                               2. The appellant has been convicted for offence<\/p>\n
                     under Section 307 I.P.C. and sentenced to undergo<\/p>\n
                     rigorous imprisonment for four years.              Further the<\/p>\n
                     appellant has been convicted for offence under Sections<\/p>\n
                     25, 26 and 27 of the Arms Act, but has been sentenced<\/p>\n
                     only under Section 25 of the Arms Act for one year and<\/p>\n
                     no separate sentence has been given for offence under<\/p>\n
                     Section 26 and 27 of the Arms Act.\n<\/p>\n
                               3. The prosecution case as alleged in the<\/p>\n
                     Fardbeyan by the informant Md. Muzammil Hussain that
\n               2<\/span><\/p>\n
he has land dispute with regard to partition of land with<\/p>\n
his brother-in-law (Sala) Md. Hussain. A case of<\/p>\n
partition was going on before Sub Judge, Hajipur, since<\/p>\n
last several years. On 14. 04. 1985, Md. Chand, son of<\/p>\n
his brother-in-law Md. Hussain came and asked him to<\/p>\n
execute a sale deed with regard to informant’s share of<\/p>\n
land in favour of appellant’s father. The informant<\/p>\n
disclosed that according to Muslim Law he has share in<\/p>\n
appellant’s fahter property and he will take his share. He<\/p>\n
will not execute any sale deed on which accused take out<\/p>\n
country made gun tried to fire at the wife of the<\/p>\n
informant but in the meantime the informant catch hold<\/p>\n
of the hand of appellant and pointed the gun down on<\/p>\n
which of the gun the daughter of informant Dil Afroj<\/p>\n
Khatun got injurty by the splinter. The daughter of the<\/p>\n
informant was also there to snatch the gun from the<\/p>\n
accused.   It is alleged that gun was snatched by the<\/p>\n
informant. The informant, his daughter, wife, mother-in-<\/p>\n
law and Abdul Salam claims to have seen the<\/p>\n
occurrence. It is also asserted that on sound of fire arm<\/p>\n
several people of the village collected to saw the<\/p>\n
occurrence. It has further been alleged that Md. Chand
\n              3<\/span><\/p>\n
tied with rope and was kept at the dawaraja of neighbour<\/p>\n
Md. Hafiz. The informant kept the fire arm in his house<\/p>\n
and went to inform the police. He could not meet the<\/p>\n
police at police station as the Police Officer had<\/p>\n
proceeded to some other work.      When the informant<\/p>\n
returned he found that the accused was not there and it<\/p>\n
was learnt that accused had flee away by untieing the<\/p>\n
rope.\n<\/p>\n
         4. On the Fardbeyan, F.I.R. was lodged. After<\/p>\n
investigation charge sheet submitted.      During trial<\/p>\n
thirteen witnesses were examined. However, P.W. 4 is<\/p>\n
the informant, P.W. 2 is wife of the informant and P.W.<\/p>\n
5 is the daughter of the informant. P.W. 2, 4 and 5 have<\/p>\n
supported the prosecution case about fire arm. However,<\/p>\n
P.W. 6, the doctor found two injuries on the person of<\/p>\n
daughter of the informant; first is abrasion and injury<\/p>\n
was simple in nature caused by hard and blunts<\/p>\n
substance and injury no. 2 also a simple and superficial<\/p>\n
injury caused by hard and blunt substance. However,<\/p>\n
P.W. 1, though, stated that he heard the sound of firing<\/p>\n
and learnt from son of Md. Jamir and then saw Md.<\/p>\n
Chand tied in a pillar. P.W. 3 stated that one Anwar
\n               4<\/span><\/p>\n
Hussain came and call him and disclosed that Md. Chand<\/p>\n
has injured his sister. However, said Anwar Hussain has<\/p>\n
not been examined.      P.W. 13 is the I.O. who in his<\/p>\n
evidence has stated that he did not find any sign of fire<\/p>\n
arm nor he found any blood nor found any trampling<\/p>\n
mark, but only found broken churi. However, it is stated<\/p>\n
that firm arm (country made gun) was produced by the<\/p>\n
informant to the Darogaji in the police station.<\/p>\n
         5. The trial court taking into consideration the<\/p>\n
evidence that P.W. 2, 4 and 5 have supported the<\/p>\n
prosecution case and further seizure list was prepared<\/p>\n
and even the report of the Sergeant Major and sanction<\/p>\n
has been proved and country made gun was produced in<\/p>\n
presence of P.W. 8, convicted the appellant as mentioned<\/p>\n
above.\n<\/p>\n
         6. Learned counsel for the appellant however<\/p>\n
contended that occurrence is of the year 1985,<\/p>\n
admittedly, there is land dispute between the parties.<\/p>\n
The evidence of witnesses with regard to use of fire arm<\/p>\n
has not been supported by any other witnesses except<\/p>\n
P.W. 2, 4 and 5.       In the Fardbeyan itself there is<\/p>\n
mentioned that at the time of occurrence several persons
\n               5<\/span><\/p>\n
were there and there is specific mention of the presence<\/p>\n
of the mother-in-law of the informant and one Abdul<\/p>\n
Salam. The prosecution case itself indicates that after<\/p>\n
sound of fire arm several people of the village collected.<\/p>\n
But except P.W. 2, 3 and 5 who are informant, his wife<\/p>\n
and daughter have come to support the prosecution case.<\/p>\n
