Justice V.GIRI\n\n Dated :10\/06\/2009\n\n O R D E R\n                       V.GIRI, J\n                    .......................\n                W.P.(C).16440\/2008\n                    .......................\n         Dated this the 10th day of June, 2009\n\n                     JUDGMENT\n<\/pre>\n<p>     Petitioner purchased an extent of 11 acres 55<\/p>\n<p>cents of property comprised in survey Nos. 40\/1 and<\/p>\n<p>357\/95 of Kinavalloor Amsom Parali, under Exts.P1<\/p>\n<p>and P2 documents. The vendor of the petitioner had<\/p>\n<p>obtained the same as assignee from Kunhunni Nair,<\/p>\n<p>who in turn had taken the property from Subramanya<\/p>\n<p>Iyer,  who allegedly got it from            Poomully mana.<\/p>\n<p>Kunhunni Nair had filed an application as O.A.170\/77<\/p>\n<p>and certificate of purchase was issued in favour of<\/p>\n<p>Kunhunni Nair. Forest officials were not parties to<\/p>\n<p>the    proceedings    before         the    Land  Tribunal.<\/p>\n<p>Subsequently, the State sought for a review of order<\/p>\n<p>passed by the Land Tribunal in O.A.170\/77. Review<\/p>\n<p>was allowed and ultimately the order was affirmed by<\/p>\n<p>the Supreme Court itself.              Net result of these<\/p>\n<p>proceedings was that the complainant became unable<\/p>\n<p>to assert   any title over the property which was<\/p>\n<p>eligible to be treated as land vested in the<\/p>\n<p>Government.\n<\/p>\n<p>W.P.(C).16440\/2008<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>2.    According to the respondents, land was eligible<\/p>\n<p>to be treated as a private forest vested in terms of<\/p>\n<p>the Kerala Private Forests (Vesting and Assignment)<\/p>\n<p>Act, 1920. Even if the contentions of the petitioner<\/p>\n<p>are appreciated,    he obviously   does not have a<\/p>\n<p>vestige of right over the property.     Though the<\/p>\n<p>review petition filed by the State was allowed as<\/p>\n<p>early as on 30.6.1988, property in question could be<\/p>\n<p>taken possession of by the respondents only in 2008.<\/p>\n<p>In other words, petitioners had the benefit of<\/p>\n<p>collecting yield from the property for a period of<\/p>\n<p>almost 20 years after it became clear that he had no<\/p>\n<p>title to the same. This is apart from the fact that<\/p>\n<p>they had benefit of the property from 1981 to 1988.<\/p>\n<p>3.    Petitioners approached this Court earlier in<\/p>\n<p>Writ Petition No.8502\/2008 for a direction to the<\/p>\n<p>respondents to hand over possession of the property<\/p>\n<p>covered by Exts.P1 and P2 to enable them to take<\/p>\n<p>W.P.(C).16440\/2008<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>the yield there from. Writ petition was dismissed<\/p>\n<p>under Ext.P10 judgment holding that the land in<\/p>\n<p>question is a vested private forest and possession of<\/p>\n<p>the same          is already vested in the State.<\/p>\n<p>Subsequently respondents took steps to auction the<\/p>\n<p>right to collect yield from the property and there<\/p>\n<p>upon, present writ petition has been filed seeking a<\/p>\n<p>declaration that the petitioners are entitled to cut<\/p>\n<p>and remove the rubber trees planted in the property.<\/p>\n<p>4.   Heard learned counsel for the petitioners and<\/p>\n<p>learned special Government Pleader.<\/p>\n<p>5.   That the property belongs to the State and is<\/p>\n<p>vested in the same is no longer open to controversy.<\/p>\n<p>This fact has      again been reaffirmed   in Ext.P10<\/p>\n<p>judgment. The plea made by the petitioners for a<\/p>\n<p>right to cut and remove the rubber trees planted by<\/p>\n<p>them,     allegedly  in   the  year   1981   also  is<\/p>\n<p>misconceived. On a review       petition filed by the<\/p>\n<p>W.P.(C).16440\/2008<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<p>State in relation to the order passed by the Land<\/p>\n<p>Tribunal being     allowed,  it came about that the<\/p>\n<p>assignor of the petitioners also was declared to<\/p>\n<p>have no title     to the property. Consequently the<\/p>\n<p>petitioners also became disabled from asserting any<\/p>\n<p>right to the property vested in the Government.<\/p>\n<p>Therefore,     there is no merit in the further plea<\/p>\n<p>raised by the petitioners that they should be given<\/p>\n<p>a chance to remove the trees because they were<\/p>\n<p>planted in the year 1981. Writ petition is bereft of<\/p>\n<p>merit.
