.<br \/>\n1987  and the directions given therein have been  reiterated<br \/>\nin  the subsequent orders of this Court, the Union of  India<br \/>\nhas not given proper effect to the directions given by\tthis<br \/>\nCourt.\n<\/p>\n<p>    Briefly, the appellants were originally appointed  after<br \/>\ninterview by selection committees but only as adhoc appoint-<br \/>\nees  in\t the above service. They were appointed\t on  various<br \/>\ndates between 1968 and 1977. Their grievance is that dispite<br \/>\ntheir  long service in the Department they were not  regula-<br \/>\nrised with reference to their original dates of appointment.<br \/>\nThe  Union  of\tIndia pointed out  certain  difficulties  in<br \/>\ngiving\teffect to the order of this Court of April, 1987  by<br \/>\nfiling\ta review petition and then a clarification  applica-<br \/>\ntion  but these have been dismissed. The resultant  position<br \/>\nis that all the appellants have to be regularised in Group A<br \/>\nof the Central<br \/>\n<span class=\"hidden_text\">112<\/span><br \/>\nHealth Service w.e.f. 1.1.1973 or the date of their  respec-<br \/>\ntive  original appointments whichever is later. We may\tmen-<br \/>\ntion here that this date 1.1.1973 is mentioned here  because<br \/>\nthe  appellants have now expressed their willingness  to  be<br \/>\nconsidered  for regular appointment only from this date\t and<br \/>\nnot from any earlier date, this being the date on which\t the<br \/>\ngroup  B  and Group A services were merged together  by\t the<br \/>\nGovernment of India on the recommendations of the Third\t Pay<br \/>\nCommission. The only difficulty experienced by the Union  of<br \/>\nIndia in giving effect to the directions of this Court which<br \/>\nnow subsists is that if regularisation is granted to all the<br \/>\nappellants,  doctors  who have been regularly  appointed  in<br \/>\nGroup  A  after\t an interview by the  Union  Public  Service<br \/>\nCommission may get relegated to secondary positions in\tview<br \/>\nof the fact that the appellants were appointed much  earlier<br \/>\nthough on an adhoc basis. These regularly recruited  doctors<br \/>\nhad  not been heard earlier and they have now come  up\twith<br \/>\nintervention applications praying that any order of regular-<br \/>\nisation of the appellants should ensure that their interests<br \/>\nare  not prejudiced. This was also the anxiety of the  Union<br \/>\nof India as expressed in the counter affidavit filed in this<br \/>\nCourt.\n<\/p>\n<p>    After heating all the counsel, we were inclined to think<br \/>\nthat while the appellants should get their rights which were<br \/>\ndeclared  by this Court in its earlier orders, there  should<br \/>\nat  the same time be no prejudice to the  doctors  appointed<br \/>\nthrough\t regular  recruitment by the  Union  Public  Service<br \/>\nCommission.  After some discussion, counsel for\t the  appel-<br \/>\nlants  agreed to put forward certain proposals\twhich  would<br \/>\nsafeguard  their  interests and also at the  same  time\t not<br \/>\nprejudice  the regular appointees through the  Union  Public<br \/>\nService Commission. The essence of the proposal made by them<br \/>\nis  that they may be treated to be a separate category\twith<br \/>\ntheir  own seniority list and entitled to promotion  in\t ac-<br \/>\ncordance  with that seniority list, the problem of  conflict<br \/>\nwith  the direct regular recruits being avoided by  creation<br \/>\nof  an appropriate number of supernumerary posts. The  Union<br \/>\nof  India is not agreeable to accept these  proposals  which<br \/>\nwere set down by the appellants at our instance, in the form<br \/>\nof  an affidavit. The proposals of the appellants have\tbeen<br \/>\nset  down  in an annexure to an affidavit filed by  Dr.\t PPC<br \/>\nRawani and dated 16th July, 1991. However, after considering<br \/>\nthe  matter  we are of the opinion that there is no  way  of<br \/>\nrendering  justice  to all the parties before us  except  by<br \/>\naccepting these proposals in the manner to be set down below<br \/>\nparticularly  because we find that while making the  propos-<br \/>\nals,  the appellants have also to some extent expressed\t the<br \/>\nwillingness to forgo certain rights that might have  accrued<br \/>\nto them in consequence of the earlier orders passed by\tthis<br \/>\nCourt.\tWe  are of the opinion that the proposals  made\t are<br \/>\nreasonable in the circumstances of the case and that they do<br \/>\nnot  also in any way prejudice the rights of  the  regularly<br \/>\nrecruited doctors.\n<\/p>\n<p><span class=\"hidden_text\">113<\/span><\/p>\n<p>    In\tview of this, we direct that the following  proposal<br \/>\nbe implemented by the Department by way of giving effect  to<br \/>\nthe  order of this Court in C.A. 3519\/84 dated\tApril,\t1987<br \/>\nand  the  subsequent  clarificatory orders  passed  by\tthis<br \/>\nCourt:\n<\/p>\n<p>The directions given are as follows:\n<\/p>\n<blockquote><p>\t\t1. Each of the appellants will be treated as<br \/>\n\t      regularised  in Group A of the Central  Health<br \/>\n\t      Service from 1.1.1973 or the date of his first<br \/>\n\t      initial appointment in the service (though  as<br \/>\n\t      adhoc Group B doctor), whichever is later.