KRISHNAN, J.\n                   ...........................................\n                    M.A.C.A.NO.1605 OF 2010\n                   .............................................\n          Dated this the 23rd day of November, 2010.\n\n                          J U D G M E N T\n<\/pre>\n<p>      This is an appeal preferred against the award of the<\/p>\n<p>Claims Tribunal, North Paravur in OP(MV)No.894\/2003. The<\/p>\n<p>claimant, a pillion rider, sustained injuries in a road accident<\/p>\n<p>and the Tribunal has awarded him a compensation of<\/p>\n<p>Rs.43,000\/=, but exonerated the insurance company from<\/p>\n<p>the liability on the ground that additional premium is not paid<\/p>\n<p>for the coverage of pillion rider. It is challenging the same,<\/p>\n<p>the claimant has come up in appeal.\n<\/p>\n<p>      2. Heard the learned counsel for the appellant as well<\/p>\n<p>as the insurance company. A perusal of the award makes it<\/p>\n<p>very clear that the two wheeler involved in the accident was<\/p>\n<p>covered by a package policy.                      There was a confusion<\/p>\n<p>regarding the coverage of pillion rider, but by virtue of two<\/p>\n<p>decisions of this Court and later by a clarificatory circular<\/p>\n<p>issued by the Insurance Regulatory and Development<\/p>\n<p>Authority dated 16.11.2009, it has been cleared. As per the<\/p>\n<p>clarificatory circular, after quoting the conditions of policy,<\/p>\n<p><span class=\"hidden_text\">                               : 2 :<\/span><br \/>\nM.A.C.A.NO.1605 OF 2010<\/p>\n<p>it was stated that the persons carried in a two wheeler and<\/p>\n<p>passengers carried in a private vehicle are covered by a<\/p>\n<p>standard motor package policy. Similarly in the decisions<\/p>\n<p>reported in    <a href=\"\/doc\/135962\/\">New India Assurance Co. Ltd. v. Hydrose<\/a><\/p>\n<p>(2008 (3) KLT 778) and in <a href=\"\/doc\/1457758\/\">Mathew v. Shaji Mathew<\/a> (2009<\/p>\n<p>(3) KLT 813) after analysing the conditions, the Division<\/p>\n<p>Benches held that      terms and conditions of the policy cover<\/p>\n<p>the risk of pillion rider and no additional premium is<\/p>\n<p>necessary.\n<\/p>\n<p>      3.Therefore    in    the   light of    the  authoritative<\/p>\n<p>pronouncements, the insurance company is liable to pay but it<\/p>\n<p>has to be made clear that        from the date   16.7.2008   to<\/p>\n<p>17.8.2010 the claimant will not be entitled to claim any<\/p>\n<p>interest for the reason that there was a delay.<\/p>\n<p>      4. In the result, the MACA is partly allowed and finding<\/p>\n<p>of the Tribunal exonerating the insurance company from the<\/p>\n<p>liability is set aside and the insurance company is made<\/p>\n<p>liable. The insurance company is not liable to pay interest for<\/p>\n<p>the period from 16.7.2008 to 17.8.2010. It is also made clear<\/p>\n<p>that, if the cost ordered in the delay condonation petition is<\/p>\n<p><span class=\"hidden_text\">                            : 3 :<\/span><br \/>\nM.A.C.A.NO.1605 OF 2010<\/p>\n<p>not paid as ordered on or before 23.12.2010, the appeal will<\/p>\n<p>stand dismissed.\n<\/p>\n<\/p>\n<p>                                 M.N.
