Justice M.C.HARI RANI\n\n Dated :19\/06\/2009\n\n O R D E R\n                 R.BASANT &amp; M.C.HARIRANI, JJ.\n                         * * * * * * * * * * * * *\n                       W.P.(Crl).No.232 of 2009\n                      ----------------------------------------\n                 Dated this the 19th day of June 2009\n\n                            J U D G M E N T\n<\/pre>\n<p>BASANT,J<\/p>\n<p>      The petitioner has filed this petition praying for issue of a writ of<\/p>\n<p>habeas corpus to search, trace and produce his wife Preethi, a woman<\/p>\n<p>aged 27 years (date of birth : 11\/04\/1982). It is the contention of the<\/p>\n<p>petitioner that he and the alleged detenu Preethi were married on<\/p>\n<p>5\/12\/2008 and their marriage was solemnised and registered under<\/p>\n<p>the Special Marriage Act. Ext.P1 is the certificate issued to confirm<\/p>\n<p>that fact.\n<\/p>\n<p>      2.   According to the petitioner, after marriage, they were<\/p>\n<p>residing together harmoniously. The 3rd respondent who is employed<\/p>\n<p>abroad had come down and under the pretext that there could be a<\/p>\n<p>harmonious settlement, the alleged detenu Preethi was taken to her<\/p>\n<p>parental house.   It is the contention of the petitioner that the 3rd<\/p>\n<p>respondent, the brother of Preethi had thereafter illegally detained<\/p>\n<p>her and the petitioner was not being permitted to have any contact<\/p>\n<p>with the said Preethi.\n<\/p>\n<p>      3.   The petition came up for admission on 17\/6\/2009. The<\/p>\n<p>petition was admitted.       Notice was ordered to the respondents.<\/p>\n<p>Today, when the matter came up for hearing, the petitioner and his<\/p>\n<p><span class=\"hidden_text\">W.P.(Crl) No.232\/09               2<\/span><\/p>\n<p>counsel are present. The 3rd respondent and mother of Preethi &#8211; the<\/p>\n<p>alleged detenu are also present. Preethi &#8211; the alleged detenu has also<\/p>\n<p>come to court along with her mother.\n<\/p>\n<p>     4.      We ascertained the response of the alleged detenu Preethi<\/p>\n<p>and she confirmed to us that she was married to the petitioner and he is<\/p>\n<p>her legally wedded husband. She asserted that she wants to leave the<\/p>\n<p>court along with the petitioner.\n<\/p>\n<p>     5.      Smelling the opportunity for a harmonious settlement of the<\/p>\n<p>dispute between the parties after hearing all concerned, we requested<\/p>\n<p>Sri.N.R.Chandrasekharan &#8211; a trained mediator who happened to be<\/p>\n<p>present in court to help the court to explore the possibilities of a<\/p>\n<p>harmonious settlement. The Nodal Officer was informed. The parties<\/p>\n<p>were sent to the mediator. By 1 p.m, the mediator has submitted a<\/p>\n<p>report in which it is reported that the parties have settled all their<\/p>\n<p>outstanding disputes harmoniously.      The settlement reached in the<\/p>\n<p>course of mediation duly signed by the petitioner, the third respondent,<\/p>\n<p>the alleged detenu and the mother of the detenu confirm that all<\/p>\n<p>concerned accept that the petitioner and the alleged detenu to be legally<\/p>\n<p>married spouses. It is agreed that none of the parties shall raise any<\/p>\n<p>objections to the harmonious marital relationship between the petitioner<\/p>\n<p>and the alleged detenu Preethi.\n<\/p>\n<p>     6.      The petitioner through his counsel and the alleged detenu<\/p>\n<p>Preethi submit that no further directions are necessary in this writ<\/p>\n<p><span class=\"hidden_text\">W.P.(Crl) No.232\/09                3<\/span><\/p>\n<p>petition. The alleged detenu Preethi requests the court that it may be<\/p>\n<p>ensured that she is permitted to live harmoniously and without any<\/p>\n<p>hindrance with her husband, the petitioner herein.<\/p>\n<p>      7.     We are, in these circumstances, satisfied that the settlement<\/p>\n<p>reached in mediation can be received and recorded and this writ<\/p>\n<p>petition can be dismissed.      We accept the submissions of the 3rd<\/p>\n<p>respondent and his mother Agnus that they shall not cause any<\/p>\n<p>hindrance or obstruction to the harmonious marital tie and co-habitation<\/p>\n<p>of the petitioner and the alleged detenu. If there be no obstruction,<\/p>\n<p>needless to say, the petitioner and the alleged detenu can approach the<\/p>\n<p>police authorities who shall ensure that necessary protection is given to<\/p>\n<p>the petitioner and the alleged detenu to so harmoniously lead a marital<\/p>\n<p>life.\n<\/p>\n<p>      8.