There is no mention in the Fardbeyan that victim was<\/p>\n
tied with a pillar. It is only stated that Md. Chand was<\/p>\n
tied and was kept at the dawarja of the neighbour of<\/p>\n
Hafiz. However, neither Hafiz nor any of the person of<\/p>\n
the family of Hafiz has come to support the prosecution<\/p>\n
case. Hence it is contended that finding recorded by the<\/p>\n
lower court without proper appraisal of the evidence.<\/p>\n
         7. Learned counsel for the State however<\/p>\n
submits that witnesses have supported the prosecution<\/p>\n
case about fire arm and injuries found on the victim the<\/p>\n
daughter of the informant.\n<\/p>\n
         9. However, taking into consideration the case<\/p>\n
of prosecution itself shows that there was enmity with<\/p>\n
regard to land dispute between the prosecution party and<\/p>\n
the appellant and it is alleged that appellant take out fire<\/p>\n
arm and fired but at the intervention of the informant he
\n               6<\/span><\/p>\n
did not hit the wife of the informant, but its splinter hit<\/p>\n
the daughter of the informant and she injured. However,<\/p>\n
the explanation given for injury caused on her palm due<\/p>\n
to scuffle between victim and accused in snatching the<\/p>\n
gun is a further development.\n<\/p>\n
         10. However, except P.W. 2, 4 and 5, no<\/p>\n
witness has come forward to support the prosecution<\/p>\n
case about possession of fire arm with the appellant nor<\/p>\n
there is evidence about snatching of fire arm nor there is<\/p>\n
any evidence after snatching of fire arm which was kept<\/p>\n
with the informant. It is only stated by the informant<\/p>\n
that he snatched the fire arm and kept in his house, but<\/p>\n
there is no evidence of any witness that they saw the fire<\/p>\n
arm just after the occurrence. The medical evidence also<\/p>\n
does not suggest that injury of the victim was on fire arm<\/p>\n
rather it has been specifically asserted that injury caused<\/p>\n
by hard and blunt substance. The I.O. in his evidence<\/p>\n
has also not supported the prosecution case that he found<\/p>\n
any remain of the fire arm at the site of the occurrence.<\/p>\n
However, only evidence is that the informant produced<\/p>\n
the fire arm to the I.O. and hence except evidence of<\/p>\n
P.W. 2, 4 and 5, there is no evidence at all regarding
\n               7<\/span><\/p>\n
possession of fire arm or regarding the fact that appellant<\/p>\n
fired or there is no evidence that just after the occurrence<\/p>\n
any one saw for snatching the gun or kept in the house of<\/p>\n
the informant. Hence possession and use of fire arm has<\/p>\n
not been established and hence conviction for offence<\/p>\n
under Sections 25, 26 and 27 of the Arms Act is not at<\/p>\n
all sustainable in view of evidence of witnesses.<\/p>\n
However, it has been stated that there was several<\/p>\n
persons came at the place of occurrence just after the<\/p>\n
occurrence even there P.W. 2, 4 and 5, but none has<\/p>\n
come to depose. It is true that if there is complication<\/p>\n
between the parties, oral evidence and evidence of the<\/p>\n
doctor prevail.\n<\/p>\n
         11. However having regard to the facts and<\/p>\n
circumstances of the case, since oral evidence itself does<\/p>\n
not inspire confidence as P.W. 2, 4 and 5 are interested<\/p>\n
and inimical witnesses and wife of the informant who<\/p>\n
came to P.O. after the occurrence has come to support<\/p>\n
the prosecution case that at the time of occurrence<\/p>\n
accused armed with fire arm or even fire arm was<\/p>\n
snatched or even saw the fire arm having snatched and<\/p>\n
kept by the informant and hence it is apparent that story
\n                                 8<\/span><\/p>\n
                 of possession of fire arm is not at all established by<\/p>\n
                 cogent, reliable and unimpeachable evidence.<\/p>\n
                            12. However, having regard to the fact that<\/p>\n
                 injury found also not suggestive to have been inflicted<\/p>\n
                 with intention to kill as both the injuries are simple and<\/p>\n
                 superficial and even not on vital part of the body and<\/p>\n
                 hence inference cannot be drawn that injury was inflicted<\/p>\n
                 with intention to kill and hence order of conviction under<\/p>\n
                 Section 307 I.P.C. recorded by the lower court is hereby<\/p>\n
                 set aside. Having regard to the fact that there is evidence<\/p>\n
                 regarding scuffle and assault and hence offence under<\/p>\n
                 Section 323 and 324 I.P.C. only be made out.<\/p>\n
                            13. However, having regard to the fact and<\/p>\n
                 circumstance of the case, the occurrence is of the year<\/p>\n
                 1985, and appellant has remained in jail for about forty<\/p>\n
                 days and hence interest of justice shall meet by<\/p>\n
                 sentencing the       appellant   for the   period already<\/p>\n
                 undergone. Hence the appeal is allowed in part with<\/p>\n
                 modification of sentence.\n<\/p>\n<\/p>\n
