PUBLIC PROSECUTOR for\nOpponent(s) : 1, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\nDate\n: 21\/09\/2010\n \n\nORAL\nJUDGMENT<\/pre>\n<p>The<br \/>\n\tappellant has preferred this Appeal under Section 374(2) of the Code<br \/>\n\tof Criminal Procedure, 1973 against the judgment and order of<br \/>\n\tconviction and sentence dated 29th August 2005 passed by<br \/>\n\tthe learned Presiding Officer, Fast Track Court No.2, Dahod, in<br \/>\n\tSessions Case No.12 of 2004, whereby the learned Presiding<br \/>\n\tOfficer has convicted the appellant-accused under Sections 394, 397<br \/>\n\tand 114 of the Indian Penal Code.\n<\/p>\n<p>The<br \/>\n\tcase of the prosecution is that on 06th December 1996 at<br \/>\n\tabout 08:30 p.m. the appellant with the help of another accused<br \/>\n\tcaused injuries to the complainant with sickle and caused injury to<br \/>\n\tthe witness and looted ornament worth Rs.10,400\/-. Therefore, a<br \/>\n\tcomplaint to the said effect was filed against the present appellant<br \/>\n\ton 06th December 1996 with Limkheda Police Station.<br \/>\n\tThereafter, after investigation, charge-sheet was filed against the<br \/>\n\tappellant before the learned Presiding Officer, Fast Track Court<br \/>\n\tNo.2, Dahod.\n<\/p>\n<p>\tThereafter<br \/>\n\tthe trial was conducted before the learned Judge. To prove the case<br \/>\n\tof the prosecution, prosecution has produced oral as well as<br \/>\n\tdocumentary evidence.\n<\/p>\n<p>After<br \/>\n\thearing both the sides, the learned Presiding Officer, Fast Track<br \/>\n\tCourt No.2, Dahod, by his judgment and order of conviction dated<br \/>\n\t29th<br \/>\n\tAugust 2005 passed in Sessions Case No.12 of 2004 was pleased to<br \/>\n\tconvict the the present appellant for the offence punishable under<br \/>\n\tSections 394, 397 and 114 of the Indian Penal Code and ordered to<br \/>\n\tsuffer rigorous imprisonment for the period of seven years and fine<br \/>\n\tof Rs.1,500\/-, and in default of payment of fine, the appellant is<br \/>\n\tordered to undergo simple imprisonment for a further period of three<br \/>\n\tmonths. However, it is clarified that all the substantial sentences<br \/>\n\tshall run concurrently.\n<\/p>\n<p>Being<br \/>\n\taggrieved by and dissatisfied with the said judgment and order of<br \/>\n\tconviction dated 29th<br \/>\n\tAugust 2005 passed by the learned Presiding Officer, Fast Track<br \/>\n\tCourt No.2, Dahod, in Sessions Case No.12 of 2004, the appellant<br \/>\n\thereinabove has preferred the present Criminal Appeal before this<br \/>\n\tHon&#8217;ble Court.\n<\/p>\n<p>I<br \/>\n\thave heard Mr.M.A. Kharadi, learned counsel for the appellant and<br \/>\n\tMr.H.H. Parikh, learned Additional Public Prosecutor, appearing on<br \/>\n\tbehalf of the respondent-State. I have also gone through the papers<br \/>\n\tproduced before me and the judgment and order of conviction passed<br \/>\n\tby the trial Court.\n<\/p>\n<p>Mr.Kharadi<br \/>\n\thas taken me through the evidence of prosecution witnesses and the<br \/>\n\tdocumentary evidence and submitted that from the above evidence it<br \/>\n\tis established that the prosecution has failed to prove its case<br \/>\n\tbeyond reasonable doubt. He has contended that the order of<br \/>\n\tconviction is illegal, improper and unjust. He has contended that<br \/>\n\tthe learned Judge has committed grave error in believing the<br \/>\n\tprosecution story that the accused was caught on the spot. He has<br \/>\n\tfurther contended that he is arguing this matter only for the<br \/>\n\tpurpose of quantum of punishment and not on merits. He has also<br \/>\n\tcontended that looking to the ratio of conviction, it is very harsh<br \/>\n\tand is required to be re-considered and hence, contended that the<br \/>\n\tjudgment and order of conviction is required to be set aside.\n<\/p>\n<p>Heard<br \/>\n\tMr.H.H. Parikh, learned Additional Public Prosecutor<br \/>\n\tfor the respondent-State. He has supported the judgment and order of<br \/>\n\tconviction passed by the learned Presiding Officer. He has contended<br \/>\n\tthat looking to the charge framed against the appellant, order<br \/>\n\tpassed by the learned Judge is just and proper. He has also read the<br \/>\n\tdocumentary evidence produced on record and contended that learned<br \/>\n\tJudge has not committed any error in convicting the<br \/>\n\tappellant-accused. He, therefore, contended that the present appeal<br \/>\n\tis required to be dismissed.\n<\/p>\n<p>I<br \/>\n\thave<br \/>\n\tgone through papers produced before me and the judgment and order<br \/>\n\tpassed by the learned trial Court. I have also perused the oral as<br \/>\n\twell as documentary evidence led before the trial Court and also<br \/>\n\tconsidered the submissions made by learned counsel for the parties.\n<\/p>\n<p>Looking<br \/>\n\tto the facts and circumstances of the case and looking to the fact<br \/>\n\tthat the appellant-convict was in custody for almost five and half<br \/>\n\tyears, if the sentence already undergone by the appellant-convict be<br \/>\n\ttreated as sentence, the same would meet with the ends of justice.\n<\/p>\n<p>Hence,<br \/>\n\tthe present appeal is partly allowed. The judgment and order of<br \/>\n\tconviction dated 29th<br \/>\n\tAugust 2005 passed by the learned Presiding Officer, Fast Track<br \/>\n\tCourt No.2, Dahod, in Sessions Case No.12 of 2004, is hereby<br \/>\n\tconfirmed.  However, the judgment and order of sentence dated 29th<br \/>\n\tAugust 2005 passed by the learned Presiding Officer, Fast Track<br \/>\n\tCourt No.2, Dahod is hereby reduced and modified to the extent of<br \/>\n\tsentence which the<br \/>\n\tappellant has already undergone and the appellant shall be set at<br \/>\n\tliberty forthwith if he is not required to be detained in any other<br \/>\n\tcase. The rest of the judgment and order dated 29th<br \/>\n\tAugust 2005 shall remain unaltered. Bail bond, if any, shall stands<br \/>\n\tdischarged.