<\/p>\n<blockquote><p>\t\t2.  In\torder  to ensure that  there  is  no<br \/>\n\t      disturbance  of the seniority and\t the  promo-<br \/>\n\t      tional  prospects of the\tregularly  recruited<br \/>\n\t      doctors  there  will be a\t separate  seniority<br \/>\n\t      list  in respect of the appellants  and  their<br \/>\n\t      promotions (&#8216;about which directions are  given<br \/>\n\t      below)  shall  be regulated by  such  separate<br \/>\n\t      &#8216;seniority list and such promotions will\tonly<br \/>\n\t      be  in  supernumerary posts to be\t created  as<br \/>\n\t      mentioned below.\n<\/p><\/blockquote>\n<blockquote><p>\t\t3. (a) Each of the appellants will be eligi-\n<\/p><\/blockquote>\n<blockquote><p>\t      ble for promotion to the post of Senior  Medi-<br \/>\n\t      cal  Officer or Chief Medical Officer or\tfur-<br \/>\n\t      ther  promotional posts therefrom taking\tinto<br \/>\n\t      account his seniority in the separate seniori-<br \/>\n\t      ty  list which is to be drawn up as  indicated<br \/>\n\t      above.\n<\/p><\/blockquote>\n<blockquote><p>\t      (b) The promotion of any of the appellants  to<br \/>\n\t      the  post\t of Senior  Medical  Officer,  Chief<br \/>\n\t      Medical  Officer and further promotional\tpost<br \/>\n\t      therefrom will be on par with the promotion of<br \/>\n\t      the regularly recruited doctor who is  immedi-<br \/>\n\t      ately junior to the concerned appellant on the<br \/>\n\t      basis  of their respective dates\tof  appoint-<br \/>\n\t      ment. In other words, if a regularly recruited<br \/>\n\t      doctor,  on  the basis of the  seniority\tlist<br \/>\n\t      maintained by the Department, gets a promotion<br \/>\n\t      as  Senior  Medical Officer or  Chief  Medical<br \/>\n\t      Officer or further promotion thereafter,\tthen<br \/>\n\t      the  appellant who was  appointed\t immediately<br \/>\n\t      earlier  to  him will also be  promoted  as  a<br \/>\n\t      Senior Medical Officer or Chief Medical  Offi-<br \/>\n\t      cer  or  further promotion therefrom  (as\t the<br \/>\n\t      case may be) with effect from the same date.\n<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>\t\t 4.  In order that there may be no  conflict<br \/>\n\t      or any possibilities of reversion, the post to<br \/>\n\t      which  an appellant will be promoted  (whether<br \/>\n\t      as  Senior  Medical Officer or  Chief  Medical<br \/>\n\t      Officer  or  on further  promotion  therefrom)<br \/>\n\t      should  only be to a supernumerary post.\tSuch<br \/>\n\t      number of supernumerary posts should be creat-<br \/>\n\t      ed  by the Government as may be  necessary  to<br \/>\n\t      give effect to the above directions. No promo-<br \/>\n\t      tion will be given to any of the appellants in<br \/>\n\t      the  existing vacancies which will go only  to<br \/>\n\t      the regularly<br \/>\n<span class=\"hidden_text\">\t      114<\/span><br \/>\n\t      appointed doctors.\n<\/p><\/blockquote>\n<blockquote><p>\t\t5.  The appellants hereby agree to  give  up<br \/>\n\t      all monetary claims on account of revision  of<br \/>\n\t      scales,  regularisation or promotion to  which<br \/>\n\t      they would be entitled till 31.10. 199 1.\n<\/p><\/blockquote>\n<blockquote><p>\t\t6.  Apart  from\t the  appellants  there\t are<br \/>\n\t      certain doctors who fall in the same  category<br \/>\n\t      but  who had not filed writ  petitions  before<br \/>\n\t      the High Court. They have filed directly\twrit<br \/>\n\t      petitions\t before\t this  Court  beating\tNos.<br \/>\n\t      2620-2659\/1985 and intervention  applications.<br \/>\n\t      The intervention applications are allowed\t and<br \/>\n\t      rule  nisi is issued in the writ petitions  of<br \/>\n\t      which  the  other parties take  notice.  These<br \/>\n\t      interveners  and\twrit petitioner have  to  be<br \/>\n\t      granted the same relief as the appellants.  It<br \/>\n\t      is  made clear that all these  applicants\t and<br \/>\n\t      petitioners  will\t be  entitled  to  the\tsame<br \/>\n\t      reliefs as the appellants for all purposes  of<br \/>\n\t      seniority\t and promotion. All monetary  claims<br \/>\n\t      on account of revision of scales,\t regularisa-<br \/>\n\t      tion or promotion till 31.10.1991 are given up<br \/>\n\t      by These applicants and petitioners as well.<br \/>\n    We direct that, in view of the long pendency of  litiga-\n<\/p><\/blockquote>\n<p>tion  before  this  Court, the Union of\t India\tshould\ttake<br \/>\nimmediate  steps  to  implement the  above  directions.\t The<br \/>\ndirections  should be given effect to latest by 31st  March,<br \/>\n1992.\n<\/p>\n<p>    All\t the interim applications in the matter\t stand\tdis-<br \/>\nposed  of in view of the fact that the main CMP\t itself\t has<br \/>\nbeen disposed of.\n<\/p>\n<pre>R.P.\t\t\t\t\t       Matters\tdis-\nposed of.\n<span class=\"hidden_text\">115<\/span>\n\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Dr. P.P.C.
